Lawyer of the Day: Harvard Law Student Threatens Police with ‘Prestige’

I guess higher education is supposed to teach you how to use your words instead of your fists. But at Harvard Law, I guess they skip the “oral argument” phase altogether, and go straight to vague prestige threats.

Let’s see how that is working out for one of the brightest Harvard Law stars:

A promising Harvard Law School standout told cops during a bizarre drunken tirade that he would “lie and cheat” to ruin them if — as a future attorney — he ever calls them to a witness stand, police said.

My pres-tige brings all the boys to the yard, and they’re like: it’s better than yours. Damn right: it’s better than yours:

A police report states that Simpkins, 24, made the threat early Saturday morning, just four months from graduation, as he spilled out of a Theater District bar and into the back of a Boston police cruiser, barking to officers, “Give me a (expletive) ride, I work for the district attorney’s office.”

Charles C. Simpkins has a fairly high profile on the HLS campus:

A proud conservative, Simpkins seemed destined for a future of unlimited potential.

A graduate of City College of New York, where he majored in philosophy and political science, Simpkins was in 2005 named a Harry S. Truman Scholar for his devotion to public service. He has studied abroad and appeared on several major networks, as well as on YouTube.com, discussing politics.

In a post in September, one political blogger said Simpkins “is what Obama could have been.”

But that bright future might be gone for the youngster:

Simpkins has been booted from his unpaid position assisting prosecutors in Dorchester District Court, for which Harvard hand-picked him.

How long before somebody is telling this guy, “it’s not your fault.”

Is it really appropriate for the DA that was employing him to also prosecute him? Even though this appears relatively minor, I would think that calls for a special prosecutor or prosecution in a different venue, you know, to maintain the appearance of propriety and all that. If the DA's office doesn't do that automatically, then Simpkins' attorney better do it, because the DA he was working for is going to go out of his way to nail this guy's ass to the wall--especially with an officer hurt during the arrest process.

How was this guy a "promising Harvard Law School standout," as per the article? He was an unpaid intern in the county DA's office. Which basically means he was there as part of some pro bono or clinical program (of which HLS has dozens), which (a) takes no skill to get into, and (b) he obviously had time for because he wasn't doing the things the REAL HLS standouts do (Law Review, Ames finals, etc.). Also, he summered at a mid-tier NY firm (Patterson Belknap), which means his first-year grades weren't anything to write home about.

That said, this is a silly incident to get worked up over. The guy was drunk and made an idiotic remark. Big deal.

If you are a subway commuter in NY city you could not help but see this guy over the last 3 years. CC put his face on so many subway ads as graduating from there and getting into HLS. Glad he is still at Harvard, but this is a set back.

Seeing as all law schools read the same text books, cover the same areas of law, and have roughly similar exams are HLS students actually any better in the real world practice of law than those graduating from the rest of the top 50 schools?

HLS students are dumber. They pay full-price for lousy teaching by profs more concerned about their own research and scholarship, whereas most students at other top 50 schools pay much less for lousy teaching by profs more concerned about their own research and scholarship.

Practitioners and judges recognize that the Harvard brand today is useless. 20-30 years ago it meant something. Today, not so much.

Yes. I didn't go to Harvard law (a long way from it), but a disproportionate number of the Harvard attorneys I've worked with have been very good. For the most part, you don't get into harvard law unless you're really smart, work really hard and are ambitous. These are the qualities of good lawyers. It has nothing to do with the curiculum or quality of instruction.

You get into HLS because you performed well on an LSAT test, which is no indicator of competency to be a successful practitioner. You also get into HLS if you have certain activities or attributes (non-intellectual ones) that are reflected in or become apparent from your application.

Students who go to HLS are bright. But students who go to other schools are just as bright. In fact, many students who do not go to HLS work much harder than many students at HLS because HLS, whether intentionally or otherwise, breeds a culture of "the hardest part is over, just sit back and enjoy the ride."

In sum, the degree from HLS, by itself, means little. It is not an imprimatur of genius or intellect, and it is not an indicator of success in the real world. HLS grads are subject to layoffs and application rejections, just like everyone else. Except they may have a ton more debt over their heads.

If HLS were so superior, then other lawyers would have no ability to compete because all positions would be taken by HLS graduates. While I agree that there are bright people at Fordham and GW and the like, to claim that top law students don't work hard is insane. If you ever stepped foot in a T5, the amount of gunning done by hopeful SCOTUS/COA clerks is insane. The gunning continues well into 3L year as competition for honors intensifies.

