Nationwide Start Date Watch: Nixon Peabody Makes the Move to January 2010

Nixon Peabody logo.JPGGiven Nixon Peabody’s announcement earlier this week that it was laying off 20 attorneys and 36 staff, one might safely assume that there is not enough work to go around at the firm. Accordingly, a tipster e-mailed us this week to say that 3Ls bound for Nixon this fall had been told that their start dates were being pushed back.

Allison McClain, Nixon Peabody’s spokesperson, confirmed this:

We have chosen to defer the start date for our fall associates to January 2010 and we will pay each a deferral stipend. This start date change affects all of our fall associates in all offices.

McClain declined to elaborate. Someone tell us: what’s the going rate for deferral stipends these days?

Last month, we asked whether later start dates were the trend for the fall. In our terribly unscientific poll, only 6% of respondents said their start date would be in January, while the most sizeable chunk—35%— said they were starting in September.

We’ll continue to keep you posted as to start date push backs. On the downside, later start dates mean delayed revenue for first-year associates (though one could move home with the parents and hoard the deferral stipend). On the upside, those Biglaw-bound 3Ls who don’t like the beach may be able to start thinking about bar trips that involve skiing.

Update (2:39): Tipsters are now confirming that the deferral stipend is $10,000.

Nixon has little work and hired too many first years. Now, Nixon is hoping that some of those first years due to start next year will take this step as a message that they should find other employment. If they do not, Nixon will convert some or all of these "deferred" associates into laid off associates.

Hey, 9, studies show that lawyers (and MBA's) who graduate during a recession suffer lower life time earnings. This is because that they cannot get the crucial experience during the early part of their careers that people who are lucky to graduate during boom years get. Thus, when the economy comes back, the people who graduate during bad times are out-competed for positions/income by those people who did get good experience by virture of graduating during an economic boom.

I am really sorry that you and your fellow law school graduates missed out, and that you will be feeling it for the rest of your career. Good luck.

33, unfortunately you're incorrect. I was in the same situation with Thelen last year. They gave us a stipend for delaying our start dates and then let us keep it when they dissolved. But I wasn't actually entitled to anything. I feel like I should have been. I know what it feels like to have that sense of entitlement to the job, and it really sucks to have your lifetime of hard work stripped away from you in an instant.

9 - sorry, there are no guarantees in law or any other profession. And there are MANY people out there who have worked a LOT harder than you (sitting through college and law school classes and taking exams is hard work? LOL!!!!), and have even lower future prospects. Sorry that your carefully-laid plans of studying REAL hard and being a gunner in law school, and getting an overpaid position as a know-nothing fungible junior associate in a big name firm, and backstabbing our way to a hoped-for partnership (hah!) while being paid far more than you're worth, all didn't pan out.

Goddamn this new generation of kids who saw some good times while growing up and think they're entitled to success and riches. It's a dog-eat-dog world out there. Want to be successful? Grow some balls and make an aggressive Plan B when the easy Plan A becomes unavailable.

For all you 2009 grads who will have your start date deferred -- just remember another reason why they're deferring you: so that they can do layoffs of 2007 & 2008 associates in January, 2010, and give you the work that they were doing.

Also, you shouldn't expect to see the senior associates you met last summer; lots of them won't be there by 2010 either.

Oh, and the partners who you worked for last summer? A whole bunch of them aren't going to be their either.

Remember what Reagan said in 1980: a "recession" is when your neighbor loses his job; a "depression" is when you lose your job.

Nixon Peabody mid-level litigation associate here.

There have been rumors of this for about a couple of weeks and speculation that it could be a sign of worse things to come. We are all very aware that Heller and Thelen used this technique right before they went under. I billed less than 50 hours over the past two months and that is about on par with everyone I know. Morale is very, very low. Most importantly though, is that the firm just issed a memo to all associates explicitly informing us that they no longer consider all of us to be winners. In fact, they consider us to be "festering TTT losers who couldn't get a job at a real firm." I came in this morning to find a handwritten note from a partner asking "Why coudn't you have gone to a better law school and gotten better grades - then you wouldn't have been forced to accept an offer at sinking ship of a law firm where you will eventually be fired for "performance" reasons leaving you with a suffocatingly painful pile of debt with no future prospects? " Needless to say I am more than a little disheartened by this development and will begin circulating my resume ASAP. Problem is, the fact that I work here in the first place is the result of going to a crappy law school and getting crappy grades and not too many firms are hiring staff attorney-quality lawyers right now. I'll keep you abreast of any futher developments.

I'm a 3L headed to biglaw (hopefully). Its not that I feel entitled to a job or to make a lot of money. I've worked very hard in school and spent a ton of money trying to achieve my goals, and then this horrible economy hits and I might lose everything I've worked for. But, I still don't feel entitled.

I'm a 3L whose headed to biglaw in NYC (hopefully). It's not that I feel entitled to a job or to make a lot of money. I've worked hard in school for the past 7 years and accrued a ton of debt. It's annoying and it upsets me that this crappy economy may take everything I've worked for away - just as I was getting my foot in the door.

