Judge of the Day: Bankruptcy Judge Needs Family Law Refresher Course
Judge James M. Peck has received two plum assignments. He’s been handling the Lehman bankruptcy and is overseeing the liquidation of Bernie Madoff’s investment firm.
Some people have been hoping that Peck would lay the smack down on these companies; maybe the federal judge just became horribly confused about his responsibilities:
Bankruptcy Judge James Peck, 63, was charged with attempted second-degree assault and harassment following a Saturday-afternoon tiff with his wife, Judith, 64.
Peck isn’t exactly claiming innocence. Instead, he went straight to “self defense”:
Peck allegedly told police that the blowup began over his wife’s late arrival at the house from the Hamptons, where she’d been earlier in the week.Peck said his wife slapped him first, as he was taking a ladder out of his closet.
“She slapped me,” the judge told police, according to the sources. “I put the ladder down. I slapped her. Then we started slapping each other back and forth.”
“Slapping each other back and forth.” Are we talking about domestic violence, or a Family Guy episode?

When Judge Peck was assigned the Lehman case, media outlets reacted with incredulity. Bloomberg News expressed it this way:
Lehman Brothers Holdings Inc.’s case was randomly assigned to U.S. Bankruptcy Judge James Peck, second in tenure, putting the fate of $613 billion in claims before a judge whose largest case since going on the bench in January 2006 was the $3 billion reorganization of Quebecor Corp.
Peck received his J.D. from NYU and was a partner in Schulte Roth’s strong restructuring practice, back in the nineties.
But two high profile cases is bound to cause some stress isn’t it?
“We’ve been married 42 years,” the judge told cops who arrived at the tony building following a 911 call by Judith Peck, according to the sources.“We love each other very much. I have never hit her before. This was not about tonight.”
Apparently, it wasn’t about 42 years of loving marriage either was it Mr. Peck?
No word on what became of Peck’s ladder after his altercation. But the judge might want to check out Ladders online. You know, just in case the “she started it” defense fails to persuade an ethics committee.

Isn't there a requirement that Bankruptcy Judges have at least ropom temperature I.Q.'s?
Remember, these are NOT Article III Judges, appointed by the President and confirmed by the Senate; they are appointed by the Article III Judges and serve a limited term.
How could he be removed quickly? The Judges need to slap some sense into him. Home confinement, indeed.

Elie, you seem to think it is ok for her to hit him, but not ok for him to hit her, even though she was the aggressor (allegedly). I wonder why that would be the case. Aside from sexism, I can't think of a single explanation. Would you also wag your finger at a female judge if her husband struck her and she hit him back?

When a woman hits a man it is appropriate for him to respond with exactly the same amount of force, though no more. What this judge did was appropriate. What decade are you living in, or does your sympathy for affirmative action make you sympathize with every double-standard regime directed against white men?

Did like two commenters post all of these comments? This particular post is lame, and it's no surprise that an uninteresting post would generate uninteresting comments. But in general I'm enjoying the comments on this site for the first time ever.
I'm of the opinion that bi*ches ain't sh*t but ho's and tricks.
That being said, I bet the judge's wife said something that he couldn't believe. When she started talking sh*t, the judge simply reached back like a pimp and he slapped the ho.
However, in his statement to the police, he omitted all details about how he grabbed the stupid bi*ch by her nappy ass weave.

No matter what your spouse does to you with unarmed hands you have to take it until you can get to the front door and just walk away.
Even if you are in the right, slapping your "better half" is just not worth it.
Note that the "self defense" ploy did not work too well for Ed Halverson either.

Guys in my high school used to slap women around in self defense all the time. It was no big deal.
I thought this post was interesting (though late) and totally appropriate for ATL. I also think the comments have been better lately.
That photo looks like someone photoshopped the guy's head (which looks like a bobble head) onto the body. Sort of like the before and after pictures for bodybuilding supplement ads.
