Open Thread: The Veep-bate
The Vice Presidential debate just ended, and there was a lot more “law” than one might have expected.
The best legal sparks flew over the Constitutional powers of the office of Vice President. Palin came out of the gate first when asked about her role as Vice President:
I’m thankful the Constitution would give a bit more authority to the Vice President if that Vice President chose to exert it in working with the Senate.
Biden said that he would be the “point person” for Obama’s legislative agenda with Congress.
But then both candidates were asked if they agreed with Dick Cheney’s contention that the Vice President was not solely governed under Article I. Palin said:
The Founding Fathers were very wise there in allowing to the Constitution much flexibility to the office of the Vice President … so I do agree with him.
Biden said:
Vice President Cheney has been the most dangerous vice president we’ve had probably in American History … Article I defines the role of Vice President.
That sounds like a fairly large legal distinction.
Later, Biden returned to the Supreme Court in the context of things he has changed his mind on over the course of his career. When speaking about his criteria for confirming justices, Biden said:
It took me five years to realize that the ideology makes a huge difference … It matter what your judicial philosophy is and the American people deserve to know it.
He then went on to trumpet his objections to Robert Bork.
So, we know at least one VP candidate favors litmus tests. Palin acknowledged no moral issues which she has ever had to compromise on.
But one issue that will be really fun to some of the lawyers who have enough to work to do to still be on the job at this late hour, was Biden’s views on the bankruptcy courts. Biden wants to allow bankruptcy judges to not only re-adjust interest rates, “but also the principal that you owe.”
Palin said that she supported that as well. But she then went back to an unasked question about energy.
What did you guys think? We think that this VP power thing will be the dominant legal story coming out of tonight.

Why do so many readers of this blog insist on ripping apart Elie's posts? He's been on the job for, what, a few weeks? The most ironic part of the criticism is that most of the posts are typo-ridden.

Why has "well she did better than crap" become an acceptable standard to judge a win?
When has "no hurting their party" been the standard by which we judge the person a heartbeat away from the President?
Shouldn't the vice president, as should the president, be an expert, not just well versed, but an expert in every field (foreign policy, economy, SCotUS, environment, energy, taxes) in order for us to hold him/her up to the standard of vice president of the United States of America? This is the most important, hardest job in the WORLD and we analyzed shortcomings so matter-of-factly. Would you send your children to school to a teacher that was a camp counselor, but could now "learn on the job"? Wouldn't you think that person should have been qualified and knowledgeable on all the aspects of what their job entailed BEFORE they took it? Am I crazy?

Regardless of what you think, the POLLS all have Biden winning on points and issues, and any gain Sarah made, Joe matched her. At best a draw, at worse Obama pulled further ahead.
I am a Bush I republican (my first election), and a Newt supporter. I watched the debate and the winking and the mugging and I thought Bush II. And I knew then that Obama might win. I was relying on casual racism, an October Surprise and Rev. Wright to win it, but damn if McCain hasn't picked the wrong VP person, and been the wrong person to have been in favor of more deregulation during a crisis caused by that same deregulation.
We don't need Bush II (or III I guess). We need Reagan, Bush I, Newt's contract with America. I don't see it, and we are going to get crushed. NC, VA, NM, and Indiana will all go Obama.

Is what you're getting at the fact that Article I is the legislative branch and therefore Biden's argument was self-defeating? I think it was clear what he meant, but that mistake was rather unbecoming of someone with a law degree. That said, it also says something about the present state of our government, where even members of Congress automatically assume the Executive came first in the minds of the Framers.

Perhaps Biden was referring to Article I, s. 3: "The Vice President of the United States shall be President of the Senate, but shall have no vote, unless they be equally divided."
It is the only responsibility set out by the Constitution for the Vice President (since succession could be viewed less as a responsibility of the VP and more a result of what happens when the President is removed) and arguably could be interpreted to set out the "role" of the VP. Of course, one could say that the real "role" of the VP is established by the succession provisions in Article II.
So, IMHO reasonable people could disagree that Biden was "technically" correct in referencing Article I or incorrect for failing to reference Article II as well.
I wish law school classes were more like debates in Sarah Palin's world. I would've spoken up more often if I could have talked about whatever I damn well pleased.

43 - good points. When the question going into the debate is whether or not Palin will look like a clueless idiot, it is clear she does not belong here (VP) at all. The desire to elect an "average" person in the hopes that they will relate to your problems is simply bizarre. McCain could have made many stronger choices (male or female) than Palin. Obama's choice of Biden is relatively uninspired, and undercuts his message of change, but at least Biden is clearly qualified.
I was disappointed with both candidates. Not once in the debate did either mention the situation at WILDMAN HARROLD.

If my target audience were highly educated professionals, I would make damn sure to write intelligently and proofread several times (even if it takes an extra few minutes). Writing is probably the most important skill for a lawyer. Ellie, obviously, is a lousy lawyer. This blog is seriously going downhill. This country is full of idiots. If you put enough lipstick on a contract for indentured servitude, there are plenty of people in this country who would sign it. The fundamental question you have to ask yourself is: am I ok with indentured servitude, or, do I think the government needs to step in at some point and babysit people? I subscribe to the latter. Since when is being an everyday person (Joe Six Pack and Hockey Mom) a desirable qualification for a world leader? I have a law degree from a top school, and I don't feel qualified for the VP or Pres job. A sad state of affairs when the voting public seems to say "she is just like me, and therefore I like her and will vote for her." She is hot, and she might even be more fun to hang out with than Biden (doubt it-I actually threw stuff at the TV tonight because her voice is so annoying), but that doesn't add up to qualification in my eyes. She was better than what we thought she would be but still a disgrace. She ignored questions, repeated the same meaningless phrases, and had no specific policies at all. At two points during the debate, she took a few seconds to try to plan her next move because she knew she couldn't think of a policy or an ideological retort for Biden.
Biden rocked her on every level except that he wasn't as personable. But I'll take an intelligent person helping make these decisions over a personable, "kitchy" (sp) and punchy one.
Biden is a joker and a dope. He reminds me of a drunk in a bar, making up shit as he drinks. At least Palin is hot and means well.

Do people ever really "win" these things? That seems like it would be like "winning" the bar exam. Absent a major gaffe by either side in a debate, I would imagine that debates have very little effect on the average undecided voter's decision. They are more just an oppurtunity to get information out to the public.

100: Sorry - graduating at the bottom of one's law school class trumps taking six years and five schools to get a BA in journalism. Nobody's maintaining that Biden's a grand intellectual. Those who think that any of McCain, Obama, Palin or Biden are qualified and fit, from ideological and experiential standpoints, to occupy the two highest elected executive offices in this country, are deluded.
