Cumberland Law School Clusterf**k: Law School Listserv Lunacy

Cumberland School of Law Samford University Above the Law blog.jpgThis actually happened quite some time ago -- last month, to be exact. But we're happy to write about it because (1) it hasn't been blogged about elsewhere, as far as we know, and (2) with the passage of time, tempers have cooled. So maybe now people can look back on it with amusement rather than anger.

A summary, from one of the several tipsters who drew our attention to this:

A friend of mine at Cumberland School of Law in Birmingham, Alabama, sent me this. Apparently some girl sent out a mass email about President Bush's veto of some health care legislation. This set off a whole clusterf**k of responding emails, with the debate devolving into one over race and class. From reading through the several threads, it's almost frightening that some of these people are actually going to become lawyers.

[One of the more] recent post[s] is especially enlightening.... [T]he author states that "The powers that be count on sellouts to climb the ladder of success and refuse to help those underneath them. That way they can use you sellouts as tokens...."

However, the most hilarious part of this whole thing is where one of the black (1L) students responds to an Asian student by saying, "To the Asian.....u aint black." Further idiocy follows.

The aforementioned "idiocy," after the jump.

Here are the emails. We've edited a bit for length and clarity. All emphases added. We've used initials to preserve anonymity while allowing readers to follow who is saying what.

President Bush recently struck down a bill, supported by both Democrats and Republicans that would have expanded health insurance benefits available to poor children. It is estimated that 9 million children are uninsured nationwide, that number continues to climb as employers slim down the coverage they offer to employees. The president’s recent actions show that he is not only out of touch with the needs of one of America’s most vulnerable populations, they also show that he simply doesn’t care.

Congress wanted to expand the State Children’s Health Insurance Program (SCHIP), which helps families who earn too much to qualify for Medicaid but can’t afford private coverage obtain health insurance for their children. The bipartisan group proposed a bigger budget for the program, increasing spending by $35 billion over five years so an additional 4 million children would be covered by the program. SCHIP currently serves 6 million children.

TAKE ACTION BEFORE FRIDAY OCTOBER 19, 2007 - This is not about party lines it is about providing healthcare to those who need it the most....

My what a pompous response. Are you serious? Tell me that this is another untimely, crude joke!!

Correct me if I'm wrong, but we are LAW students aren't we? Since when did Cumberland Law School become an institution in which speech is quelled? The right to free speech applies to those speakers with whom we disagree.

We (well most of us) are here to expand our philosophical horizons. We, as the future lawmakers of America, owe it to ourselves, our colleagues, and our communities to delve into issues such as these. If we can't express our thoughts with our peers, then with whom might we express those thoughts? So, is our listserv, our sole means of mass communication with our colleagues, the "appropriate means for delivery" of such messages? Of course it is!

I was going to keep my distance from this heated discussion, BUT I felt compelled to defend my colleagues free expression of speech.

BTW, since when did we start equating children w/ puppies?

Free speech is great, but when I open my mailbox and find 18 back-and-forth emails on SCHIP, it's time to arrange a forum to hash it out. I'm sure everyone on each side of this argument has great points. However, not everyone in this law school cares about, or wants to know about, your opinion.

Please do not hit "reply all" when sending these types of e-mails. I'm sure it's some kind of Honor Code violation.

P.S. Read the Wall Street Journal from yesterday to see what happened when NY and Mass. passed a type of "universal health care" bill.

You've been urged to "take action by October 19" and urge several members of Congress to reverse their vote and overturn President Bush's veto of the Democrats' version of the State Children's Health Insurance Program (SCHIP) reauthorization.

If you decide to take action, remember first that President Bush supports increasing funding from $24 billion from 1997-2007, the original amount, to $29 billion from 2007-2017. The big spenders in Congress want to make $34 billion. And guess where that money comes from?

Other things to remember when you "take action":

Don't call and harass Congresspeople who think that families who make $80,000 shouldn't get free health care from the rest of us.

How many poor people do you know?

Have you ever been poor?

Do you even know what it's like to not have health care or anything else for that matter?

