Morning Docket 05.06.09
* President of San Francisco’s Federal Reserve says the economy is getting better. “For the first time in a while, there is some good news to savor.” If by good news, you mean that laid-off lawyers have taken to wearing track suits around the house “savoring” comfort food instead of 6-figure salaries, then yes, there is reason for optimism. [Bloomberg.com]
* Meanwhile, Chrysler’s bankruptcy judge Arthur Gonzalez paved the way for a fire sale of most of the company’s assets. [Reuters]
* A Miami juror, who was on the jury deliberating the case of 6 men accused of conspiring to destroy the Sears Tower in Chicago, was replaced for refusing to deliberate. Got to hand it to her for getting out of jury duty. [The New York Times]
* Souter says goodbye, telling the U.S. Court of Appeals that a jurist’s satisfaction is “not in the great moments, but in being part of the great stream.” [The Washington Post]
* Should there be more women in the “great stream” Souter described. Justice Ginsburg says the Court would benefit from another woman. [USA Today]
* Senator Chuck Schumer went to bat for Loretta Lynch, former U.S. attorney for the Eastern District of New York, who held the job under Clinton and who has just been re-appointed by Obama. [The New York Times]

I really hoped they had fired you, but I guess not. The woman on the jury didn't "get out of jury duty" dumbass. First you have the trial, then the jury deliberates. She sat through the ENTIRE trial before getting tossed. At least there weren't any typos in that particular blurb, although I find it hard to believe that you can be in j-school and still not know how to write in the active voice.
I'm seeing this third year law student. He has an offer from a big New York law firm. I'm worried that they might take back his offer. He says that they can't do it because it's illegal. He says there's a law called something like "Promise or Stop All." I don't know if he is telling me the truth. Before I move to New York to be with him, is he right about this?
Track suits? Way too much to wash. It's t-shirts and boxers for me. Comfort food is right on the money, though. I'm turning into Kraft Mac & Cheese.
Is anyone having luck with job searches?
The thinking is that it "has" to be a woman, but that was the thinking during the HarieTTT Myers affair too. I almost think Bush did that on purpose, as Alito might have had more trouble getting confirmed if Miers hadn't preceded him.
But then again, I'm one of those people who thinks New Coke was a trick to get people to appreciate regular Coke more.
Wurtzel is not on the passing list of the February 2009 bar exam. Again.
i'm glad the economy could go to hell just in time to ruin my career.

3 - Yes. Read "Statement of the Law," Chapter 90.
Hey, did we ever establish whether Eliza is actually just Elie?
4 - I'm wearing what I used to wear to the firm's gym, but I now wear to sit on the couch and make the cookies that my also-laid-off wife keeps making.
And no luck with job search (4th yr, NYC).
#3,
There are few absolutes in law, but the vast majority of ATL commentors support a broad interpretation of the Promise-Her-Stop-Elie doctrine. Never pass up an opportunity to share your life with a lawyer.
"Should there be more women in the "great stream" Souter described."
Question or statement, Eli(e)za?
Good to know that souter gave that speech to the monolithic entity known as the "US Court of Appeals."
13, was just about to say the same thing.
Elie, seriously, if the typos/awful grammar are intentional--as a way to ignite comment wars, increase site traffic, etc.--I get it, fine. But frankly, I don't think these errors are intentional, and in fact they have become so commonplace that you have become a caricature. Maybe the bar was too high because of how great a writer Lat is, but seriously, to paraphrase and update the old carpenter's adage--proofread twice, post once.
A poem I wrote for all laid off Lathamites. Don't get down. The world is your oyster and you'll come out of this for the better.

Standing Tall
By LL
Sometimes the world looks perfect: Nothing to rearrange.
Sometimes you get a feeling like you need some kind of change.
No matter what the odds are this time, nothing’s going to stand in my way.
This flame in my heart, and a long lost friend.
Gives every dark street a light at the end.
Standing tall, on the wings of my dream.
Rise and fall, on the wings of my dream.
The rain and thunder. The wind and haze.
I’m bound for better days. It’s my life and my dream,
Nothing’s going to stop me now.

