When the client's wife calls and asks for the receipt, you are pretty justified thinking that she acts for him since he *married* her. And of course there is the public policy defense. After Leroy Greer's wife filed for divorce in January 2006, he began seeing another woman and sent his new girlfriend a dozen long-stemmed roses. Actually the question is whether or not the credit card used was a joint account since the billing address is the same as the wifes. We are all ssuming that it was because of the "Thank You Card" if could have very well been the wife saw the "Thank You Card" looked at the bank statement and called about the charges. I don't see you calling a retailer over a thank you note but she would need more then a name and address to get information. Such as credit card, number, expiration date, and billing address. And she would need to say more then I need to know why you sent my husband a thank you card. Probably along the lines I have a unauthorized charge on my credit card what is it for. I so understand this situation. When a black man becomes sucessful his whole family wants to cash in because they feel like they are entitled too him and his sucess (MONEY). Mama, sisters, cousins, nephews and nieces, grandma(pa) and the dady(if he has one who knows him). So when he marries someone and give her a good material life (as he should because its his wife), they all get mad at her, the wife, act their plain old getto-drama mess, make his wife life impossible, try to put her down and all kind of schemes. Just because she is enjoying what she more than likely help him build, because if he came from nothing or not much, then he must have had some kind of help from his woman. But because his mama man did not give her much, his sister had kids from men who do not give them much, and so on... they all get mad, and hate on the sister who is his wife. The black man is already traumatized by his family, by the sexual conduct that he saw while growing up, that just having sex with a whole bunch of different women helps to calm the issues he has in his mind. He doesn't know how to love, how to give love, how to receive love, how to live like a respectable monogamous man, how to protect his woman and children, how to respect the God he claims to worship. He is just a plain human emotional and psycological disposal(as is most of his family if they have not broken the cycle) even though he might be economically successful.
I learned this after going to counseling with my husband who had the same behaviors, and who's family felt the same way about me as the Greer family feel about Bernice.

Beside my personal views about Mr. Greer and Ms. Kelly (She obviously uses her Maiden name to hide the fact she is married) This case has no legal merit and Mr. Greer is wasting 300K on a useless defense. I can understand why he's being charged 300K by his lawyer because this makes her look equally as bad nevertheless business is business. Three points that make this case useless are:
1. Is there any proof that part of his conversation with the sales/customer service rep indicated that he did not want any correspondence? Proof would be either another person hearing this conversation other then the two parties, written transcript of the conversation or recorded transcript.
2. How did the company obtain a address that wasn't his? He claims that at the time of the purchase he was not living at that address. But to make that purchase he had to provide a address. So why did he give them that address if he was not living there?
3. He claims he and his wife were not together at the time of the purchase. So why would he be concerned about any correspondence. He wouldn't have been doing anything wrong. If you aren't doing anything wrong why would you attempt to cover your tracks as he says he did.
4. Was there intent to mislead him? His wife and others would call if they receive information about purchases they don't know anything about. With identity theft and credit card fraud harming thousands a day it was in her and her husbands best interest to question the purchase. It could've been a fraudulent purchase.
1800 flowers is not responsible for outcome of his marriage based on his actions. If someone steals your car and hits and kills someone while in the act of committing the felony would you be responsible for that death because you had a nice car, would the car manufacturer be responsible because he has theft deterant alarm and the car was stolen anyway.
