Associate Life Survey: Bonus Points
Last week, our ATL / Lateral Link survey focused on when raises happen at your firms. But we’ve also been wondering about another prong of compensation: bonuses.
In 2007, Cravath kicked off bonus season early, on October 29th, but it’s much more common for firms to announce in December. Indeed, this year the first major announcement of October came from Morgan Lewis, who announced that they won’t be announcing bonus until January. (That said, though, Orrick announced their 2008 bonus structure back in June.)
But timing isn’t everything. There’s also the quantum of solace cash. On that front, comments in last month’s associate bonus open thread suggest some pretty diminished expectations. As one reader put it:

But a second reader posits that firms can leave last year’s bonus structures in place … because billable hours are actually low enough to avoid a cash crunch:
If firms keep the same bonus structure, they will still be spending *way* less on bonuses this year. That’s because so few people will make their hours. Most associates are way down compared to last year, and November and December are only going to be worse in terms of finding work to do. It wouldn’t surprise me if many firms will save 50% or more without making any adjustments to the bonus structure. That’s what gives me some hope that bonuses will remain the same. Of course, firms would be happy to use the remaining 50% of bonus money on other things. But they won’t want to chase away the few associates who are actually competent enough to make their hours.Now, if I can just find a way to stay busy through November and December…
Sort of a “glass half full, so you don’t really have to tip” approach.

14 -- actually, I would think it would be far less, as this year many non-NYC offices are the ones propping up their respective firms. I am in a non-NYC office of a T10 firm and we have been much busier than my NYC counterparts.
That being said, I hope they continue to pay the same everywhere this year, so we can remind you of it when you bitch about it 2 years down the road about how you work so much harder, NYC is so expensive, your taxes went up because the country elected a socialist, you are getting screwed, etc.

Dirty little secret of Orrick bonuses - in many years, fewer than half of associates get any bonus, because it is hours-driven. Moreover, if they miscalculate slightly on bonus structure, the partners make it up by promoting a disproportionately small number of partners in slow years.
Any speculation on what V5 bonuses will be like? DPW/S&C seem to be getting a lot of work so they should be able to afford it.
Don't care about layoffs, and so wouldn't sacrifice a nickel in bonus to avoid them. Layoffs, if any at my firm, won't reach my class (2004). If they do, they won't reach my practice area (litigation). If they do, they won't reach me.
Dechert is in the process of "stealth laying off" everyone who is eligible for bonus this year. They have decided that PPP is more important than honesty and integrity.

Certainly fooled the CWT associates and all the other associates out there who relied on no layoff promises.
This thread makes no sense as applied to the top NY firms (Cravath, WLRK, S&C, Simpson, DPW, FF, etc.) These firms do not vary their bonus payouts based on the amount of hours billed. The guy billing 2000 hours gets the same amount in bonus as the guy billing 2600 - - payouts are simply based on class year (assuming the associate is not on probation, being pushed out of the firm, etc).
20, Cravath and S&C will, at a minimum, meet Orrick's announced bonus structure--meaning $45,000 for the first years and increasing for the upper classes. Basically, they will pay bonus at the same rate, including "special," that they did last year.
The real question this year will be who will match. Serious stratification is coming, kiddies.
Why is "I'm a law student" a choice here? Law students should NOT be answering a survey on bonuses. They aren't working yet.
26, some 3Ls intern at an office of their future employer during the academic year--it's possible that they, like the stub years, will receive some sort of bonus.
re 25, bollocks. Orrick's announced bonus structure only guarantees 25 to first years and up to 20 in "discretionary" bonus. To get a guaranteed 45K bonus on their table, you have to be a sixth year.
Thus Orrick (and anyone insistent on matching Orrick) need only combine last year's table with a much more demanding methodology for the discretionary portion of the bonus in order to significantly reduce bonus expenses overall.

I don't know about your firm, but at S&C and Cravath there is no discretionary portion of the bonus. FYI, there's no way that first years at S&C or Cravath will get less than they *could* make as first years at Orrick.

What the hell is Fried Frank doing in that list? Are you kidding with the "top NY firms"? That place does not belong in the same room with the other firms you mentioned. Replace FF with Skadden, and then maybe your are correct.
FF is on the list only because, historically, they have followed the same bonus structure as those other firms. Of course, nobody (me included) thinks all of these firms are in the same - - the point is just that they all pay the same amount in bonus and do not use a discretionary or hours based formula.

#34 You stand as good a chance of being laid off if you are bonus eligible as you do if you are a slacker. Some firms (Dechert) have made it a practice to stealth lay off associates who were on track to easily make bonus. They will take that big fat bonus and add it to PPP. Next year when they don't have any competent mid and senior associates to do the work they will just hire some retreads from one of the many failed firms to do the work the juniors have no clue how to do. One of those they hire may be you. This is assuming that Dechert doesn't go the route of BK, closing their doors or bleeding partners who have work and can see the writing on the wall.