Latham Truth #5:
Few weeks after being laid off, Latham sent us an email consisting of its professional and pro bono accomplishments for the 2008 year, basicaly bragging how great the firm is doing.
Share your truth.
3) So if the guy you are seeing loses his job offer, you won't move to New York to be with him? You should love the man, not the man's job- Do yourself a big favor, and job offer or not, cut the relationship off now before you end up divorced, broke and broken
10 (cookie guy) - how wealthy are you now?
roughly, (160 + 180 + 200 + 220) x 2?
Can you shut up, Latham person or people? One sure way to avoid getting others to sympathize with your plight is to blatantly beg for such sympathy. The more you whine, the more I think it probably sucked to work with you.
On a different note, Eliza, you are a horrible writer, both substantively and with regard to grammar and punctuation. Also, you are witless.
13 and 14 - it was CA3.
19, I could give a flying Latham if you sympathize with me or not. You can go Latham yourself for all I care.
BTW - you are a horrible writers as well, in terms of substance, grammar, punctuation and spelling. Lathamface.
18 - way to demonstrate your complete lack of understanding of anything financial in equating wealth with the sum of gross income. please go back to fraudulently registering fake voters and your other "organizing" activities.

19,
You make a good point, that whining does little to relieve stress and engender sympathy. I find it much more useful to take a few minutes most days just to post a little comment to try and let the world know that my firm, Thompson Hine, is a real shit hole of a place to work. Everyone takes a big paycut, announced layoffs, constant stealth layoffs, and the partners are being even bigger pricks than usual. All the pain is being shoved onto the associates and the staff and, as a result, if you aren't a partner you have basically zero chance of getting any secretarial support... they are too busy kissing up to the jerks that will fire them next month.
Don't bother trying to go after pity, just let some people know what a joy it is to work at your firm and all the great things it will do for their careers!

(yes, partners, right now you are paying me to sit in my office and write this about you. Enjoy.)
Thanks, 22. I was going to write a blurb about student loans, NYC rent, weddings (one year there were 14 between the two of us - it seemed like every weekend away from the office, we were going to a wedding), suits, visiting/hosting and entertaining parents and siblings, expectations of having at least a few more years of this income, hobbies, etc., but you captured it perfectly.
Anyway, lots of time now, in case anyone wants to invite me to a wedding.

Unhappy employees and unemployeds: The key is tone. 16, your tone is annoying. 21, your tone is slightly improved. (I am assuming you are 16, although it's certainly possible that there are multiple unemployed Lathamites who spend their unemployed hours bitching about Latham on ATL.) 23, your tone is quite acceptable and I have no objection to your posts.
-19
18, when people are taxed at 40%, they don't take home as much as their actual salary.
So let's raise the taxes of these dual-income married professionals even more because lower income people (and white-guilt liberals with higher incomes) think it's "fair".
Change we can believe in. Yes we can!
Is the talent pool really so shallow that Eliza is the best you could find Elie/Lat?
Kash knows jackshit about the profession, which sometimes comes across in her writing, but at least she can write.
Eliza is a double whammy of no legal expertise and no writing skills. Instead of taking on an intern, why not get rid of Eliza and replace her with one of our many laid off brethren/sistren that she's trying to mock?
25, Let me underscore my point. I do not give a Latham if you don't like my tone, or don't like my substance. Go Latham yourself.
19 must not have objections to Thomas Hines posts because he is a Latham partner. Even after firing these guys, he tries to tell them how to act. What a fucking douche!
24, to be fair, your combined income of about $400k was 8 times the median household income of the US, or about 6 times the median household income of NYC, so I am having trouble generating sympathy for your situation. Take away your student loan payments and you still made 4-5 times median NYC income. Those NYC households making $65k a year also had rent, wedding trips, visiting relatives, and hobbies.

Elie, how can you not cover this?
http://www.youtube.com/watch?v=KpqKNZ3km3c
Tom Lauria, head of W&C's restructuring group, discusses the Chrysler bankruptcy. In particular, he describes how the White House threatened Perella Weinberg and forced other first lien creditors to withdraw their opposition and subordinate their debt to the UAW.
Rule of Law?
Abogration of contractual rights?
I suspect I know why you have been silent about this story...

The constant Latham bitching does get annoying.
But tthe firm is even more disgusting if what #16 says is true.
30 - It's hard to understand what you mean by "fair", as your fearless leader uses the word to justify things that have no other justification (i.e. his characterization of raising taxes on dividends as being the right thing to do, even if overall tax revenues would decrease, because it would be "fair"), but for you and the other brownshirts out there who believe that "fair" means that everyone should have equal outcomes not equal opportunities, you are forgetting to factor in the 3 years and tens (hundreds) of thousands of $s invested in a law degree that your median households haven't invested in. Thanks for the hope, but you can keep the change.
22
Wurtzel did not pass the bar, but I did pound her in the ass at a Holiday Inn Express last night.
34 - it's true. I got the same email.
what happened to nervous T10 1L?
Yes please try to cover the white & case story 32/33 is talking about. Of course, its old news now but maybe you guys could dig up the real goods?
32, 33 and 39,
I doubt they will cover the story due to political bias. But here's hoping
The last time we heard about women being part of the "great stream" was the R Kelly trial.
