Lawsuit of the Day: Lebanon v. Israel
In a sign of immense progress towards the peaceful resolution of differences in the Middle East, the Industrialists Association of Lebanon is contemplating filing an international lawsuit against Israel for violating a food copyright:
The Lebanese claim is that Israel markets original Lebanese food like tabouleh, kubbeh, hummus, falafel and fattoush which the Lebanese considered their trademarks prior to the establishment of the Jewish state.
I'm no Talmudic scholar, but I'd imagine the original copyright holder is He who is called I Am.
Shockingly, the Lebanese Industrialists might have precedent on their side:
France, Denmark and Germany asserted that Greece cannot have a monopoly over the production of [feta] cheese. Greece managed to prove in international institutions that it is the cheese's "originator" and won the case.Until that point, the three prosecuting countries produced 12,000 tons of cheese a year.
The court ruled that from then on, other countries could not use the name "feta", as this cheese is "largely associated with Greece's history and has been produced under this name for 6,000 years."
Thus, the European Parliament's Committee on Economic and Monetary Affairs decided to grant Greece the sole right to produce and market the cheese under that name.
And you wonder why the international community cannot react rationally to the current financial crisis.
An international legal battle between Lebanon and Israel over hummus is still so much better than the usual conflict resolution between those two countries. Yay progress.
Lebanon: Israel stole our falafel [Ynet News]

first? really? yay!
Elie: you might want to look up the difference between copyright and trademark.
nothing about recent court decisions in Connecticut? really?
does anyone know whether the SAs at WILDMAN HARROLD will be able to work on this case at their world-renowned international IP-food practice?
V3, you all better watch out. This case is going to put WILDMAN HARROLD on the map, both prestige-wise and in the all important PPPs.
Hello... gay marriage in connecticut... i know it pales in comparison to dumb lawsuits and admissions policies at state law schools... but come on it's a lot more relevant to 99% of people.
Will this provide an opportunity for a -nervous T-10 1L to work in international food IP?

CONN SUPREME COURT ON GAY MARRIAGE PLZ.
Lebanon and Israel are not in the EU. This is different.
Jesus, Elie -- I don't care if the source article erroneously uses "food copyright"; this is a legal blog, so you should use correct terminology (or at least snarkily mock the error). Trademarks and copyright are VASTLY DIFFERENT, especially when it comes to food!!!! I would think you would have been tipped off to TM rather than copyright by the use of "originator" in the feta cheese discussion. Origin (or source) indicator = trademark.
Also, Connecticut gay marriage post, please.
Aided by America's powerful AIPAC lobby, the Zionist entity's "hummus" manufacturers provide to the world a substance that, while hummus-like in taste and appearance, in fact contains eye of newt and the blood of Christian babies. It is made from a secret recipe passed down from the Elders of Zion. Consumption of Zionist hummus poisons the soul!
Wow, they never cease to amaze me with their stupidity. Lebanese did not start falafal, hummus, and all of those foods. They are regional foods that are made by many of the Arabic countries and were brought to Israel by Jews who were born in Arabic countries. So at least they should be able to produce this food since they were born in those countries.
Either way, we should resolve this matter of some kebab and hummus in a pita and NOT through bombings.
- Nervous Israeli
Greece won on feta cheese before the European Parliament’s Committee on Economic and Monetary Affairs which has no authority over Israel or Lebanon. But assuming that there is another forum to bring such a claim, would other Arab states that claim these products as their own object to having Lebanon claiming it as their own?
Also, this stuff has been served in Israel since British Mandate times...hasn't the SOL expired?

First of all, the Lebanese did not invent or come up with these type of food. It was the Syrians. Leave it to the Lebanese to come with the most absurd lawsuit ever contemplated.

Why can't Obama just run for European Messiah and that way Europe will get what they deserve and Obama can rule over a socialist society.
16-Everyone knows that...except, maybe, bloodthirsty zionists who seek to destroy any evidence that a Palestinian civilization once flourished where their ethno-clensed cities now stand.

11 -- If Elie had correctly labeled this as dealing with TM rather than copyright, "starting" (or creating) those foods would be irrelevant. In any litigation, it is likely that the dispositive factor would be whether those terms (i.e. "falafel," "hummous," etc.) possessed secondary meaning as a source identifier, with the "source identified" being Lebanon. Of course, this points up how ridiculous any legal action would be: there's no way Lebanon could demonstrate this, and a common food name, even if registered as a mark, wouldn't be inherently distinctive enough to move past the existence/ownership prong of an infringement suit without demonstration of secondary meaning.
Let's see, hummus, taboule, falafel, etc. have been eaten for hundreds of years in Greater Syria. Lebanon has been in existence since the 1920s. How could they have invented these foods?

