Be careful of Cravath partners baring gifts. I don't think Chesler would be advocating an end to billable hours if he didn't think he could make more with fix fees and incentive based compensation.

The old "jail" or "enlist" option in front of judges used to be quite common. It no longer is....for good reason. Heavily armed criminals patrollling the streets of baghdad or villages in afghanistan is not a good idea.

The last time sentencing people to military service was okay was when we had a draft, and our military was full of conscripts who did drugs and acted up.

Now we run a high-tech, all-volunteer force. What message does it send to the volunteers when criminals get sentenced to service? Sounds a lot like Pres Obama when he told the gradeschoolers they’d better study hard or they’d end up in Iraq. Service isn’t a punishment. It’s a privilege and an honor.
1. Military Service would not necessarily be punishment as much as rehabilitation. But, if anyone in BigLaw actually spent time in the military, parts of it could be seen as punishment, epically basic/boot.
2. There in one problem though. The whole oath thing stating "that I take this obligation freely, without any mental reservations or purpose of evasion."
