Associate Bonus Watch: Freshfields Matches

associate bonus watch 2007 law firm Above the Law blog.jpgFrom the London Times:

Lawyer aims for KO

A City solicitor who swapped the boardroom for the boxing ring is to make her professional debut. Laura Saperstein, 36, from Tottenham, North London, was a mergers and acquisitions lawyer with Freshfields, earning £75,000 a year. Three years ago she left to train full-time and won the British lightweight amateur title. Her bout, against a Swedish opponent at Tooting Leisure Centre, will be on November 18.

We're guessing that Ms. Saperstein is enjoying her new career, in which she's already encountered significant success. But perhaps she misses her old job, or at least the paycheck of her old job, this time of year.

Her former employer, the Magic Circle firm of Freshfields Bruckhaus Deringer, just announced bonuses for its New York and D.C. "fee earners." The memo appears after the jump.

Wow - these guys have actually taken note of the criticisms of other bonus announcements in defining "good standing" and in their honesty regarding the discretionary nature of bonuses in future years.

They also pay D.C. Woohoo! The market in D.C. is set. Anyone who can't cough up Freshfields, Skadden, etc. dough in D.C. is decidedly second tier.

Posted by No, Discretionary is Right | Permalink Wednesday, November 14, 2007 6:12 PM

The correct phrase is "to all intents and purposes." This phrase dates back to the 1500s and originated in English law, where it was "to all intents, constructions, and purposes." In modern usage, "for all intents and purposes" is also acceptable. The phrase means "for all practical purposes" and is generally used to compare two nonidentical acts or deeds, i.e., "She went to his room and drank with him, which he viewed ? for all intents and purposes ? as consent to sex." A shorter equivalent phrase is "in effect."

When used in a strictly legal sense, the wording would be "intent and purposes," as it refers to one's mental attitude/state at the time said action occurred.

A common malapropism is "for all intense and purposes" ? a result of the original phrase being misheard and repeated. The word "intense" is used here incorrectly; "intense" is used in English to indicate a degree of intensity, i.e., "As the afternoon passed, the fire grew more intense."

For "all intensive purposes" is flat wrong. Now, where did YOU got to school, moron?

The phrase is a corruption of "for all intents and purposes" by persons who have heard the phrase, but have not read it in it's proper form. It means "for all intents, and for all purposes."

I am a recent law school grad interested in doing some tutoring for current San Diego-area law students. I would work with you not just on individual subjects, but on devising a plan for your whole academic experience.

As you have probably already heard, legal recruiting is very superficial. The best way to set yourself apart is to get great grades and make law review. Once you do that, you should have no trouble landing a 2L summer associate position or a clerkship. Anyone can do it. Unfortunately though, most students don't develop a good approach until after the first 1L semester - or even after the second 1L semester. That's when dreams are broken!

Accordingly, what I would do with you is work out a general strategy for all of your coursework. This would include editing your brief so you have a quality writing sample for your law review application. In addition, I'd help you condense your study materials and work with you on a proven problem-solving approach to exam preparation.

I went to a law school that is ranked about the same as USD. My skills would apply well for a student of any law school that emphasizes learning the bar material well. The whole Harvard & Yale jurisprudence approach is over my head. Fortunately, it is also irrelevant to students in SD law schools!

I graduated magna cum laude, was a published member of the law review, and worked as a teaching assistant and judicial clerk. I could work out a price with you that's reasonable - probably something like $50 for the first hour of each on-site session (maybe at your law library), and $30 for each hour thereafter or for time I spend at home reviewing your work. I'd also be available by phone for questions outside of these sessions, at no extra charge, so long as you are reasonable.

I really enjoy this stuff, and I need something fun to do. So let's make a deal! It will improve your grades and chances of making law review to work with someone with experience. It's chump change compared to your tuition and books!

My name is Jason. E-mail me if you are interested: sdlawtutor@yahoo.com.

6:23 - Special bonus paid out Nov. 30. Regular bonus paid out Dec. 31. And ahead of year-end review process. No chance that someone won't get their bonus based on what happens in reviews.

Freshfields matched for all associates in the US -- they only have offices in NY and DC.

The six CC structured finance associates who got fired probably contributed much to CC's overall success for the year as part of the structure finance boom, but were fired the day before bonuses were announced. Not very classy. Look at McKee Nelson for an example of class.

Can anyone please give some background why its called the Magic Circle? That nickname sounds really odd to those who are not familiar, including other lawyers. Is there a Council of White Wizards and Red Wizards? Do the firms have some alliance between Elves and Men that dates back to the time of magic?

What is funny about the "Magic Circle" is that they all pay starting salaries (in the UK) less than a couple of US Firms. No, not Skadden.

What is backwards is that Weil is the market leader, with Jones Day in second.

UK is apparently BIZZARO world.

As a partner at a "large" DC firm (hint: it's not H&H or W&C, but it does start w/ P), all this speculation about special bonuses in DC is pure folly. Many factors are at play here, but the most prevalent is that my partners and I just don't think you associates deserve that kind of cash for the work you're doing. In fact, most of us still are shocked you are getting 160k in DC - no offense, but your work product does not warrant it. And, before you jump down my throat, remember not to shoot the messenger.

If any of you actually WORKED at LW, you'd know that they ALWAYS announce late and by late, I mean in late January/early February. So please spare yourself some keystrokes until then. And LW traditionally pays more in NYC than its other offices. Without arguing the merits of this, don't shoot the messenger (hell I'm in LA anyhow).

So can we please stop with LW. Not that anyone seems to care, but Paul Hastings announces even LATER than LW in LA.

someone made a point before that some employment law issue made it advisable to always preface bonuses with the discretionary language.

K&E did not punt. It simply cannot announce a spreadsheet of numbers like the other NY firms because each associate gets a different amount. The bonuses are discretionary (and high). It does not do lock-step bonuses.
