Lawsuit of the Day: Move Over, Judge Halverson

He weighs more than 500 pounds, but that wasn't enough to tip the scales of justice for ex-cop Paul Soto.

The rotund retiree lost his legal argument that it was a line-of-duty fall outside a doctor's office that cost him his NYPD career. A judge says it was actually his "morbid obesity."

"There's no dispute that [Soto] is physically incapable of performing his duties as a police officer. He is morbidly obese, suffers from narcolepsy and is hypertensive," Manhattan Supreme Court Justice Judith Gische wrote in her decision made public yesterday.

Apparently the physical vigor of being a cop doesn't always keep off the pounds:

When Soto joined the force in 1993, Gische found, he weighed approximately 250 pounds. He is now 40, 5-foot-7 and over 500 pounds.

A former colleague at the 6th Precinct said Soto's gun belt was an incredible 6 feet long, and his bosses would order him to take walks around the stationhouse for his own good. They would also have other officers shadow him to make sure he didn't pick up food along the way, he said.

It's a good thing Soto doesn't work at a law firm, where office-wide emails about extra sandwiches left in conference rooms make the rounds daily.

He was obese when he joined the force, so why was he hired in the first place? Don't they have fitness requirements?

I feel like I should laugh, but this guy must have a serious mental issue that caused this problem. When you have to be followed by fellow officers to prevent you from eating . . . you have a serious problem.

9:47: The article doesn't say what his height was when the force hired him. Perhaps he was taller then.

The NYPD has physical fitness requirements when you start on the force, but I'm pretty sure there are no continuing fitness requirements once you've made the force, which is how you end up with obese cops like this clown. Amazing!

The article said he was 5'7 and 250lbs when he was hired, so apparently, the NYPD doesn't have physical fitness requirements to be hired or to continue on the force.

i think restaurants should have "no fatty sections"--it's so fucking difficult to eat while looking at them. in fact, let's ban them altogther from the restaurants and make them eat outside in the cold. then we can laugh at them as if we are somehow superior.

If Cop files suit against local donut shop alleging liability for making the baked goods so tasty as to have induced him to become addicted to them, thereby causing the heft and job loss, then lost wages are surely consequential damages ...

Wow, 5'7"? In 1993 he was actually 6'10".
