Supreme Court Clerk Hiring Watch: A First for Seton Hall

Supreme Court hallway Above the Law Above the Law Above the Law.JPGWe take back what we previously wrote about Justice Samuel Alito being “a bit secretive about his clerk hiring.” Presumably Justice Alito signed off on this press release issued by Seton Hall Law School, announcing the hiring of Lucas Townsend (Seton Hall 2004 / Ackerman (D.N.J.) / Trump Barry) as an Alito clerk for October Term 2009.

Congratulations to Townsend and to Seton Hall, which has placed its first graduate into a SCOTUS clerkship. From a tipster:

We just got this email [a slightly tweaked version of the press release] from the dean. Not bad for a school that most of the elitists on ATL would consider a TTT. Although SHU will never sniff the T-14, the school has been steadily climbing the U.S. News rankings, and I think this alum’s accomplishment might help that cause.

We also had the best showing of New York Vault 100 placement ever by this year’s 2L class. Things are looking good on this side of the Hudson.

In other SCOTUS clerk hiring news, Justice Anthony M. Kennedy joins the “finished for OT ‘09” club, with these three hires:

— Daniel Epps (Harvard 2008 / Wilkinson)

— Allon Kedem (Yale 2005 / Leval)

— Misha Tseytlin (Georgetown 2006 / Kozinski / Brown (D.C. Cir.))

They join Scott Keller (University of Texas 2007 / Kozinski), whose hiring was previously reported here.

Most of the justices are done hiring their October Term 2009 law clerks, except for Justice Clarence Thomas and Justice David Souter. Justice Souter traditionally hires last, so it’s not surprising that he still has open spots. But one can’t help wondering whether DHS, never a fan of life in D.C., might be considering stepping down from the Court, now that President Obama has taken over. As for Justice Thomas, we suspect that perhaps he has hired all his clerks, and we just haven’t heard about it. If you can help, please email us (subject line: “SCOTUS clerk hiring”).

Wow, I knew SCOTUS was powerful, but I never knew they could go back in time and redo the 2004 term. Is this a joke on Seton Hall then? Your grad gets a clerkship for a term a clerkship that was over 5 years? Or is this yet another example at how TTT Elie MYSTTTTAL is? Come on MYSTTTAL, he GRADUATED in 2004! Alito taught Con Law at Seton Hall from '99 until '04, while he was on the Third Circuit. It's quite possible that he had extensive contact with Townshend while they were both there.

Stop the hate. Lucas has done three straight clerkships and is more than qualified whether he went to CCN or SHU. All the TTT is fine if that makes you sleep at night but an LSAT score is just that, a score. Sooner or later you guys, most of which are weird as all hell, will realize that those prestige points won't help you when you actually have to perform against that TTTier 2 grad that is better prepared (having to actually work hard in Law school) and has a chip on his/her shoulder.

Here is how the game of life really breaks down for the people who read this blog:

1. Ultimate Winners - there are about 6 of these guys out there. An Ultimate winner went to HYS, works at a V-10, and is also magically cool/good looking/personable/athletic/gets laid regardless of money/prestige. Ultimate winners would have friends and score beautiful (actual, not law school scale) women even if they were electricians + they are uber-smart FTW.

2. Winners - People who have all of the characteristics of the Ultimate winner, but didn't go to a top-5 law school. These guys are still "the man" and are very successful, but they fall just short due to their lack of pedigree. They rarely feel inferior because only a handful of people being better than them at any given thing they ever try to do. Winners are also self-aware.

3. Nothing to be ashamed of - People who have one or two things that they are really good at but are just normal otherwise (maybe they are really smart and went to YLS but are socially awkward). The key to having nothing to be ashamed of is knowing your limits. If you are a genius but are kind of goofy and you embrace it, you got nothing to be ashamed of and probably have a pretty nice life.

4. Tools - These guys are probably really great at one or two things but suck at everything else (e.g. goes to HLS and comes from cash but has no personality, is funny looking, etc. OR goes to Rutgers law and thinks he is better than all of his non-law school friends even though he is really just a big fish in a small pond). The key to being a tool is hyping up your positive quality, making fun of others that don't have it, and crying yourself to sleep about what you don't have while trying to convince others that you are flawless.

5. Losers - People who try to comment on ATL and make fun of people at other law schools, firms, etc. from behind their computer. Losers don't appreciate what they have and are usually deficient in all categories but one. They are the antithesis of the Ultimate Winner and still can't get laid even though they make a lot of money and went to Harvard. Losers can't really even convince themselves that they are cool and will stop at nothing to drag others down to their misery.

Ha, I went to nerd camp with Misha Tsetylin. The counselors did a skit at the end of the summer and one of the lines in the skit that I remember to this day is "Misha Tsetylin needs some Ritalin."

I clerked at the Piggly Wiggly after law school, so there. Provided a smooth entry into my current immigration practice. And I'm not too proud to admit that I still maintain that clerkship on a part-time basis, Tuesday and Thursday evenings. Clerking is cool.

As a SHU grad with no great pride in my school, I can say that I have won in court against HLS, Columbia & NYU grads, so, I agree with above. Your score on the LSAT, while deciding where you will go to school and where you will work, has little to any merit on the quality of attorney you will become. Plus, I certainly paid a lot less for my education as SHU paid a lot of my tuition for me!

NYU does not suck. It is the career services and faculty members who are in charge of helping with clerkships that are not carrying their weight. There is no reason that UMICH, UVA, Chicago, CLS, etc. should be getting one or more clerks a year and NYU is not.

NYU's pathetic response is to allow for A+'s and increase grade inflation which MAY help future grads at the expense of current and recent grads.

80, I did not apply for a Supreme Court Clerkship. But it is a little harder than "busting your ass." The fact is that NYU is not doing a good job of getting its students clerkships. Only four of the current justices have hired NYU students. Breyer and Ginsburg have never hired a NYU student. Only four justices have and the two that have hired the most, Souter and Stevens, are the most likely to retire. The fault lies with the people in charge of clerkships.

81, you have your facts wrong. Phil Weiser received a J.D. from NYU in 1994, clerked for Ginsburg on the Supreme Court in October Term 1995, and now teaches at the University of Colorado. Paul Schiff Berman received a J.D. in 1995 from NYU, clerked for Ginsburg on the Supreme Court in October Term 1997, and is now the Dean of the Sandra Day O'Connor School of Law at Arizona State University. Alexander A. Reinert received a J.D. from NYU in 1999, clerked for Breyer on the Supreme Court in October Term 2000 (a Term when Stevens and O'Connor also had clerks from NYU), and now practices civil rights law in New York City. Ariela Migdal (Joe Lieberman's daughter-in-law) received a J.D. from NYU in 2001, clerked for Breyer on the Supreme Court in October Term 2003, and now works for the ACLU (I believe). The only current Justices who have not hired clerks from NYU are the two newest Justices, who don't have much of a track record, and Justice Kennedy.

Misha is one of the most genuine people I've met and a great guy. Smart yes but he also works very hard--he deserves it!

Misha is both obnoxiously insufferable and insufferably obnoxious. Plus, his Facebook statuses are about as intellectual as the regurgitated conservative junk from Rush Limbaugh.

or an american university outside of the 48 contiguous states?