I didn't know lesbians invented hummus and fattoush. Do they eat it on carpet?
Do they give out law degrees at McDonalds when you order a burger and fries in Cambridge? Seriously, Elie? Did you learn even a LITTLE law while you were there?
To 13/17/18/20:
i'll take the bait. you are an absolute moron who knows sh*t about what the f you are trying to say. when did israel "take" lebanese land?!? for that matter when did they take anyone's land?!?

This is not that big a deal. Doesn't the Champagne region of France own the rights to call sparkling wine "champagne"?
28.....serious? I hope you take the bait and choke on it...along with your Israel land stealing denials.
You dont know when they took Lebenese land? Ahem (shebba farms, among other places) Let me go ahead and guess you dont know anything about them taking palestinian land either Ahem)(palestinian holocaust and ethic clensing). DeNILE is not just a river in Egypt. (They will prob try and take that too).
Your so stupid.

Dumbest lawsuit ever.
I WOULD like to hear evidence on the first use of mashed beans though. First peopel to chop and eat parsley?
32 - This is kinda different in that Champagne is actually a PLACE in France, where people around the Middle East have been eating all those foods for quite some time, and I dont think "felafel" and "hummus" have any more connection with Lebanon than anyplace else in the region. Nobody buying "felafel" reasonably assumes it was from Lebanon, but someone buying "Champagne" could reasonably think it came from Champagne, France. See also post 24 (not by me).
After WWII the UN should have given jews land in Germany, not Palestine. That way they could have appropriated sausages and schnitzel.
37-agreed...and lmao!

Since the falafel trademark was jointly owned by Palestine, Israel, as the successor state to the Palestine Mandate, should have the right to make falafel!
Also, doesn't it violate the Arab boycott to sue Israel?
The Israeli felafel is better than the LEbanese felafel. The baby's blood and old lady tears the Israelis use in theirs adds a wonderful kick.
Can't buy that in a jar! (except in Tel Aviv!)
33/34/35:
it was part of syria who waged a war that they lost and so their territory that was used to start the war was conquered. if you cant hold up in battle then you lose! its quite simple.
egypt (at least sadat- who suffered a bitter end for his peace efforts) and jordan learned their lesson from all their loses in war and cut a peace treaty (albeit a cold one at that, but at least no real war). israel gives all their enemies, who are sworn to their destruction, a chance at peace even when it is not the popular thing even in israel. though they have more than their fair share of loony leftists - but that's another story.
also try reading about the balfour declaration of 1917 well before lebanon and jordan et al.
besides you sound like a dumb law school student who knows nothing about the world except for the leftist crap shoved down your throat. try reading the full story not just one sided and dont be afraid to speak your mind instead of just following the leftist...
42--Just because you say things, does not mean its true (I know....i totally burst your little zionistic bubble). First, Syria says it belongs to lebonon, lebanon says it belongs to lebanon, and the intl community says it belongs to lebanon. So.....yeah, about that DeNile stuff. Second, The balfour declaration gave away something that did not belong to the brits. As occupiers, the brits had no authority to give the indigenous people's land away. Just as the Nazis took and gave away the land and wealth of jews living in Germany. You would not argue that Hitler had a right to give all that away? Lastly, your characterization of Israel giving its "enemies" a chance at peace is undermined by what Olmert recently said..."Israel must withdraw from nearly all of the West Bank as well as East Jerusalem to attain peace with the Palestinians." Now that I totally demolished your feeble attempts at legitimacy...let me say this in words that you may understand....You are an ass. Cus Emak!
43 = educated towelhead
That's not a copyright issue Elie --- it's a trademark issue.
42- after all the atoning you just did...do you really want to start justifying the land stealing, baby murdering and ethnic clensing tactics of israel? You should apologize, to the Palestinian people and the inlt community alike for the atrocities perpetrated by israel. How can you continue to justify what you are doing to the palestinian people after what the Nazis did to you? Where is your humanity?????????
44--an educated towelhead is your worst enemy. Trust me my friend, the tide is turning. Enjoy this period while you can. Really, soak it all up.

46, please take your anti-zionist crap elsewhere! In case you havent noticed, this country agrees with Israel. Israel is America's strongest ally, and that's a fact! The only people agreeing with your rhetoric are either: 1) muslim or 2) muslim-sympathizing professors! Now please leave bc your pro-terrorist views aren't welcomed.