64, I hear you. I'm the poster from above who was supposed to start at Thelen. It's been a very tough road since Thelen dissolved. My best advice for you is to start networking now and getitng your resume out there. It can't hurt, and if there's some sort of massive layoff at more firms, at least you'll be out there already. Unfortunately everyone I spoke with told me that they weren't hiring, even though they liked my resume. It's very disheartening, and also very depressing to be in this situation. I hope things go better for you than they did for me.

I hope everyone who is on here bitching about how they got screwed continues to hold that attitude throughout their job search. It will ensure every firm avoids them by a mile and will make it easier on the rest of us who got screwed but aren't ineffectually lashing out.

86 here. 85, you're technically right, but I still think it would be smart to get your resume out there. I was optimistic that Thelen would merge with Nixon and that eveyrthing would be ok. And that was a long time ago. Things are so bad right now. I personally took the time to travel when my Thelen start date was pushed back, and it was the best thing I could have done. Definitely go travel, but also remember that Nixon may not be the golden ticket you thought it would be.

9 - I understand 9 . . . a little.

I took out loans for law school based on the assumption I could land a biglaw job and pay them off fast. My assumption was low risk: I attended a T-5 school in a boom time. It panned out, and now I've paid back a huge chunk of loans, bought house, etc.

However, if I were in school now having made the same loan/job calculation, only to have the equation changed by the recession, I would feel fairly duped and definitely panicked.

However, I agree with 47 - instead of ranting on some website, I'd be working hard on my plan B, and doing all I could to make some sort of safety net.

In fact, now that I think of it, I think most state bars have a requirement that you must finish law school in 4 years. Maybe 2Ls should take next year off from school, do something to earn some money and get some experience, then go back to school and graduate in (presumably) better times. There's probably a million flaws with that idea for the commenters to rip apart, but it beats ranting about how unfair everything is.

67; this is 16. You missed the point -- most recent graduates won't ever get to enjoy the "lockstep thing." That is because they will never be hired by firms that use lockstep, rather they will be forced to work in small law, getting experirence that will never be useful to a big law firm that uses lock step. Thus, they will be less likely to ever be hired by biglaw even when the economy improves. That means they will earn less over a life time. And, by the way, fewer and fewer firms are using lock step. You can expect that recent grauduates will make between 25 and 40 percent less over a life time than their peers who graduated during a boom. That's just a fact.

43: you are undoubtedly a newbie. I am sorry that you will suffer. Please consider other careers now, rather than trying to make this one work out -- Although your ppost does not reflect much in the way of reasoning ability, I am sure that you could be a good lawyer, but you were just too late to the party to make a go of it in Biglaw. So Sorry.

9, stop your fucking whining. I'm a 3L too in the same situation as you - gave up other opportunities to go with a firm that screwed me as they started collapsing. Am I dissapointed? Obviously. Do I harbor bitterness towards the firm? A bit. But coming on ATL and crying about being a victim makes you look like such an epic d-bag it's absurd.

Start looking for new prospects and pray that it isn't as bad as it looks. People will respect you if you keep a positive attitude and take proactive steps to better yourself. If you whine and feel entitled people will just look at you like a pathetic loser who doesn't know how to deal with adversity. No one said this shit would be a cakewalk.

I don't understand people's desire to trash others so much. This is why people hate lawyers. We all have this me first mentality and we are so quick to laugh at other people's misery and misfortune. Why can't people just understand that the economy is bad. People are getting laid off. Firms are freezing salaries. Firms are pushing back start dates. Why do we have to make fun of people, criticize them for ranting, etc.? I understand people who want to make fun of others for feeling entitled, but for people to openly taunt and degrade those that have been laid off or had their start date pushed back is absurd. What goes around comes around. It is time for everyone to relax, stop using this time to bash people for being laid off. This time sucks for everyone.

To those that have been laid off, I am sorry. Be positive. Look at various alternatives outside of law. Volunteer. Do something to stay active. And network. Things will work out.

I can't believe NP would make such a drastic decision right now - kills their reputation, and may actually come back to haunt them if workload increases. There will likely be more work in the fall than there is now, just as there is more work now than there was in November/December. This is a bad recession, but the economy will rebound, probably sooner than people think.

If your firm doesn't defer its 1st year start dates, and you don't work at Weil, then something is wrong with the managment at your firm, because no one needs a boatload of first years coming in in 6 months, especially in light of the fact there is no work coming in and natural attrition has disappeared.

Is it too much to ask people on this message board to have a little compassion for our colleagues who have just lost their jobs? It is disturbing to see how inconsiderate and tone deaf some of you are toward others.

I am very fortunate to work in a busy counter-cyclical practice group at a top 100 law firm. Nevertheless, I can empathize with everyone who is suffering. I realize every day how blessed I am.

Just because we’re attorneys does not mean that we have to treat people like crap. Many of the people who have lost their jobs have families to support. If possible, show a little empathy, compassion, and humanity toward others. You could be laid off tomorrow.

This is definitely not the time to point and laugh at those who lost their jobs or might be losing their jobs. Your jobs might be next. I'm pretty sure the NP folks didn't expect it, especially when the firm just opened new offices and absorbed Thelen folks.
