So Bush nominates Harriet Miers, and the left starts ranting about how she is completely unqualified. But is she any less qualified than an elected judge who has only sat on her state's highest court for three years? Was Miers any less qualified than an academic who failed the bar exam only four years ago?
I'm not saying that Harriet Miers was qualified for the position, but why does being a lesbian suddenly make you worthy of being a Supreme Court justice?

The cries from the Left I could have handled. That was to be expected. It would not have been a problem since Republicans were a majority in the Senate. However, it was the cries from Right; Coulter, Noonan, Malkin, Dobson, Norquist, et al., that led Turdblossom to recommend that we pull the plug on dear old Harriet. Too bad, she was doing one heckuva job.

Really? Failing the bar automatically disqualifies KS? So we'll just ignore she was the Dean of Stanford, and that she has repeatedly and successfully argued in front of the Supreme Court. Let's ignore that she has been a law professor specializing in Constitutional law for 25 years. Oh, and that she's the author of a leading casebook on Con Law.
24 years AFTER she graduated from Harvard, she took the CA bar, probably didn't prepare very thoroughly and failed.
I really think KS failing the CA bar says way more about the meaninglessness of the bar exam than it says about her qualifications (though it probably says as much about her ego. But really, when L. Tribe calls you the most extraordinary student he's ever had, you probably have a right to a big ego).

Kathleen Sullivan actually - refreshingly for an academic, especially female - does not have too much of an ago problem. She would joke in class about failing the bar and once expalined her rationale for not studying too hard:
"I was really busy, and I figured...what's the worst that can happen? I fail it and I take it again...its not like its going to be on the front page of the Wall Street Journal or anything!"
