Regarding Too Much Litigation: Right idea, but finger pointing at the wrong people. A large part of the blame goes to the insurance industries' "Never Say Settle" attitude. In cases of obvious liability, they will refuse to settle, forcing the plaintiff to sue... and to request excessive damages to cover the attorneys' fees made necessary by the insurance company's refusal to settle.
One case I was personally involved in: plaintiff's condo is flooded when pipes burst in condo upstairs. Turns out the upstairs neighbor went on vacation in the middle of winter and left the windows open. It was so cold in the apartment that the water in the toilet was frozen solid. Plaintiff wanted $3,000 to replace matress, carpet, a few other things. He even reduced the value to take into account the used condition of the property destroyed. Insurance adjuster for the upstairs neighbor refused to pay. They actually told me that theives had broken into this 5th floor apartment condo, didn't take anything, but left the window open and locked the door behind them. If I disagreed, I was free to bring it to court.
Another true story: a man is injured in the bathroom when a ceiling fan's blade broke off and hit him in the head. Big laceration on the forehead, many stitches, scarring. The insurance adjuster denied coverage, claiming that the plaintiff caused the accident. What, by choosing the stall that was positioned under the ceiling fan? Or perhaps you think he was jumping up and down while peeing?
