UVA Law Is Set to Won’t Welcome Tom Tancredo Staffer Guilty of Hate Crimes

Marcus Epstein.jpgYou’ll recognize the comedic stylings of Tom Tancredo from his brief turn as the Republican presidential candidate capable of protecting us from the rampaging Mexican hordes. Recently, Tancredo has been liberally availing himself of the opportunity to call Judge Sotomayor a racist.

Maybe you can’t blame Tancredo for throwing around the racist moniker. White men get to use the term so rarely that hearing him say it is almost cute — kind of like when a baby learns its first curse word.

But maybe Tancredo should check his own house before throwing around charged terms. One of his chief speechwriters, Marcus Epstein, has pleaded guilty to a hate crime.

According to documents obtained from District of Columbia’s Superior Court, Epstein, 25, must appear before Judge Wendell P. Gardner on July 8 for sentencing after pleading guilty to simple assault charges stemming from an incident during the early evening hours of July 7, 2007. The documents state that Epstein was walking down the street making offensive remarks when he encountered the victim, called her the “N-word” and struck her in her head. He was briefly detained by the woman’s husband, but was able to escape, only to be arrested minutes later by a Secret Service officer who witnessed the attack. According to the officer’s statement, a friend of Epstein’s informed him that he had been drinking.

Nothing says “protecting the future of America” quite like getting drunk and slapping a woman.

While rubbing shoulders with Tom Tancredo and Bay Buchanan, Epstein has made quite a name for himself with his colorful rhetoric. But it appears that Epstein has been a good soldier for Tancredo. And the Congressman isn’t going to abandon him just because he likes to get drunk and hit black people on the head.

Apparently, neither will UVA. More details — plus an update — after the jump.

Epstein currently works with Tancredo’s PAC, and it looks like he will be able to keep that job:

Epstein has plead guilty and will be sentenced on July 8, although he changed his plea to water down an admission of guilt into the belief that “the government could prove me guilty.” A spokesman for Team America PAC confirmed that Epstein is still at work until he leaves for law school in the fall and an official statement is forthcoming.

His law school landing spot is UVA Law.

Above the Law reached out to UVA Law Dean Paul G. Mahoney, but he has not responded to our inquiries.

Update: It appears that Epstein won’t be going to UVA Law after all.

Update (6:39): But Epstein’s Facebook status still lists “UVA grad student ‘12” as one of his networks.

But diversity of opinions is an important goal for most law schools. If nothing else, it is likely that Epstein will have very interesting points to make when his class discusses the constitutionality of hate crimes legislation.

Still, some UVA Law students are unhappy with the antics of their future classmate:

As a current UVA law student, I’m horrified. He was at admitted students weekend in April. I heard that he worked for Bay Buchanan, but did not know about this at the time. He was a WEIRD kid.

I’m assuming that the above tipster is a white UVA Law student. I’d imagine that black UVA students are actually looking forward to the possibility of getting slapped upside the head by a drunk 1L shouting racial epithets.

Wait, from the article it doesn't sound like he pleaded guilty to a hate crime. He pleaded guilty to a charge of simple assault. Maybe he COMMITTED a hate crime, but he only copped to the assault part of it.

I mean, I have a hard time believing a fascist Repub like him would EVER cop to a hate crime. (Note, I'm not saying all Repubs are fascists, just that this one is).

Hate crime laws are unconstitutional--they are thoughtcrime.

Comment 31 makes the point. Beating a UVA chick with a string of pearls is illegal if not consensual. Making the same act more an additional and more severe crime based on the perpetrator's thoughts (i.e. racist ones) should not be permissible.

It sounds like Epstein is an asshole. But beating someone is beating someone, regardless of the reason for it.

74 - I can't believe you're defending overt racism in the South by comparing it to covert racism in other places. Boston, NYC and CA all have problems with race. The difference is that racism in the South is much more public. For example, you can't get Confederate license plates in New York, but you can in Virginia. On the other hand, clubs in Boston ban baggy pants, doo-rags, and athletic jerseys as an underhanded way to keep out black men. Racism is everywhere, you just don't have to look so hard for it in the South.

