Supreme Court Clerk Hiring Watch: Chief Justice Roberts

Supreme Court hallway Above the Law Above the Law Above the Law.JPGOkay, so Chief Justice John Roberts can't administer an oath of office to save his life. But he can hire brilliant and fabulous law clerks:

1. James McDonald (UVA 2007 / Sutton)

2. Stephen Sachs (Yale 2007 / S. Williams)

2. Erik Zimmerman (Stanford 2007/Wilkinson)

They join the previously hired Roman Martinez (Yale 2008 / Kavanaugh), filling up JGR's chambers for October Term 2009.

We also hear that Justice Samuel A. Alito is done hiring for OT 2009. In addition to Jaynie Randall's previously reported hiring, we can now add:

1. Amit Agarwal (Georgetown / Kavanaugh)

2. K. Winn Allen (UVA / Sutton)

If you know the identity of the fourth Alito clerk, please drop us a line. We hear that SAA is a bit secretive about his clerk hiring, which strikes us as a bit silly. As a former prosecutor, Justice Alito should be familiar with the inevitable discovery doctrine. Why guard the identities of Supreme Court clerks so jealously, when they're all going to be made public eventually by the Court's Public Information Office?

Updated lists of Supreme Court clerks, for OT 2009 and OT 2010, after the jump.

If you're aware of some SCOTUS clerk hiring news not previously reported in these pages, please share what you know, by email (subject line: "Supreme Court clerk hiring"). Thanks.

Will Justice Souter step down now that Obama is president? He hasn't hired his clerks yet.

I'm sure if there was VIDEO of a drunk white judge calling a black cop a "n---o" and saying the following, it'd be right up on ATL:

Cop says judge is drunk.

"That's your interpretation, but we'll see what they say in court, won't we, Mr. Washington?" said Judge Cofield.

Washington asked if she was willing to take an intoxication test. She replied: "Mr. Negro Washington. I need to go to the bathroom, and then I will take the test."

"It's Sgt. Washington," he replied, adding, "Don't disrespect me, and I won't disrespect you."

At another moment, after she had given a urine sample, Cofield asked Washington: "Do you have a reading on my urine test, Negro trooper?"

When asked to sign a form that she understood her rights, Cofield said, "I'm not signing anything, because when it comes down to the bottom line, who's smarter — me or you? We'll figure it out, won't we?"

It is increasingly apparent that President Obama will have an early opportunity to chose a Supreme Court justice, unless Justice Souter is simply a procrastinator.

Does anyone know if the alleged L & W layoffs are being discussed in any other forums? It seems like there is enough evidence (if anecdotal), and, if true, the news would be big enough, to warrant a post.

I understand the layoffs haven't been confirmed. But that doesn't mean we can't discuss them. If lack of confirmation = lack of an ATL post, then layoffs will never be discussed as long as a firm keeps them "stealth."

I know I'm off topic, but that's because ATL won't create a topic. Please don't delete me.

avatar
26 Posted by guest | Permalink Tuesday, January 27, 2009 2:04 PM

With all due respect to Mr. Sachs, I cannot help but wonder whether he is beyond human. I've never seen anyone earn so many accolades. His resume is blinding; I had to look away after the first few lines. Summa at Harvard + Rhodes scholar + Yale Law School + SCOTUS clerk?!

One day, he'll probably be a SCOTUS justice as well.

avatar
27 Posted by guest | Permalink Tuesday, January 27, 2009 2:07 PM

Lat, I have a question re: SC clerks that perhaps you can answer in a subsequent post.

What are the statistics for where SC clerks come from prior to being selected as clerks? Perhaps a breakdown of how many come from private practice, or Circuit courts, etc?

avatar
28 Posted by guest | Permalink Tuesday, January 27, 2009 2:08 PM

18 and 26, I just keep telling myself that he's probably a tool in person. I have nothing to support this belief, but it helps me sleep.

Also, why was he at Mayer Brown?!

avatar
29 Posted by guest | Permalink Tuesday, January 27, 2009 2:12 PM

Looks like TTThomas learned to hire from real schools this term. Let's make snarky guesses why...

avatar
30 Posted by guest | Permalink Tuesday, January 27, 2009 2:13 PM

Steve Sachs, in addition to being a genius, is a really nice guy. He is probably at Mayer Brown because their D.C. office has a top-flight appellate practice.

avatar
31 Posted by guest | Permalink Tuesday, January 27, 2009 2:15 PM

28, I know Stephen Sachs personally and I can assure you that he is definitely not a tool. I agree that you could make that assumption by looking at his resume, but in reality nothing could be farther from the truth.

In-state admittees to UVa have comparable GPAs/LSAT scores to out-of-state admittees. GULC is a great school as well, but don't bother arguing that it has a better student body.

Hey, real reason for UVA is that UVA has great connections in DC. NYU beats it soundly in NYC

SO, iF you want to clerk for SCOTUS, go super elite DC, litigate at top firm, work in Government, or become involved in politics then UVA is a much better choice (based on history and current connections).

IF you want to work in BigNYC, serious NY corp law, or work at super elite NYC, or top level tax, then you are better of at NYU (based on history and current connections).