You've got a real serious case of HLS envy. So you were rejected by HLS. So were thousands of others. Get over it. BTW - to assert that an HLS degree ain't what it used to be is belied by the fact that the majority of present and future Supreme Court clerks are HLS grads. I also know Claudio at HLS. He's generally liked, known to have terrible taste in politics (Fred Thompson?) and is not thought by anyone to be a standout academically. Many of us have seen him stupidly drunk, so this story is no shock. Yet the article and the comments have it backwards. Nice guy. Not an allstar.

I was in a class with Simkins last year--Housing Law. He was the most articulate person in the class, by far. It was worth listening when he spoke. I hope this doesn't derail what I believe is going to be a great career as a lawyer.

I was accepted to HLS but opted to go elsewhere. I think that you will find many of the comments here are not "envy" but rather the "reality" that you and others like you simply do not want to recognize.

There are those individuals who are from an era long gone who will perpetuate the importance of pedigree over substance, and so that is why you will see the same schools disproportionately represented in certain positions. This does not mean they are better that other applicants. It simply reflects the biases of those who make the selections.

47 here. Small sample is probably the issue. The Harvard partners I've worked with are no better or worse as a group than any other partners. The people who make it (especially the junior partners) tend to be good lawyers across the board, regardless of law school (it's probably the same with associates at the very best firms).

That said, out of the five harvard associates I've worked with closely, three were stars. It's totally anecdotal, but something I've noticed nonetheless.

Just a guess here, but I suspect that the HLS 3L in question "may" have a tiny substance abuse issue.

Of course, there is no person that a cop delights more in arresting than a lawyer, except perhaps a Harvard lawyer. (The young man is lucky he did not brandish DA office creds; he would have been additionally charged with impersonating a law enforcement officer.

This nonsense about Harvard lacking substance that lesser schools supposedly have is nothing more than serious insecurity. You really think scoring 170+ on the LSAT and having a 3.7+ GPA average is nothing but "prestige points?" The fact is, all lawyers had 4 or so years in undergrad to test our academic abilities. The ones who got into HLS did better on that test. Usually much better than you.

Note this doesn't mean HLS grads make better lawyers. It does mean that over a number of years, their performance was better than yours at the tasks they were given.

He did it in a very obnoxious manner unbecoming of a District Attorney employee (or, for that matter any law firm considering hiring him) and he obviously has extreme substance abuse issues. Last, he managed to obtain wide ranging publicity and notoriety in the legal community of his indiscretions.

I think that this severely that limits his job prospects, don’t you?

67 - You're wrong about the justices. Only five justices graduated from Harvard Law School (not seven).

The non-HLS justices: Stevens (Northwestern), Thomas (Yale), Ginsburg (Columbia - but attended Harvard), Alito (Yale).

Maybe you could count Ginsburg as 0.5. That still gives you only 5.5 HLS justices.

Claudio has come through a lot and, in the grand scheme of things, this is just a small setback. And given the racist behavior of the Boston cops, I wouldn't be surprised if what actually happened was way different from what we've been told.

Many of his posts on the forums were arguing that he was not an affirmative action admit, but rather, that he was admitted because he was a Truman Scholar. Of course, he probably got the Truman scholarship in large part due to his race as well.

The problem is that every student at a TTT assumes he/she is one of those "exceptions" that COULD have done well had they had the desire. Perhaps they could have, but the fact that they chose to mess around in undergrad seriously questions in my mind their ability to get their act together in law school. Laziness and poor work ethic is a pattern of behavior that is not so easy to correct.

I agree that someone with a 164 has the sufficient intelligence to be as good of a lawyer as someone with a 174, but what I'm saying is that a poor undergrad record in a lot of cases reflects a poor work ethic that won't let that 164 shine through.

Claudio didn't ASK for a ride. He DEMANDED one and the cops refused. Claudio remained in the car and threatened to ruin the officers' careers. He also abused his connections with the DA's office.

One of the officers involved was black. 190 et al. is probably Claudio.

Resisting arrest is not always a misdemeanor. Claudio resisted in a violent manner, causing an officer to be hospitalized. Claudio's career is over.

190 is probably Claudio or Claudio's boyfriend.

It seems that this young man didn't know that when you play the Ivy-class game, you open yourself up to a lot of repercussions. The police actions were allegedly based on his behavior. If not, then he has grounds for a suit. However, his job and career losses--independent of whether the police were right or wrong --were and will be the result of his mouth, his ARROGANCE, and his disdain for everyday working people.
