(Dismissed) Lawsuit of the Day: Stephen Dunne Comes to His Senses?
First the case of the $54 million pants was dismissed. And now another ridiculous but amusing lawsuit, previously covered here and here, bites the dust.

The federal court battle over a Massachusetts bar examination question about homosexual marriage has ended with the court accepting the plaintiff's voluntary dismissal of the case.On Oct. 9, a Massachusetts federal judge granted Stephen Dunne's request to dismiss his case against the bar examination testing agency, the state Supreme Judicial Court and four individual justices over a question on the state's bar exam concerning homosexual marriage.
In a lawsuit filed in June, Dunne claimed he failed the Massachusetts bar examination because he didn't answer a question about homosexual marriage.
The website Stephen Dunne launched to help fund the case, www.christianlawsuit.com, has been taken down. Will refunds be issued to the people who donated money to the cause -- all three of them?

to further 3:11's logic a bit, i can see a good cause of action in contract for breaching the implied contract with above the law commenters that as a single white male, one will not date a non-asian woman.

Um, Dunne doesn't seem to have come to his senses at all. He's voluntarily dismissed the case because he apparently believes that the state bar has agreed not to include gay marriage questions on future bar exams because there was no gay marriage question on the last bar exam. In fact, the state bar had to specifically say that its lack of a gay marriage question on the latest bar exam does not reflect any sort of agreement between the state bar and Dunne.
When did WGWAG become white guys with Asian girls-- wasn't it the reverse?
Even if he passes the Mass bar, he should be banned on C & F grounds.
In IL, Matt Hale, a crazy neo-Nazi leader, has been refused admission to the bar - despite having passing scores - because he cannot agree to uphold the state's (and in his case, the federal) constitution (equal protection, civil rights, etc.).

I wonder if the reason that he dropped his law suit is that it became clear that he would not have passed the bar but for the gay marriage question. Either way, this guy sounds like someone who would have a hard time passing a bar exam no matter what was on it.

1. No, ATL has been doing "_____ of the Day" forever (maybe even longer than the WSJ).
2. ATL's honorees are more entertaining. The WSJ "Lawyer of the Day" posts are usually BJs of the lawyer in question, while the ATL "Lawyer of the Day" posts involve embarrassing f**k-ups.

What was so fascinating about that dismissal order? It was a one-sentence order dismissing the case. No rhyme, doggerel, or blank verse, unfortunately.
It's just amazing that NYU is so highly rated, given the massive numbers of nutjobs like Dunne it graduates.
