Lawyer (Turned Escort) of the Day: Nina Baccala

prostitution above the law.jpgTimes are tough, and sometimes those with JDs have to find sources of income beyond their legal pursuits. Sometimes they try to increase their cash flow through illegal pursuits. Such as prostitution. (This isn’t the first time we’ve covered the phenomenon.)

Putting your life in the hands of a random John has bigger potential downsides than handing your body and mind over to Biglaw. From the Massachusetts Lawyer Weekly:

In a story similar to that of the so-called Craigslist killer, a Massachusetts lawyer claims she was the victim of an attack at knife point in Providence last week after placing an ad offering escort services.

A Providence Journal story states that Nina C. Baccala met William V. Lapierre after advertising escort services in the Providence Phoenix. When Lapierre allegedly tried to rob Baccala with a large kitchen knife, she reportedly fended him off with a chemical spray.

Baccala passed the Mass Bar last year and clerked for Superior Court Judge Raymond J. Brassard, says the Massachusetts Lawyer Weekly. She has a JD and an MBA, and still had to go the lady-of-the-night employment route. This economy really sucks. More on her background and how she fought off her attacker, after the jump.

The Providence Journal describes the attack:

Nina C. Baccala, 36, of North Providence, told the police that Lapierre invited her into his first-floor apartment at 18 Barrows St. before 2:30 a.m. and offered to get her a drink, according to Oates and a police report. Instead, Lapierre returned from the kitchen with a large knife, according to a police report.

Baccala said that Lapierre told her: “I’m not going to give you money. You’re gonna give me your money.”

Baccala told the police that Lapierre held the knife to her throat and threw her on the couch, according to the police report. Baccala sprayed Lapierre in the face with a chemical spray and fought him off when he tried to stab her, according to the police report. She fled outside and called the police.

Apparently, Baccala’s MBA has come in handier than her JD:

Baccala, who graduated cum laude from New England School of Law, in Boston, was admitted to the Massachusetts bar in December. She is awaiting the results of the bar exam she took in Rhode Island in February. A Bryant University graduate with an MBA degree, Baccala is also listed as the president of BCN Enterprises LLC, a business that she incorporated in 2003 as a “dating service.” Her business is recorded at the secretary of state’s office as providing “assorted gifts, merchandise, personal services,” and she listed it as “telephone sales” on her 2008 application to the Rhode Island bar.

We hope this doesn’t hurt her chances for admission to the Rhode Island bar.

Why would the paper post her name? This really is going to negatively impact her career. If the attack happened, she is a victim and deserves privacy. What paper did will possibly prevent other victims from coming forward. There was no need to publish her name.

Apparently she is a graduate of the USC (University of Southern California) School of Law. It's really sad what happens there, they'll take any rich kid that pays the tuition and can't get into a better school, but then they drive them into whoring themselves out.

The problem with your analysis Kash is that you ignore the indispensable causal criterion of temporality. She was an escort before she became a lawyer and was turning tricks at the height of the real estate-led BigLaw bubble. Thus, the Great Recession couldn't possibly be the cause of her descent into whoredom.

Anyone else troubled by the fact she said she was a clerk for Judge Brassard? Judge Brassard is perhaps one of the most reputable judges on the bench and would never have patience for someone like her. Not to mention clerks are not assigned to individual judges.

How pathetic is it that Assistant Attorney General Stacey Pires Veroni contacted a newspaper and admitted Ms. Baccala feared a tanking of her reputation because of this incident. It seems like she laughed in the victim's face. Very disheartening.

Ms. Baccala accompanied this individual in reliance on an implied promise that she'd be paid for her services. She was never paid. Wouldn't she have some sort of claim here?

If she counted on the john's guarantee to pay, and relied on it to her detriment, she may have a promissory estoppel claim against him. Her damages would of course be capped to the extent of her reliance. I believe Section 90 is very clear on this. Does anybody have experience suing clients who don't pay?

Seriously, there's a need for a retraction/correction here.

Superior court "clerks" in Massachusetts rotate among judges.

This woman doesn't deserve to even have her name in the same sentence as Judge Brassard. He's one of the best judges on the bench in Mass.

When I was a graduate student at the University of Michigan, there seemed to be three dominant fantasies among us females:

* Have a baby

I had all three. I'd probably have made out best if I choose Door Number 3. In fact, many of former female classmates regret not exploring selling our bodies when we had one. II recall using the "escort" services of young, eager male associates at my firm on many occasions. Although at my age I have trouble achieving or maintaining a state of physical arousal, the young men at my firm helped me through my fumbling attempts. Serving as an escort is not an easy task, so I commend this young woman for her bravery.

This isn't limited to difficult economic times or even third-tier schools or firms. Here is a story from 1997:

"Marsha Watt, a 1990 graduate of Northwestern University School of Law and formerly an associate at the prestigious Winston & Strawn law firm in Chicago, had charges filed against her in February by the Illinois Bar over her most recent conviction for prostitution (i.e., the kind involving sex, for which her published rate, according to a personals ad, was roughly three times what the law firm billed for her). As someone who has friends at New England School of Law, I find it sad that an 80 something year old alumni talked about being in one of the first graduating classes of women lawyers (as NESL began as a womens law school) and despite her degree the only work she could find was as a secretary.....

Now decades later.... New England Graduates have apparently been forced to downgrade from secretarial work.... to the realm of escort services...

Don't worry, if I run into Nina any time soon (I actually know her) I will be sure to let her know you all say hi!

The reason why she is working as an "escort," is because she is completely incapable of working in the legal profession. She ignores constructive criticism, she misses deadlines, she fails to submit work, she lashes out at others, and she cannot accept responsibility for any of her actions. That she was allowed to graduate after all that she pulled there is a testament to her ability to threaten and harangue members of NESL's administration.

Having met Nina, her choice of professional endeavors did not surprise me. That men were willing to pay for her services was much more of a surprise. (Though, apparently, they weren't).

93, yes nesl students have plenty of opportunities, in my opinion it is despite the school not necessarily because of it. But then again that is my own personal opinion. Which I do believe I am allowed to have...

94, I also agree, I was not surprised in the choice, but surprised someone might be willing to pay her... although now it does shed some light into where she got the money for her luxury car while living on school loans...The thing that bothers me most 94, is good students who have a rough time get the boot and then people like Nina bully their way through the system.

Hey 94,

Could your real issue with Ms. Baccala be that she was the only person on LR that was willing to challenge your tryannical rule, and as a result it was YOUR conduct that was scrutinized by the school's adminstration (oh yeah, I forgot, there was one other--she was threatened, publicly humiliated, and ultimately expelled from LR).

How's the solo practice going? Pretty big undertaking for a recent law grad. Or could it be that perhaps it is you that is "completely incapable of working [with others] in the legal profession [?]"

I wonder if I am in the only one of your 1L classmates who considers what having an affair with a fellow classmate (which was made obvious by your public displays of affection) while your wife is home caring for a newborn baby and 2 year old child says about your morals and values. My only surprise is that you were able to find such an alternative companion in the first place (Geez, I wonder if Mrs. #94 is following this discussion...)

102- NESL is a diploma mill that ruins lives and should be shut down. Unless you are in the top 5% no reputablefirm will touch you with a barge pole.

Is is worth the $100,000 investment in tuition? NO. Jesus,even Suffolk grads look down on NESL grads, and that's saying something.

And besides, most lawyers are principle whores anyway - do anything or say anything for the right hourly rate - what she does is a step up.
