Musical Chairs: Goodwin Procter’s Gains or MoFo’s Losses?
Two big name rainmakers are leaving Morrison & Foerster for Goodwin Procter. According to a Goodwin Procter email:
Goodwin Procter announced today a major expansion of its Financial Services Group with the addition of two nationally-recognized attorneys, Robert M. Kurucza and Marco E. Adelfio. Kurucza joins as co-chair of the firm’s Financial Services Group. Both are resident in Washington, D.C. The addition of Kurucza and Adelfio will enable Goodwin Procter to provide a more fully integrated suite of services to prominent common clients, and to offer even greater cross-disciplinary expertise to a broad range of financial institutions.
Good news for Goodwin, but the announcement is just more unsettling information coming out of MoFo. Rumors of all sorts have been popping up about how things are going at MoFo. What we do know for sure is that Mofo hasn’t made a decision about associate salaries:
MoFo, [hasn’t] announced their bonus/ pay freeze intentions yet (which is totally bogus because it leaves associates in the dark). What little guidance we received came in the form of a wait and see what the market is doing approach.
Latham and Orrick have frozen, O’Melveny and Gibson Dunn are paying market. What will MoFo do?

MoFo compares itself to Orrick and Latham to a degree, but Cooley and Wilson Sonsini are also factors. Did Cooley freeze salaries along with the layoff? I don't think Wilson has announced anything yet - neither of these (nor MoFo I think) has the financial services exposure of most of the firms that have frozen, tech sector is not going to get it as bad so maybe they will be in the group that doesn't freeze.

SAN FRANCISCO = WORSE THAN HOUSTON
San Francisco firms are so badly run that I wouldn't be surprised if Mofo or Bingham or Pilsbury go under, or even Orrick. They all want to compete with NYC firms but it's hard when you are bleeding heart and don't demand more hours from associates, or get rid of underperforming associates, or cut costs on pro bono activities your wanna-be peer NYC firms never spend money on. It is not just a coincidence that Heller and Thelen and Brobeck were SF firms.

First let me tell you that I have been around. I was a bouncer for many years, and a Biglaw associate. If two of your rainmaker partners try to jump ship to a competitor, don't forget that it is a street fight, and there are no rules. Offer them increased equity, then take it to the ground while they consider the offer. The heel-hook is always a winner from a north-south position, or just straight ground and pound. If you can't take them down and the partners are still hell-bent on jumping to a competitor, shut the door to the conference room, lock it, create distance and grab a chair.
Those who think the street is brutal have never been in Biglaw.

Guys used to give their organizations ridiculous names a la "MoFo" all the time, it was no big deal. But alas, they were adolescents.
A salary freeze would be a dream. I am one of hundreds of asociates at MoFo that are doing absolutely nothing ...except fight internally for pro-bono work and revamping marketing materials ( why??). The axe is being sharpened and things are getting pretty stressful. I wish the firm would fire a hundred or so lame partners and close all the foreign offices (i.e. black holes/money pits), then maybe ( just maybe) my alternative lifestyle gig can continue to run thru this recession. It is looking bleak. I am too young to flip burgers and too old to flip burgers -- the window is closed.

55, you may be slow, but I don't think there are "hundreds" of associates at MoFo with no work. We're busy in my group, and I don't get the sense that other groups are just twiddling their thumbs.
I do agree that things are getting stressful, but it's b/c the firm is refusing simply to tell us anything about bonuses or salaries. There really is no good reason why they can't just make up their minds and tell us how much we are getting paid for the work we are doing.
I think maybe they are in a tough position on bonuses, since they set out a specific hours/performance-based bonus plan in April 2008. Unlike firms that left themselves more discretion with their bonus plans, MoFo committed itself to specific pay for a specific amount of work. I'm not a labor lawyer, but my understanding is that this is not the kind of bonus plan an employer can retroactively change at will.
And even if changing the plan now to reduce bonuses retroactively is not illegal, it would seem pretty underhanded to take away money that has already been earned by associates. So they are probably struggling with that.
I do think it is likely that they will sign on for the freeze and reduce bonuses going forward, but there has been no announcement yet.
I can assure you there are practices in MoFo that are doing just fine. I am not drinking the cool-aid.
I think it would be pathetic if MoFo did not raise, while OMM and Paul Hastings do. More importantly, the firm really needs to reward the high billers. I know I will definitely not be working as hard as I did last year if my bonuses add up to crap. And yes, there are ways to work less and still work within range of everyone else.
