Indictment For Palin Email Hacker

Sarah Palin Alaska Governor Sarah Palin hottie.jpgDavid Kernell, the now infamous 20-year-old hacker who got access into Sarah Palin’s private email account, has been indicted by a federal grand jury.

Kernell is the son of the Democratic chairperson of Tennessee’s House Government Operations Committee.

The A.P. reports:

Kernell, an economics major at the University of Tennessee in Knoxville, faces a maximum of five years in prison, a $250,000 fine and a three-year term of supervised release.

What kind of emails is David Kernell sending around that made him think that a 44-year old woman would have anything newsworthy in her email account? She’s a grandmother. Did he really think that Palin would use email to send around scandalous photos?

Five years and $250,000 seems like the right price to pay for such rank stupidity.

I guess you never practiced, huh, Elie. Unless you count at being a blogger.

LOL at calling this guy a hacker?

Even retarded "hackers" know to use a foreign proxy and spoofed MAC address when "hacking."

Of course there's not going to be anything too embarassing in Palin's e-mail. Who did this guy think she was, mayor of Detroit?

I suspect he will plea bargain for a fine and parole. Maybe spending 30 days of his summer break in the pen. No point in giving a college kid 5 years for a dumb stunt.

Elie,

5 years and $250,000 isn't what this kid's going to get. Under the sentencing guidelines he'll probably get probation and no jail time assuming he's got a clean record otherwise.

You might know this if you bothered to learn about the law.

lol at Elie for suggesting he deserves 5 years in federal prison and a quarter million dollar fine.

by that standard bill clinton and scooter libby should've gotten life!

College students have a long history of being harassed by the police and treated unfairly by our nation's thiny vieled anti-intellectual drug policy.

We should let this kid commit two murders, be set free by a majority college-aged jury, and then celebrate his acquittal as a triumph over "the man."

avatar
17 Posted by guest | Permalink Wednesday, October 8, 2008 11:53 AM

The rumor was that Palin and her advisers were using personal e-mail accounts so that they could send messages about state matters that would not be released if FOIA requests were made for their official accounts. So perhaps this hacker thought he could find something that would derail the campaign.

18 Posted by guest | Permalink Wednesday, October 8, 2008 11:54 AM

15 - I guess Elie buys into the theory that Trig is really Sarah's grandson...

"a 44-year old woman" ...

you do know she's the VP candidate for Republicans... right?

"anything newsworthy" ... "scandalous photos"

are you kidding me? of course there was huge potential for things newsworthy. and no, he didn't think there would be photos. photos are not the only thing that can be scandalous. the candid words and thoughts of politicians can be scandalous, believe or not.

Elie, you need to spend less time reading TMZ and more time reading NYT, WaPo, WSJ, etc.

5 years and $250,000 is the statutory max. The guidelines range will be much lower.

To give Elie credit, this is a mistake plenty of lawyers make. Only federal prosecutors and criminal defense lawyers really have reason to understand the sentencing guidelines.

"rank stupidity"? If this had been a GOP operative's son hacking into Biden's email I suspect that Elie would come up with a much harsher assessment of the motivations. Perhaps something along the typical conspiracy theories the left loves to throw out when attacking the GOP.

avatar
23 Posted by guest | Permalink Wednesday, October 8, 2008 12:05 PM

I will definately vote for McCain now that I realize the son of the TN Democratic operative is behind this illegal hacking of Palin's illegal use of personal accounts for state business.

It should be "44-year-old woman" not "44-year old woman ."

And, wtf, a 44-year-old female vice presidential candidate can't have anything "newsworthy" in her email? I hate you, Elie.

Also, the tone of this story is a result of Elie caving into the criticisms about being too liberal and trying too hard in the other direction. And it shows.

Palin brought this on herself by openly communicating to her staff the expectation that they could avoid public scrutiny of their official communication if the conducted that official communication under their private email accounts.

This guy was not even close to a hacker. He figured out that that dumb bitch used her zip code as her recovery hint. Palin should be indicted for violating transparency by using a personal Yahoo e-mail account for government business. Any discovery experts want to chime in on how that would be affected?

Condition precedent for liability on the sec. 1030(c)(2)(B)(ii) charge:

What was the other act the "hacking" was in furtherance of?

Elie, come on! Don't you think that politicians may have work-related information in their mail accounts and that this information may be newsworthy, because politicians' work is newsworthy?!
