The Senate can judge whether someone was validly elected (or in this case, appointed). Just as they wouldn't have to seat someone who was intimidating voters, they don't have to seat someone potentially selected through bribery.
And being the sole judge of that issue, they don't need a heavy burden of proof.

The news this morning is that the Dems are going to let him in as the Senator. What kind of spineless bullshit is that? What they hell did they make a huge scene of turning him away yesterday for if they were going to back off of it the very next day? Seriously... all the power the Democrats have and we have this snivelling troll Harry Reid as the Senate majority leader. Obama had better be the real deal, cause Reid and the rest of the gutless clowns in the Senate sure aren't.
Burris can be desired by the Senate all they want. Until the Illinois Sec. of State certifies Burris, he cannot be a senator. Period.

Illinois Secretary of State Jesse White says he's being unfairly blamed by members of the U.S. Senate for not seating Roland Burris.

"An attorney wound up in court on the wrong side of the law after he clocked his wife in their Upper West Side apartment, police sources said yesterday.
James Hunt, 46, allegedly punched his wife, also 46, as she awoke in their apartment on West 72nd Street near West End Avenue at around 11:20 a.m. Sunday.
Police responded to a 911 call and found the wife crying on a seventh-floor staircase. She was treated for minor injuries at a local hospital. Hunt was charged with assault and released without bail at his arraignment."
