Ex-Thelen Employees Granted Class Status

Thelen LLP new logo.jpgThelen dissolved, not that long ago. But some former employees claim that they did not get sufficient notice under the WARN act. Those employees are now allowed to pursue remedies as a certified class:

Lawyers and staff for the now-defunct firm Thelen have won class certification of their suit claiming the firm failed to give federally required 60 days notice that it would close its doors….

Thelen stipulated to class certification, a move praised by Steven A. Blum, who represents former Thelen employees.

Congratulations guys. Good luck getting blood out of a rock.

Of course, there are people affiliated with Thelen that still have money, and the lawyer representing former Thelen employees intends to go after those deep pockets, regardless of where they practice now:

Asked if sufficient funds exist for a recovery, Blum said, “From one source or another there should be a substantial recovery. From Thelen itself there are banks to contend with first and we may have to go to other sources in addition to Thelen to get maximum compensation.”

He said those other sources would include “other law firms that have taken large groups of Thelen partners and discarded the employees.”

Interesting. Nixon Peabody picked up 90 Thelen attorneys. Any chance that former Thelen partners now at Nixon will disgorge profits to this new class of former employees?

all former thelen partners should be concerned. it is not unheard of for liability to stretch to partners that have departed a firm and even hold the new firm accountable. If people are desparate, they will do anything. plus, with the internet, it is easy to start shredding the reputation of these partners. I know of one firm (wink wink) that hired an online "press release" company. The company put out press releases regarding a lawsuit the partner was in. because of the skill of the press release company, whenever the partner's name was searched using any search engine, the press released showed up at the top. the case was settled.

FUCK THELEN...all the 3l's who took offers from the summer of 2007 detrimentally relied on thelen when taking out loans for third year of law school...as far as im concerned the 3 l's should sue thelen...since we were told in march of the problems and then in december of 2008 we found out about the dissolution, we should have some kind of lawsuit...i hate thelen and big law for fucking with stupid law students....FOR ALL THOSE OUT THERE WHO WANT TO GO TO LAW SCHOOL...DO NOT GO...YOU WILL NEVER PAY BACK YOUR LOANS...YOU ARE STUPID IFYOU GO TO LAW SCHOOL...IT ISNT WORTH IT...GO ENJOY UR LIFE AND HAVE A GOOD CAREER...

Here is my proposal to avoid disgruntled former employees.

For many years I have urged the firm's management committee to consider hiring barristers from India and the Philippines in lieu of hiring overpaid associates to do menial tasks such as document review, due dilligence and bate stamping. Here are the facts: foreign barristers (with emphasis on experience) will work for the equivalent of $20-25 an hour. If you obtain 2,000 billable hours from a foreign based barrister, the firm can bill them at normal or even slightly reduce rates of $350.00 an hour. That is an annual revenue of $700,000.00 per barrister. At $25 an hour, the barrister is paid $50,000.00 resulting in a net profit of $650,000.00 per barrister for the firm. The beauty of this plan is that there is no overhead expense (i.e., office, secretary, perks, etc.) with hiring a foreign based barrister. If the firm hires an inexperienced associate out of a top school, we would have to pay $110,000.00 more which I would rather capitalize on the firm to protect us from these horrendous economic times and from the wealth robbing policies of the Obama administration. I believe most firms, including my own, will start to consider this plan.

The best thing about this plan is that you can terminate the barrister any time you want and there is no legal recourse. Do you think a barrister making $25.00 an hour is going to fly to the States and file a class action against the firm?

In my experience I have noticed that Indian barristers write quite well, often better than American educated attorneys. These barristers will only be doing leg work and no interaction with the Court or clients will be necessary so the plan will work.

What you are doing is devaluing your profession. Sure, go ahead and help the Indians along and make tons of money for yourself. I am sure you have enough money banked to live on for another 10,000 years and I guess you want to make sure you're covered if you happen to live 100,000 more years. They will work cheap for now and learn all they can, but eventually when they don't NEED AMERICAN HANDLERS AND MIDDLEMEN like yourself, they will drop you like a hot potato and approach the clients themselves. All they need is 1 Indian in the US with a law degree who has passed the bar to form their own firm and compete directly with you at much cheaper rates because they don't have you in the middle sticking your paw into the pot. Currently there are thousands of them here. You are playing a dangerous game for your entire profession. There was much talk in the past of accountants having tax returns done on the sly in India and charging their clients full American prices (and not telling the clients), but I think accountants have realized that they are DEVALUING THEIR PROFESSION and will get cut out of the equation by the Indians eventually. Attorneys should wake up. Not everyone can be a partner and not everyone will. Is it going to be a case of an attorney is either a partner or doesn't have a job because everything else is offshore? Yes, that would be glorious for existing partners to have banked enough money to live off of for 1,000,000 years, but how will you grow new partners? Plus, how will you spend all that money anyway? Perhaps if the uber rich turn America into pure haves/have nots, you will not be able to drive anywhere due to the fear of kidnapping and will take private helicopters. That will spend some of the money but not all of it. America will suck if it turns into a place with only haves/have nots. That should be enough to temper your greed, but I doubt it.

The Dissolution Committee is still collecting a salary for doing nothing. Some of the Partners on the Committee are solely to blame for the firm going under. How do you approve a merger when the company you are merging with is in debt and has not paid their bills for years? I hope Thelen employees are able to get their money and that the greedy Partners get what they deserve. Karma is a bitch......

I do not think that Elie is a terrible editor. I also do not think that Elie is a terrible writer. Admittedly, I only began to read a.t.l. a few months ago. Still, my first question is: Are there not greater issues at hand? My second question is: Are those complaining not guilty of poor grammar and editing themselves? I suspect that many complainers are envious of Elie because he has a job whereas they do not.
