Update: Bingham Associate Given Date Rape Drug?
Internal Email Offers Rebuttal to Ex-Associate’s Claims
As litigators know all too well, there are two — or more — sides to every story. Unfortunately, in many controversies involving law firms, we never hear the firm’s side (usually because they clam up — we try to pressure them give them incentives them to talk, but we don’t always succeed).
Earlier today, we reported on allegations made by a former associate at Bingham McCutchen in Boston. Michelle Moor claimed that (1) she was drugged at the firm holiday party; (2) a fellow Bingham associate told Moor that she had also been drugged — and then raped — by a Bingham employee the year before; and (3) a male employee at the firm “made ‘a number of alarming sexually inappropriate comments’ about ‘roofies’ and having sex with unconscious women.” Along with Moor’s allegations, we posted a brief statement from the firm.
Now we can bring you more of the firm’s side of the story. Earlier this afternoon, Bingham McCutchen’s general counsel, William Southard, sent out an internal email to all personnel. The email contains more specifics than the firm’s prior statement.
We got our grubby paws on it, of course. Based on the email, it seems to us that Bingham has handled this difficult situation with sensitivity and “delicate handling” (as touted in its ubiquitous advertisements).

I’m sure many of you have seen or heard about today’s media reports concerning a filing yesterday by Michelle Moor with the Massachusetts Commission Against Discrimination. Because the reports and the filing contain alarming allegations, we thought it appropriate to respond briefly about the personal safety issues raised in Ms. Moor’s filing. While we empathize with the concerns raised by Ms. Moor, we want to address the allegations contained in the media. Because of the pending legal process, we are constrained in what we can say, but we do want to stress the following.
First, Ms. Moor reported that at the 2007 associates Christmas party at an off-site location she was given a date rape drug which made her ill and required treatment at an emergency room. The events occurred in a public restaurant with a very large number of people present over the course of the event, including numerous people unaffiliated with the firm. Our initial desire was to begin an immediate investigation, however, Ms. Moor asked us to refrain because she did not want her privacy compromised and because she felt that it would be difficult to determine the identity of the offending party at such a public venue. Only after Ms. Moor was comfortable with proceeding did we undertake the investigation. Ultimately, we could not determine, and Ms Moor could not say, who might have introduced the drug, how the drug was ingested or whether the person who did this had any affiliation with the firm. We did, however, conclude that the events, whatever their genesis, furnished an important reminder to all of us that issues of personal safety arise in all aspects of present-day life. As a result, commencing in January we began to plan to better inform all of our personnel about safety measures that they can take, and are conducting personal safety training sessions for all lawyers and staff in the Boston office. We will expand the reach of those efforts to the rest of the firm. We also engaged in outreach to concerned personnel in the Boston office to detail what had transpired, and sent out an email to all Boston personnel informing them of the off-site incident and advising them of the need to be aware of these types of concerns. We have today in Boston issued a response similar to this one to address Ms. Moor’s allegations.
Second, Ms. Moor purports to describe a second incident that occurred at some point in the past involving the drugging and rape of an associate. We investigated this assertion, though Ms. Moor refused to identify the associate whose story she purported to relate. Without any identifying information we had no way of verifying the report or reaching any conclusions about it. We have very recently been contacted by the associate referenced by Ms. Moor. Without going into details, we have learned Ms. Moor’s information is fundamentally inaccurate.
Third, Ms. Moor complains of comments made in her presence by a firm staff member concerning date rape drugs and she accuses the firm of not acting appropriately in response to them. The allegations of a failure by the firm to act are unfounded. When the firm learned of the comments, an exhaustive confidential investigation was undertaken over a period of several weeks, not only because the reported comments were inappropriate, but also because of the prior events at the Christmas party. At no time in the investigation was the firm able to conclude there was any connection between the inappropriate comments and the events at the Christmas party. Upon completion of the Firm’s investigation, the staff member identified by Ms. Moor was terminated.
We are very disappointed that Ms. Moor resigned from the firm and that she has filed her complaint, and we disagree strenuously that there is any basis, factual or legal, for any of her claims. The thrust of Ms. Moor’s MCAD complaint — that the firm was unresponsive to the concerns she raised — is simply untrue. Despite Ms. Moor’s complaints, the safety of firm personnel is of paramount importance to us, as the current safety training efforts and numerous other programs reflect.
Given the pendency of the complaint, please maintain this information as confidential. Please feel free to contact Ralph Martin or me with any questions you may have.

By that email, it does not seem that Bingham is "constrained" in any way from speaking on the matter. Pending legal process be damned, and they've called Ms. Moor a liar (well, "fundamentally inaccurate"). This is going to get ugly.
Why didn't they just disclose this information when the incident first appeared in the news? Do they think they have something to gain, or lose, by withholding this information? Whether they like it or not, the internet is here to stay, and secrets cannot be protected forever.

I don't buy BIngham's side of the story. I spent my 1L summer working in Boston last year and went to one of Bingham's summer recruiting events for law students in the city. They tried very hard to cultivate a party-hard fratboy environment and more than one of their associates got drunk and made inappropriate passes at me.
I raised this with a former classmate of mine from undergrad who is now a second-year associate there. She told me that you learn to avoid certain jackasses and it's not that big of a deal. Importantly, she didn't disagree with my assessment.
Bingham wanted to cultivate an atmosphere of freewheeling fratboys and they got it. Why are we at all surprised when something like this happens? An environment of suspended accountability of unlimited male perogative is not something that any professional services firm should strive for nor should we be surprised when this kind of outrageous behavior arises.
The bottom line is this: discussions of date rape at a firm event should be alarming and not a matter of course. I have to disagree with my friend who works there. This is not a bad egg but a cultural problem at Bingham and secretly trying to remove one actor without realizing that there's a huge problem is just going to lead to more headaches.
If there's one thing that's clear to me, it's that this memo was drafted with a precise eye toward getting into ATL. Congratulations, Bingham, on being the first firm to figure out how to use Lat to your advantage.

The second year I was to make the bigger noise. I rewrote personal statement, found better recommender. I researched much of the informations on Harvard Law School. I went over application to Harvard Law School, as you are to say in the other idiom for English, with the fine-toothed comb. I say for you if you are to attempt to groom the dog with fine-toothed comb for certain you are to realize inherent lack of dignity in the mix of the metaphor. Also the mix of the metaphor was soon to turn to the mix of the drink, when with relief I am receive the important news: accept for 2006 Harvard Law School class. It was with greatest shock I was to discover lack of eligibility for educational visa for the next two year. This is the third year in which I am apply for Harvard Law School. Because of problem with the visa, I am at this time apply for Harvard class for 2008. Possible you are to think that apply the three times for Harvard Law School is to demonstrate the dogged persistence. For this reason I am ask that you are to accept me and also to allow for defer the additional year. Even dog need time off to lick the crotch before once again yelp, bark, and chase after the crimson cat.

Everybody knowing that HLS is "best in Asia" and that America's University, Washington College of Law is "best in Americas." ATL's posting of Columbia and NYU are better than Hofstra which, if you are the Magma of, I cannot at this time understand. Why, if you are best of Hofstra, you did not attend best of New York which is the Columbian University in Harlem.

9:23-24 - Stop lying. I would never do toilet law like ADA in Nassau County. I am going to Zarb in the fall. Right now, I'm poking around to find a firm that will hire me on as a summer associate with the hopes of having a chance at landing me full-time after I have my MBA. Firms would really like to have a guy like me who has the Triple H with a JD/MBA. I almost had an interview at a Vault Top 71 Firm last week, but it fell through at the last minute. I'm not worried though, there are plenty of other firms out there.