How many poor people are in your family, in your social circle, at your church?

I think your response was a little uncalled for and a bit callous. Healthcare is important and I have family members and friends who have suffered without it. I think you should think about how issues like this affect people no matter what political party you support and as law students we should be aware of issues like this. Especially when issues like this affect the least among us.....children. This is not about a battle of words or political parties. I think as privileged law students we sometimes forget about people who are less fortunate, those who aren't in our "circles."

Although I agree with your response, unfortunately, this is a battle of political parties. This is a topic that has less to do with the forgetfulness of the privileged and more to do with the differences in values and priorities of people. Some people, for example, find it more important to make sure the health needs of children are taken care of and are willing to have their pay docked a little bit to ensure that happens. Some people think it is better to keep all their own money and take a "top-down approach" to taking care of the poor and underprivileged. Hence the political division. I believe this is not an issue that should be politicized, but the harsh reality is that you cannot separate politics from spending, whatever the spending is for. Even worse is the factors involved in approving spending often have more to do with which party is proposing the spending. Think about these things when it comes time to vote, and do it.

P.S. We should go out to some place like Greene County, Alabama and ask them to weigh in on how the "top-down" approach is working out for them.

"callous" by definition is "showing or having an insensitive and cruel disregard for others."

personally, i think it's a low blow to say that to a fellow law student who simply responded, intellectually so, to an email sent out to the masses.

regardless of whether you agree with him, calling his statements "callous," (when he obviously put time and effort into informing the student body of his views, and his email though stressing his views, doesn't include any remarks that purposely are meant to cruelly disregard others) and ccing that email to the entire student body is just plain rude.

and personally, i thank D.B. for responding and giving us the other side of this debate. his email wasn't "uncalled for," - but the basis for your attack (simply wondering whether he knows any poor people,) - totally uncalled for. if you disagree with him, attack him on his facts. don't go making this into a personal attack on how much money you think he makes or the type of people you think he associates with.

oh, and before i get attacked on my merits, i'll state for the record that i know what it's like to be poor, i know what it's like to not have health insurance. my family came to this country 26 years ago with nothing but the clothes on their backs. growing up i lived off welfare and free lunch. so perhaps in your opinion my two cents might be worth more since i've actually lived a life of poverty? well here it goes: poor people are not helpless. and to think otherwise, in my opinion, is an insult to the hard work so many people like my parents have done. they went from working as janitors in fast food joints to getting their masters within 8 years. they did this while raising three children: one who is now a doctor, a second working on wall street, and a third in law school.

my views on healthcare? not important. what IS important is that if everyone insists on making this a public debate, let's make it an intellectual one based on facts and figures, and let's leave the insults out.

And my folks are the ones who need this healthcare.

True there's a lot of poor white children that could benefit from increased access to healthcare, but let's be honest this is aimed at Black people. Black America is not unemployed, we're underemployed. We work. We work hard. Been working hard for hundreds of years to make this country great. Problem is, we make six and seven dollars per hour. Who can live off of that? But you don't see Bushy saying anything about raising the minimum wage so people can afford their own healthcare. U didn't catch Bushy trying to help Katrina victims. You won't catch Bushy fixing the no child left behind crap either. Why? Cuz it's his way of continuing to oppress Black People. You disagree? U don't think this a Black issue? Well as I have been so eloquently told..."You are delusional." Disguising this as a rich and poor issue is just that...a disguise. Poor people are Black. Wealthy people are white. This is a historical truth and as long as people ignore this reality every political issue will come back to that.

I don't usually get involved in this stuff, but in this case I felt I must speak. Hdealth [sic] care for the poor is not strickly [sic] a Black issue. I do not dispute that there are many black children who would benefit from this legislation. However, there are millions of poor children: black, white, hispanic, asian, etc. I personally believe that you should not denounce (is that spelled right?) them or their plight by saying that this is only a black issue. It is what it is: a poor issue. Just for the record, my family still lives below the the state and national poverty levels.

