Mike Nifong Is Bankrupt (and Not Just in the Ethical Sense)

Disgraced and disbarred, Mike Nifong is now bankrupt. The former North Carolina prosecutor, whose career imploded with his botched handling of the Duke University rape case, today filed for bankruptcy, listing liabilities in excess of $180 million. A summary schedule from Nifong's Chapter 7 petition can be found below. Almost all of that sum represents legal claims filed against the former Durham County district attorney by members of Duke's 2006 lacrosse team, including the three players who were accused of raping a stripper at a team party.

Included among Nifong's assets are a 2003 Honda Accord, about $9000 in personal property, and his $235,000 home. He lists nearly $5000 monthly in pension or retirement income and describes himself, charitably, as retired.

By the way, question for bankruptcy people: assuming Nifong successfully declares bankruptcy, would a civil suit by the Duke kids be barred as stemming from events that preceded the bankruptcy judgment?

Overall, Lat's posting frequency has been in the tank lately. It is noon, and he's got 3 posts, one of which was the morning docket. This not to mention his survey "posts." I used to refresh this blog every 30 minutes, now I'm lucky if I get over here a couple times a week. What happened?

Considering that he tried to ruin the preppy frat boys lives, I can't think of a single reason why they wouldn't want to return the favor as much as possible.

To all-- I would think even Lat's minimal journalistic standards would have required including that salient detail in his rip-off of the WSJ Blog entry, rather than expecting me to go read the story there. Silly me for expecting this blog to include all the relevant facts to a story in its "reporting."

11:42 - I would think that even your minimal reading skills would have required seeing that salient part of the paragraph which reads:

If he turned tricks, he might be able to pay it off. Lining up 40 Johns a day, at $250 each, would generate $10k a day, or $3.65 million/year. For a reasonable settlement, at say $30 million, and a with healthy helping of lubricant, he could make ammends by the end of his pathetic life. I think he should take it for the team.

While I think Nifong is getting what he deserves, I can't help but be discouraged that Crystal Gail Mangum (the false accuser who continues to enjoy anonymity in the media) has not also been sued. Nifong played his part in all of this to be sure, but the entire debacle started with her and it should come back to haunt her. Letting people like her get away with things like this is nothing short of a travesty. If she's not going to do time, she should at least lose what few assets she has.

12:56: While your point has some validity, and the players are free to sue an out of work stripper in the back woods of NC, the DA's office probably recieves these bogus charges all the time. As trained attorneys trusted with the people's safety and money, it is their job to vet out the BS and only prosecute guilty people. Especially when you have to hide evidence to keep the case from becoming laughable. Nifong also went further to make inappropriate comments about the players to the media.

As for the stripper's assets, I don't think that surrendering two zebra stripped body suits, a 24 pack of rubbers, and a case of stipper dust is going to serve much purpose.

1:22, there's specific deterrence and then there's also the novel concept of general deterrence to be considered. Furthermore, there's also vindication of the public (and the victims, to be sure) at stake here. If the criminal justice system won't enforce the appropriate laws, then at least the civil law should impose some sort of penalty on people who stake through the criminal justice system thanks to identity politics (see also O.J. Simpson)
