I think he only felt he could get away with that because he knew he was talking to a "TV judge" rather than a real judge. And I think she sensed that too, which is why she got so pissed off.

What "next forum"? It's the People's Court. Isn't being the judge on this travesty a major embarrassment in itself? And isn't screaming and running away at the commercial pretty poor conduct, or at least it would be in a non-trash-TV court?
It's binding arbitration for the most part. Pretty rock solid and nearly impossible to overturn, even if they get the law completely wrong.
The whole tone is disrespectful and just dumb- constantly interrupting, and you've got to roll with what the judge gives you. You're not going to beat a judge who says "That's not x." by saying "that's not?" with a sarcastic hypothetical. Any judge in the country would slap this guy around.
I did find the line about how if ANYBODY would take it seriously, it would be a 2L at MIAMI, kind of funny, as though 2L at Miami is the highest peak of the legal profession.

God, I loved this. Sure, this was the People's Court, but the guy had it coming. As someone said before, this is too many law students in this country that think they know it all. Isn't the first thing in Civil Procedure that they teach you, even before the actual "law", is to never talk over the person holding the gavel?

In all candor, if the guy says, "There's an application process of some sort". Isn't that putting the other party on notice that, um, there's an application that needs to be filled out ... which will be reviewed by someone ... and that someone will render a decision on whether to accept or deny an application? If people on Court TV behaved like real lawyers and real judges, they wouldn't put them on TV. This is "entertainment," not reality, and it doesn't tell us much about how these people would behave in their real-life roles. The kid acts like a spoiled brat, and the "judge" acts like an intemperate hothead. Its a close call, but I would say the "judge" is a bit ickier, since she actually used to be a judge before she became an entertainer.

What I was going for was that she told the guy he was embarrassing "us," presumably meaning Miami Law School. But does she think that having a yelling "judge" in a fake courtroom makes Miami proud? im pretty sure these TV judge shows are basically binding arbitration deals. it is unclear who has appellate jurisdiction over such shows but presumably you argue in front of an en banc panel with Alton Brown, that obnoxious british chef guy, Tom Skerrit, and Chuck Woolery. dunno about choice of law provisions.

Correct me if Im wrong, but don't these TV court shows actually pay for all of the costs handed down by the judges? I thought the producers found the most interesting "cases" and then the actual costs are paid essentially in exchange for the appearance. Oh, and I completely concur with 1:56(b).
That law student is a disgrace to our profession. Unfortunately, there are many law students that show the same lack of respect and intelligence. The truly graceful ones are few and far between.

Pretty much. Each party gets an "appearance fee," and if they lose, the judgment is taken from their fee.

3:51 - that's an excellent point. If she's not acting as a real judge, she's probably not entitled to any sort of judicial immunity. I'm sure the poor guy had to sign a release - but if the premise of the show is that it will loosely follow the law, and she throws the law out the window and then damages his reputation to improve her ratings - I'd say he's got enough of a claim to overcome the waiver. I doubt the waiver covered the conflict of interest between a litigant and the judge arising out of the judge's conflict of interest.

well deserved- you don't mouth off to a judge as a law student- the usual riffraff on these shows don't know any better, but this kid presumably has had appellate advocacy, moot court, etc, and should know better. I would hope this shows up at the 2l's c&f exam. I know someone on the appeal committee, and I assure you this will not bode well for getting admitted.

Experienced, successful trial attorneys interrupt and talk over judges ALL the time. I've seen it happen consistently, even in high-profile trials. Law schools teach this wrong.

It's all about putting on a show, well hopefully so in her case. It's kind of ironic how she goes on to say he's embarrassing UM. What is her explosive behavior doing, and she was a teacher? Irony at it's best in my opinion.
Keep in mind that we don't know what the show's producers told this guy beforehand. He may have been instructed to be aggressive just so they could get that moment on tape -- "reality" shows are like that.

NEWSFLASH: The People's Eleventh Circuit Court of Appeals has just AFFIRMED Judge Milian's ruling in this landmark case. The defendant/appellant 2L, however, has vowed to take the case all the way up to the Supreme People's Court in Hollywood. Asked for comment on the decision handed down today by the three judge panel consisting of Judges Judy Scheindlin and Joe Brown and Senior Judge Wapner, the appellant 2L responded, "well, that's just like their opinion...they're totally full of sh-t."

First Rule you learn in Law School is that a lawyer that represents himself in court has a fool for a client. Second Rule is that in such a forum or if you go into small claims court on your own behalf, NEVER tell the judge you've studied law. Because then the judge will think of the First Rule and treat you accordingly.
The first rule I learned in law school was 12(b)(6) failure to state a claim upon which relief may be granted

She's a cute hollywood actress, even if she has been an attorney and a judge. The Peoples Court show is hogwash. Some of the plaintiffs/defendants have to be coached on what to say. Our legal system has its faults, absolutely! But, if court judges really acted like her, crimes would greatly increase in frequency. And, I wouldn't want to be an attorney or a judge. Life is too valuable.
