Lawsuit of the Day: Hit-and-Run Bentley Driver Strikes Again

A Coney Island businessman is suing the city for damaging the Bentley he was driving when he killed a Brooklyn dad in a hit-and-run accident.

Harry Shasho, who pleaded guilty to leaving the scene of an accident, says the NYPD failed to safeguard the battered black 2005 Bentley GT luxury sedan that was impounded as evidence of the fatal crash. He's asking for at least $190,000.

It sounds like Shasho needs a bit of a reality check:

Shasho says the Bentley was in "excellent condition ... with no noticeable defects or damage" when he turned himself in, according to the suit filed in Brooklyn Federal Court.

The police report tells a different story. It describes the car as crumpled and the windshield "depressed and fractured" by the violent impact with [victim Louis] Couch that left his body parts strewn across the street.

The suit seeks damages from the city, the NYPD and the Brooklyn district attorney's office.

Not the kind of case you'd like to take to a jury.

Being that a deer weighs the same as a male adult human and being that if you hit a deer you're entire front end of your car is typically totaled...I have no idea where this guy determined that he didn't do any damage to his car when the impact was so high that it killed the person...

Guys in my high school used to slam their Bentleys into unfortunate pedestrians, then stick the police with the repair bill all the time; it was no big deal.

the real story here is why anyone would pay so much money for such a god-awfully ugly automobile. One could acquire an Aston Martin for about the same amount and drive around in style. WTF?

Shasho sould really be suing the widow and family of the guy he killed because the deceased is likely the actual proximate cause of the damage to his Bently.

But I do know one thing. When my client's Bentley gets damaged after killing a pedestrian, then he is entitled to no less than two million in compensatory damages, and two million in punitive damages. Thank you.

The guy seems like a douche for filing such an appalling bad (from a PR perspective) lawsuit, but many people are failing to notice 16's comment. Namely, that the pedestrian who was hit by the Bentley was, according to the story, drunk. The Bentley's owner DID, apparently, flee the scene, but it's not like he was driving drunk and just nailed some guy. If some drunk idiot stumbles into the street in front of your car, sometimes there's nothing you can do.

I don't, however, buy the argument that the cops were the actual ones who did the damage to the car.

Not taking this a-hole's side by any means. But the victim was drunk and that is definitely a factor. This happened to me a bunch of times, where I'm driving and some idiot drunk stumbles in front of my car. If I don't brake, guy is dead. In this case, we don't know all the details. I'm just saying.

32: I can say with confidence that Bentley + Ocean Parkway + scene-fleeing = driver who was driving way too fast and way too recklessly, regardless of whether the guy killed was drunk.

31 - not true. A Bentley coup costs about $170, whereas a comparable Aston Martin coup costs about $175.

Yeah this guy sucks and he shouldnt have driven off. Still, 2 plaintiff points -

1. Is it too much to ask the police to store confiscated property without in turn destroying it (at least more than it already was?). When someone gets out of prison, they get their stuff back, not their stuff left in a bag in the rain for 2 years.

2. Not only was the victim drunk, but he was using the Mexican crosswalk (ie, middle of the damn street out of nowhere), across a pretty major road (Ocean Parkway).

let's get a few facts straight...I knew Peter for many many years (since I was a child) and while he was drunk the night he was MURDERED he was never a stumbling drunk, so he didn't just walk in front of the moron's bently while crossing the street aimlessly. The moron hit and KILLED Peter and fleed the scene of the crime. He didn't turn himself in until 12 hours after the accident...which pretty much tells me that he was probably drinking and driving and knew that he'd be arrested w/a dui and probably do jailtime for MURDER. That guy left a human being in the middle of the street to die like an animal. Any damage to his car was done by the impact of a person hitting his car. The lawyer who is taking this ridiculous lawsuit should be disbarred and the judge should revoke the sentance and stick this idiot in jail.