"I'm no Talmudic scholar, but I'd imagine the original copyright holder is He who is called I Am." - Dear Elie, please don't write offensive, ignorant, and stupid things. Thanks.
42, 44...should you be killing defenseless chickens right now? (not just choking your chicken)
"In general, the messages protested the tradition of kaparot — sometimes spelled kapparot or kapparos — in which Orthodox Jews take live chickens, swing them over their heads as a means of symbolically transferring sins to the chickens, and then slaughter them on the eve of Yom Kippur, the Jewish day of atonement."

49--clasic....waiving OUR american flag.....while telling someone their views are not welcomed....simply cause you dont agree (not to mention the truth).
Take your genocide supportive views elsewhere....like germany (isint that where you people (yes, Yoouuuuuu people) learned how to devestate a population first hand?)
51/52 - wtf does that heave to do with our arguement about israel. that is just classic jew-bashing while not knowing sh&t what your talking about! not that the others are not jew-bashing, they totally are just under the anti-zionist umbrella.
for the record when the brits had israel under their control there was no national people there. in fact egypt and jordan - after israel agreed to take less then what was offered by the balfour dec- had ample opportunity to take gaza strip and the west bank respectfully. they could have done that and helped out their brethen - oh i forgot they dont give a crap about them, even today. look at how they treat thier own. israel on the other hand has a human rights record that noone else can even touch. (i know all the comments already - so save them). i wonder why all the arabs - oh excuse me palestinians - want israeli citizenship. maybe because they will then be treated like human beings by their "sworn enemy"!
bottom line: this is just baseless hatred by the "radical" muslim community just based alone on hate. je.g. look at the way you write on this blog.
So...this one has devolved rather quickly.
53, you are a true moron! Not only do you not know how to spell "classic," you also resort to hatred bc your life sucks and are sick of having sand in your ass. Yes, your views (and those supporting terrorism) are not welcomed in this country.
For the record, don't speak of genocide when your people (yes, your people) go blow up buses and kill innocent civilians!

lebanese chicks are hot...and somewhat slutty. don't care much for their food though.

"israel on the other hand has a human rights record that noone else can even touch" lmfao! As in having one of the worst records on human rights....ever?
From 1967 to 1989 the UN Security Council passed 131 resolutions directly dealing with the Arab-Israeli conflict. Of the 131 resolutions passed, 43 could be considered neutral while the remaining 88 either criticized and opposed the actions of Israel or judged against its interests. Nearly half of the 88 resolutions against Israel "condemned", "censured" or "deplored" the member state or its actions.[3] During this time, in the UN General Assembly, 429 resolutions against Israel were passed, and Israel was condemned 321 times.[4] The United States has used its veto power to prevent resolutions concerning Israel from passing through the Security Council on 42 occasions since 1970.
~winki
the whole un is worth nada. they can get a passing vote against israel just from the anti-israel nations
49 - Nice argument. Glad you resorted to logic rather than overbroad stereotypes. Oh, wait...
Whats wrong with being anti-israel? They practice Apartheid and engage in land stealing and genocide.
Why should we not be anti-israel? Interestingly enough, you fail (which is no doubt a magnification of your ineptness) to recognize that to get anything passed in the UN, you need a consensus. Sooooooo, what your telling me is that every UN condemnation of israel is the result of anti-israel countries? Evenry country is wrong, and israel is right. Riiight...why does this sound familiar.....the “they all hate us for no reason” argument????? hmmmm.
have you anything positive to say about israel?
where do they practice apartheid? those that are not citizens chose not to accept israeli citizenship.
also genocide? do they go around blowing up buses packed with people going about their daily lives?
Hey guys, how about those Dodgers?
63---in light of their genocidal practices? I am going to have to go with no on that one. And in case you were wondering, I dont have anything good to say about rape, murder, human suffering, baby killing, genocide, and human rights violations. btw, do you think the orphaned palestinian kids have anything positive to say about their occupiers?
What a dumb ass question.
Hey guys, how about those Dodgers?
if your talkin brooklyn dodgers - then how you doin?
66, go throw your rocks elsewhere you palestinian terrorist! Be warned, Jack Bauer will hunt you down and kick your ass!
As long as Israel's enemies in the West are shrill idiots like 66, we friends of Israel have little to worry about...
did i tell you guys i nutted on some hot lebanese chick's neck and teetahs (i might have got a little in her hair as well)? i mean, how does this go unnoticed on this board? instead you morons are wasting your time talking about silly concepts such as the "UN" or "genocide." i bet you if i had sang ha'tkivah while i did this, my whole experience would garner a little more attention on this board.

