How Many SCOTUS Cases Should a VP Know?
Sarah Palin’s interview with Katie Couric last week made me … happy. But the McCain-Palin campaign appears nonplussed with the post-interview spin.
Maybe the campaign feels pressured by the latest “global electoral college poll.”
Regardless, the campaign is set to “re-introduce” Sarah Palin. Palin, and McCain this time, sat down with Katie Couric again. (I guess Mel B was unavailable.) The new interview that will air sometime after the debate.
The McCain-Palin ticket is apparently pumped about how the new interview went. They want CBS to air the full interview, unedited. But the campaign is mad that CBS leaked a snippet of last week’s Couric interview that did not air:
Of concern to McCain’s campaign, however, is a remaining and still-undisclosed clip from Palin’s interview with Couric last week that has the political world buzzing.The Palin aide, after first noting how “infuriating” it was for CBS to purportedly leak word about the gaffe, revealed that it came in response to a question about Supreme Court decisions.
After noting Roe vs. Wade, Palin was apparently unable to discuss any major court cases.
There was no verbal fumbling with this particular question as there was with some others, the aide said, but rather silence.
I’ll pause for criticisms about the liberal media, northeastern elites, and my mother.

Okay. But to speak plainly, is it really too much to ask that the person within a heartbeat of naming the next Supreme Court Justice (alright, two heartbeats) be able to name at least a few important decisions? Even Bush the Younger was able to do better than that. Remember the 2004 Presidential debate, in which Bush said:
I wouldn’t pick a judge who said that the Pledge of Allegiance couldn’t be said in a school because it had the words “under God” in it. I think that’s an example of a judge allowing personal opinion to enter into the decision-making process as opposed to a strict interpretation of the Constitution.Another example would be the Dred Scott case, which is where judges, years ago, said that the Constitution allowed slavery because of personal property rights.
That’s a personal opinion. That’s not what the Constitution says. The Constitution of the United States says we’re all — you know, it doesn’t say that. It doesn’t speak to the equality of America.
Come on. Turning Dred Scott into an example of an overactive liberal Court is the highest form of legal sophistry!
At the very least, shouldn’t Palin have the legal knowledge of George W. Bush? We’ll have to wait and see if she gets a word in this Thursday, or if she just sits back while Biden threatens to kill Barack Obama.

While I think Sarah Palin is unfit to be vice president, I don't really understand how this question would have come up. What did Katie Couric say? "Name as many Supreme Court cases as you can. Right now!" Anyone might have blanked in those circumstances. Palin sucks, but without more information, this seems silly to me.

I know a case that the Governor of Alaska should know...how about Exxon Shipping Co. v. Baker? It was only decided in June and drastically cut (from $2.5b to $500m) the punitive damages that victims of the Exxon Valdez oil spill will receive.

Elie - I'm a democrat and I was pissed when Lat was posting the Obama tax hike stuff. I'm guessing that quite a few of the Republican commenters who are now complaining about political bias were vehemently defending those posts.
However, in the interest of consistency, I do think that you should tone down the political rhetoric a little bit. This is a legitimate topic, but can be done without so clearly imparting your political bias.

This is the key to Palin. If you ask her the stock questions other politicians get ("what kind of supreme court justices would you appoint?"), she has her pre-canned talking points ready to go. But if you peel back a few layers (like with this question), she's totally screwed because she just doesn't have the background. That's not a question of intelligence or "experience", by the way. It's a question of engagement, or even interest, in the major questions facing the country. You could do this with any topic. E.g., instead of asking pointed health care questions about the candidates' plans, just say "what is community rating and why do you support or oppose it?" There are points to be made on both sides of the debate, but she will be completely screwed by this because she's probably never spent even a minute thinking about it. Suffice to say, if McCain had picked Jindal or Romney, we wouldn't be having this conversation.

I said that I was "happy" with her interview which, while snarky, is something I thought most people would agree with. Were Republicans "unhappy"? I posed a legitimate question: do lawyers think Palin should know more about the Court? The bar I set was the current Republican President, whom I quoted accurately. And I kicked the whole piece with an extremely dumb thing that the Democratic VP nominee said.
If lawyers do not think that a candidate's views on SCOTUS are relevant, that's fine. But it's not biased to ask the question.

105 - That wasn't my line of argument, but thanks for reading into what I said. My argument was that even though one goes to law school (and a T14--ooooh--one at that) doesn't mean that one automatically knows about Supreme Court cases.
I know lots about lots; I've just never been interested in Supreme Court stuff. I went to law school wanting to do corporate work. I spend and spent time concentrating on developing the skills to make me better at what I do, not wasting time memorizing cases.
For me, law school was largely a job queue. A few romanticize it, but that's what it is for many (most?) of us.

I think an entirely fair question in the debate would be to ask Palin whether or not she agrees with the principle of stare decisis. It's not a "gotcha" question - anyone who has paid any attention to SCOTUS confirmation hearings over the past 20 years would be familiar with the term. Also, I'm pretty confident that Obama and Biden could come up with a decent answer on it.

But 14/104/109: I think the point is that you are a corporate-side deal attorney. You are not running for VP. We therefore expect you to know corporate law. You presumably do.
Sarah Palin is presenting herself to us as someone who deserves to be one 72 year old heartbeat away from the presidency. We therefore reasonably expect Sarah Palin to know something--anything--about Supreme Court precedent so we can evaluate how she might view SCOTUS appointments. That she knows nothing is only one of the many reasons prominent conservative commentators are calling for her to step down.

116 - I'm not arguing that I'm qaulified to be VP (or that Palin is) on that basis, just that I've been to law school, consider myself reasonably successful relative to my level, and would have given Couric a similar answer.
Personally, I'm love/hate with Palin. I was excited about her at first, but now wish that the campaign folks would let her run free instead of over-preparing her and then throwing her into hostile environments. Anyway, who are the prominent conservatives calling for her to step down? None of the ones I read are, but maybe I'm missing something. I know that Kathleen Parker has and that much has been made of it, but I thought that Brooks, Will and Frum all stopped short of explicitly asking her to step down. I would guess that much of this talk of "prominent conservatives" asking her to step down is the media trying to make something out of nothing, naturally in an attempt to make McCain look like a disaster.
And can you imagine if she did? I think it would be far worse than McCain running with her. The press would be ruthless about McCain's poor judgment, etc.; lefty bloggers would be worse.

she'll give memorized answers that will only be tangentially related to the questions asked. biden will try to get her off script, but she'll retort with platitudes. given the low expectations, people will call it a huge success and mccain will get a 1 point jump in the polls. he'll go on to lose by 50 electoral votes.

I'm not a lawyer and have never studied law, but I can name 18 off the top of my head. I don't expect that much from Sarah "Brain Trust" Palin, but she could have gotten at least Brown v Board or Bush v Gore.
