OK, maybe the ABA norms, I'll grant him that...I just don't know enough about how the ABA would nuance their requirement, while at the same time respecting the institutional autonomy and confessional integrity of the myriad of law schools that are sponsored by universities with a religious sponsorship and/or foundation. And there are many of them out there.

But as for the Higher Ed Act...Huh? Title VI and Title IX claims for gender/racial discrimination in private institutions that receive federal aid, yes.

But a first amendment claim based on the Higher Education Act? Not likely at all. First of all, many private institutions of higher ed (particularly those of a religious persuasion) have restrictive codes of conduct that limit students' free expression, and these institutions still receive federal funds.
