That said, Key is not blameless--he's clearly a publicity hound who saw his chance and pounced. Its just too bad Regent couldn't have been the bigger person and just ignored him.

the state action could be found in amount of govt funding that goes to the school (which no doubt is substantial given the white house inhabitants). its a tough argument to make, but a clever one nonetheless.

there is no case law up to this point that supports the notion that just because a private institution receives federal funding, it is a state actor...in fact, with the current Supremes, do not look for this to change at all in the near future.
This is very different from Title IX issues regarding discrimination on the basis of gender; it this case, if an institution receives ANY federal funding, it must abide by federal regs regarding gender discrimination...this is just not the case with freedom of religion, or other constitutional claims that this guy is bringing forth.

Harvardgirl: Sorry, I forgot to reply to your question. We're 12 attorneys, 5 partners, 6 associates, 1 counsel in the NY area. And yes, being an attorney is not all about biglaw - the money is of course nice, but there are plenty of people who go to Biglaw for a year and flame out really quickly.