64 -
Palestinians in the West Bank and Gaza are not allowed citizenship. They are controlled by Israel, but not given equal rights under the entity that controls them and are forced to use seperate roads, schools, etc.
There's your apartheid...buddy.
73 - They aren't citizens and from what I understand dont WANT to be.
They SHOULD have their own country, and they WOULD have had one a long time ago if they seemed likely to be reasonable, non-threatening neighbors, as opposed to a base for launching rockets into Israel etc, which is apparently what happens when the Israelis "just leave" occupied territory a la Gaza and South Lebanon. The Israelis are often quite brutal, but their neighbors really DO want to destroy them so its not as simple as just being nice.
That said, Persian chicks are SUPER hot! =)
persian chicks are not arab chicks (and more specifically, lebanese chicks). that said, i've had my ass eaten out by a persian chick i met on sunset blvd at 1am a few years ago. they're pretty trampy if you ask me.

74 -
Not true. Palesinians, like all humans want to be treated equally. The fact remains, Israel controls their lives but denies them equal rights under the law. being a lawyer, perhaps you understand such concepts. Moroever, the only just solution is to grant all Palestinians citizenship, which is what the majority want.
-73
77 - wrong, or at least as it relates to palestinian women. they want to be treated like whores. my lebanese chick's family was originally "palestinian" (whatever the fuck that means).

I had a Lebanese stripper at the Sundowner once - she gave me and my wife a "couple's lap dance," which is half as good as a regular lap dance. My wife had snail trail all over her leg. It was still totally worth the $20 Canadian.
- v. 20 Jew.
P.S. Hey there, v. 10 Jew!

My views:
The jews are ashamed of what they have done (and continue to do) to the palestinians... that is why they are so defensive... They treat them like second class citizens and have jailed them, humiliated them and uprooted them... they have created a palestinian diaspora.
On the otherhand, the arabs are fools for resorting to violence. It has just made rational people hate the palestinian cause.
- Not a jew or an arab.
81 - i'm not defensive about the pearl necklace i dropped on ole' girl. quite to the contrary, it was hilarious ("can you please get me a towel? like now.")!!!

82....your making our people look bad. Please stop calling your self a jew while describing sick sexual acts.
p.s. I gave your mother a pearl necklace last night! lol. sucker...i actually had ya going for a sec. I, win, again!
35:
You're an idiot. Shebba farms belonged to Syria, not Lebanon, and it was claimed during the course of a Syrian invasion. If you choose to roll the dice, you risk losing your bet.
84 again,
Anyways the whole situation is completely FUBAR, it doesn't look there can possibly be a peaceful resolution, at some point its probably going to degenerate into all out war again. Israel can't give citizenship to all Palestinians because it would effectively destroy Israel. There are too many Palestinians clustered together in Gaza to ever live peacefully, they need more space. Neither side seems willing to agree to compromise and take two states with some land swaps, although Livni is more likely to take action on that plan. The Palestinians are divided in two major camps and infinite smaller factions, so even if you could broker a peace deal involving Hamas and Fatah, neither would be able to control the smaller factions and prevent them from staging attacks. Then, you've got the crazy settlers up North who want all of biblical Israel and won't go away quietly either. Plus, you have all the neighboring states with an interest in the conflict pushing the sides in different directions, and the Lebanese (hizbullah, not the army) being used as a proxy by Syria for waging wars of attrition against Israel.
So, in conclusion, FUBAR. Maybe if we just air dropped a bunch of happy pills down there people would settle down a bit, we could hide it in the hummus.
Hey 76... the Persian 'chick' with the small breasts you met on SUNSET at 1 AM was a dude. Those weren't breasts, those were pecs. Hate to be the one to tell you.
I wonder if there's some tranny blog somewhere where this guy is bragging about the dumb, drunk v.10 lawyer he picked up on Sunset a couple years back.
86 - what's wrong if she was a dude? you sir, are an intolerant fuck.

If lebanon wins this lawsuit, does it mean that israeli arabs will not be allowed to sell their native food?

Wow, way to get absolutely every fact wrong in a single shot.
1) The UN Commission that addressed the issue when Israel withdrew from Lebanon ruled that Shebaa was Syrian, not Lebanese. After agreeing to accept the ruling before it was issued, Lebanon disregarded it once it went against them.
2) Syria does not say Shebaa is lebanese. For decades, Syria would not even say *Lebanon* was Lebanese - they liked the idea of greater Syria too much. It was only this past year, after intense international pressure, that they finally made small steps in that direction. If Syria simply said "Shebaa is Lebanese, we have no claim to it" Israel would hand it back to Lebanon. Don't hold your breath waiting for it.
3) You are obviously either a) not lebanese or b) a lebanese Shiaa getting off on promises of martyrdom from Hassouneh (otherwise known as "Tubby Turban" in the immortal words of one blogger). Remember when he said that the guns of the resistance would never be turned on fellow lebanese? Sure . . . until his Iranian paymasters told him to. Good times. Good times.