So right. I grew up in the South (well, Virginia), and while there is definitely racism there, the racism I've seen in New England scares me more. At least in the South you know what you are getting -- if you go hang out in a rural mountain town then some of the rednecks will no doubt be racist. But in the Northeast, the racism is much more insiduous. There is plenty of pomp and blustering about how "openminded" everyone is, but when you start digging deeper you see evidence of a superiority complex amongst the well-to-do whites, both in terms of race ("being white is better than being black") and geocentrism ("Massachussetts is much less racist than the South").

I don't know about you all, but I like my racism where I can see it and confine it. Sneaky racism is much harder to deal with both personally and systemically.

I went to college with this guy at William and Mary. He is both crazy politically and a raging drunk. He was always passing out somewhere or running away from police. He also has a very pronounced speech impediment, which makes understanding what he is saying nearly impossible when combined with his slurred drunk talk.

85 - If racism is always going to be a part of society (and trust me it always has and it always will) then secret racism (the kind you harbor as do everyone else in here) is a better course of action than overt racism. It's pretty much the difference between the KKK and an old person. Both are racist sure, but one will hurt you one is only relevant if you deal with that person.

88-You say racism has always been around and will always be around. FAIL. The racism of the 1860s in the South is much different than the racism of the 1960s in the South. Moreover, the racism of the 1960s in the South is much different than the racism of the 2000s in the South. Racism is slowly dying out. Remember when "miscegenation" was the WORST thing possible? biracial babies were worse than black babies. Nowadays, even if people are racist, they tend to not harbor more hate towards interracial couples/persons. That evil left us, so can racist per se.

I wonder what the context was for this attack. It seems odd that anyone, even a drunk person, would randomly dish out racial epithets and karate chops. Was he in an argument with this woman? Did she say anything to him? What made this a "hate crime" as opposed to a brawl in which one of the combatants used the most offensive insult he could think of in the heat of the moment? Maybe this kid really is seriously racist. Then again, maybe he just mad a racist comment in the heat of a tense situation. The point is we don't know and the above post contains nothing but conclusory statements. Since most ATL readers are legally trained it should be obvious to everyone that we don't know enough to intelligently judge this guy.

Nobody's trying to defend the guy. What's happening is that elitist pricks jump at any chance to rip on the South, or for that matter the Midwest or any other "flyover" area. But especially the South. So this guy does something bad and everyone's all like "oh, there's the South again". Nobody doubts that racism is more rampant in the South than elsewhere. If this is all they have against the so-called voter intimidation by a bunch of lunatics (who aren't trying to get into law school) then it's obvious why the charges were dropped.

Re comments about racism in the North v. racisim in the South: there's no contest. Southern racist is more overt and, importantly, it has been historically far more violent. It is simply not the same to harbor beliefs like "to be white is better than to be black" or ride around in sheets lynching people. It's idiotic to say otherwise. No one is saying Boston , NYC, LA, etc. don't have their racists, but they are not the same as in the South.
I'm a white female, and I've never been more concious of "white privilege"( i.e. happy to be white because of what it meant for my personal safety ) than when walking through a truck stop in Alabama on a road trip to Disney World when I was about 13. The confederate flags and general atmosphere were just scary -- and I grew up in Texas. I've never had that same feeling in small town Iowa, IIllinios, etc.

And Epstein is a punk. I've never used the "N' word in my life. And he hit a woman. What a low class, trashy punk.

Make no mistake about it, Mr. Epstein: there's a line, you crossed it, and you should not think that you would be allowed to disgrace this institution, which has been attended by unbroken generations of some of our families, by graduating from the University. Matriculate elsewhere.

(2) The above notwithstanding, I hope he sues your fat ass for libel, Mystal. Assuming the publicly available details on his plea are correct, Mr. Epstein clearly did not plead guilty to a hate crime, an act with a specific legal definition that carries with it a distinct and reputationally significant meaning.

If you look at document 63 you will see that he was charged with an enhancement on the simple assault charge. I used to work as an investigator for criminal defense attorneys in DC and I can tell you that the AUSAs will do this whenever the "n" word is used during a fight between cross races and it greatly enhances the possible sentence, so it is a serious deal.

If you look at the documents you'll see that the AUSAs submitted a plea offer that stated something like "plead guilty to simple assault and we'll drop the more serious charges." It seems that he pleaded guilty to just simple assault without the hate crime enhancement, but you guys take a look at it and see if you think that's what happened.