I was unaware that Cumberland Law students are going to be "the future lawmakers of America." Maybe that's not a bad thing, Mr. Andover/Yale/Harvard hasn't exactly done a great job. But of all the e-mails, the one that should really be a career killer was "President Bush supports increasing funding...to $29 billion from 2007-2017. The big spenders in Congress want to make $34 billion." $5 billion makes one a big spender and you defend the man who spent $1,000,000,000,000+ in Iraq (a trillion looks pretty scary when you actually type it out, don't it). What a fucking piece of dogshit.

I sense there will be some spirited political debates in 'Bama ID firms in the future.

That email exchange is Exhibit A as to why student loan debt cannot be discharged in bankruptcy. Unless you go to a good school like Hofstra, you will not be able to repay your debt. Cumberland is clearly nowhere near Hofstra in terms of prestige and student body intellect.

Also - Cumberland...I mean, its in Alabama...what more do you want? But sheesh, you people are such school snobs. I don't attend a T12 school but I sure had a 1L BigLaw firm summer associate position in NY last summer and will have one this summer in DC.

Who knew everyone at Cumberland was nuts? I always figured it had at least a few conservatives. Maybe they didn't bother to dig into a list serv fight.

By the way, I think "it's not about politics, it's about [indisputably great thing]" is a great liberal argument. Conservatives don't make it nearly as much. (You know, it can be about "saving the health of poor dying children" or "protecting the innocent whales" and still be about politics.)

I can't discount that it being forwarded didn't have anything to do with race, but it is also over-sensitive of you to assume it certainly did.

I was going to pick on that also, but from the context of the email it seems possible they were referring to Ivies from poor backgrounds in general, not the two who attend Cumberland. Practitioners of certain rhetorical styles would address the world in general in the 2nd person. Note the use of "these Ivy League universities."

I might hire the one who pointed out it was a forum issue as a case manager, but the rest are hopeless.

Voice of reason - I concede that I MAY be sensitive however, in the limited time that I've been reading ATL whenever an email has been forwarded to the masses - thereby hindering somebody's employability - it has been a person of color. Perfect example - the Latina from Columbia law who was lambasted by everyone on ATL (nearly ALL non-minorities).

The internet simply allow people to express their true feelings without the (thin) screen of racial politeness. I don't know about you, but I rather prefer the honesty of naked racism over the must more dangerous hidden prejudice.

Fact of the matter is that a lot of the stuff that goes on IS in fact what people are thinking and are too polite/scared to say. I don't see the point of them masking it over the internet.

I don't see how any of these emails would affect someone's view of the emailer. An email is ungrammatical? OK, they'd have to fire everyone at my firm for that infraction. She called him "Bushy" -- I'd guess it was intended to be snarky. It's certainly more endearing that Hitlery.

Unless you're so politically worked up you won't hire someone who doesn't share your views, or you're a rascist who doesn't like uppity black folk, this seems like a non-event.

this listserv discussion was worthless. no one bothered to mention how the proposed SCHIP expansion was to be funded? no one considered it relevant to whether one should be for/against this proposal? it's actually a complex and interesting issue but this "discussion" did not hit on *anything* relevant.

No, Cumberland 3L, but we think a lot less of your admissions committee. Who the hell let these morons who can't draft a coherent sentence (let alone an entire argument) into law school? I hope for Cumberland's sake that the majority of your students are better than this.

I'd also question how long this went on before the administration decided to act by shutting down or screening the listserv. My alma mater started screening student listserv messages years ago.

Please keep in mind that 100% of UA Law students taking the Alabama Bar this year passed, due in part to the fact that so many Samford students did NOT. So I wouldn't worry too much about these "political geniuses" ever actually becoming lawyers. Because odds are they'll still be trying to pass the bar a decade from now.

I go to Cumberland and the funniest part of the e-mails were left out. Someone found 3 puppies on the side of the street and sent an e-mail giving them away. The e-mail just happened to be in the middle of this clusterf***. People then started asking about why Bush doesn't give puppies healthcare (poking fun at the idiots engaging in these arguments). Those were the best and it is very sad this site left them out.
