Adventures in Lawyer Advertising: ‘The Dopest Attorney’

Allison Margolin, whom we have written about before, is an HLS grad who practices law in Los Angeles. According to her website, she “handles all criminal cases from murder to medical marijuana.” But the latter would appear to be her passion, judging from how she wishes to be reached:

    When we were in L.A. in March, we spotted her ad in L.A. City Beat (a newspaper that has since folded). A tipster did us the favor of scanning it and sending it our way:

    Her branding skills are dope, yo.

    We don’t know if Margolin was on law review during her days at Harvard Law School, but we do know she recently penned a legal editorial for stoners. Check out her argument against the prosecution of medipot growers in CelebStoner.

    In my ethical lawyering class here in LA, the prof actually showed us her ad as an example of what not to do. The claim "dopest lawyer" can't be substantiated by facts and is a violation of the CA rules.

    "Dopest" may not be a claim regarding the quality of her work, her standing, etc... It fairly may be read as a claim about her area of practice, which appears to be THC-related.

    I'm just thinking outside the box here, but I think she needs to be careful about her advertising. If someone smoked dope, relying on this advertisement to get out of trouble, then this "hot lawyer" might be in trouble. Now I'm not a lawyer, but I think you could argue that her advertisement constitutes an implied promise to get you off of a minor drug offense. Damages would be capped at reliance damages (of course). I need to do more research, but I think Restatement 90 is quite clear on this.

    Aside from looking like a Czech madam running a low class brothel, this woman is a prime example of what's wrong with today's generation of attorneys. I find her advertisement to be unethical and criminal (solicitation of a criminal act). I never had respect for west coast attorneys and apparently anything goes according to the California Bar authorities.

    Normally, in order to fully appreciate the importance of this item, we would have to know whether Harvard Law School is accredited by the American Bar Association. However, since one does not have to be a graduate of an ABA-approved law school to sit for the bar examination in California, that inquiry is irrelevant ot Ms. Margolin's circumstances.

    @8: Sadly, no she can't. She misspelled the name of her intern on her website. The run-on sentences and atrocious grammar on her site don't help either. (Although they may be intentional, to flow better with the mindset of her client base.)

    (1) Her ad does not say that she graduated from Harvard - perhaps she just means that as part of her practice she will be applying 'Harvard Law,' i.e., the law that she believes is taught at Harvard.

    74 you are an idiot.

    I don't know if you went to law school, much less Harvard, but there's a few things they teach you there:

    1) Federal vs. state law (and in CA, marijuana is legal with a prescription and Obama does not plan to enforce the federal law in CA).

    2) That people accused/convicted of crimes, no matter how guilty they may be, are entitled to defense regardless if they pay themselves or we the taxpayers do. Attorney's can and are obligated to tell their clients what is and is not against the law for probation matters and what types of behaviors/test results will get that probation revoked. To do otherwise would be malpractice, and you as the attorney cannot tell said client NOT to smoke pot despite any possible ramifications.

    3) At Harvard at least, they teach their law students to respect others' viewpoints, and if she likes pot/has sympathy . Most HLS grads go into big law firms after graduating, and Ms. Margolin is turning down an awfully big pay check to practice what she cares about.


    On a personal note to you, just because she's intelligent, worked hard to get where she is, and has different views than you do doesn't give you any grounds to belittle what she's earned. Even alumni that are clear hypocritical lawbreakers like Elliot Spitzer, as embarrassing as that may be for Harvard, are not denounced by the school.

    Why don't you just chill out and smoke a joint...or better yet, get a job rather than hate on someone else over the internet.
