Local Prosecutor Decides Pictures (of Alleged Rape) Are Worth A Thousand Words

Pop quiz: You are a local prosecutor, and you’ve obtained pictures of an alleged rape. The pictures show the alleged violation taking place — the victim and the alleged assailant — as well as other teenagers drinking and partying. You should:

(a) Use the pictures as evidence when you prosecute the rapist.

(b) Put the pictures in a file and never look at them again (if you determine that the pictures show consensual sex).

(c) Do not charge the alleged rapist, but show the pictures to parents in your community.

If the story as retold by Kash is accurate, then that prosecutor should lose his license and potentially be brought up on charges of distributing child pornography.

What's more morally questionable: Showing a photo with censored identities that depict underage children having sex, in an attempt to alert parents in that community to what their children are up to, or posting a story on a widely read blog about a hostage situation involving a law student whose dad is the hostage taker, and whose mom is the hostage, allowing the student's identity to be easily discovered by all readers, and then entitling the story, "Best Excuse for an Extension, Ever"?

Serious ethical question.

Wow, potentially a cool $75 million though! In A Civil Action, they said something to the effect of the size of the payoff represents how sorry the defendant is for his / her conduct. She wants this country attorney to be VERY sorry for what he did.

"Felman’s family filed an ethics complaint, leading the Kansas Supreme Court to reprimand Campbell and suspend him from practicing law for six months."

It's a different world once you get west of Minnesota and Iowa. With the exception of Missouri, the rest of the Midwest is not as crazy as folks out in states like Nebraska and Kansas.

the fact that they were obtained during an investigation is the problem.

the teens who took the pictures have a constitutional right to do whatever they want with the pictures if taken in a public place.

If I recall, I think law enforcement and some mental health professionals have some privileges when it comes to possessing and handling child pornography, but I don't know if that includes using it for public educational purposes.

She's demanding $75 million, which is a tad rich. Given that her face was obscured, and the photos were in a public place and the sex was supposedly consented to, I don't really see the harm. At least not the $75M harm.

If everything was obscured, then how why would this mentally impaired prosecutor think it has any more educational value than some generic photo that he could accurately describe as depicting situations that could happen at similar parties?

First of all, someone commented on underage sex, there was no mention of underage sex in the post just of teenagers partying, secondly if a prosecuter deemed that the tape showed consensual sex then it would have to be filed and not used...so b would be the correct answer.

my apologies to all commentor (45) here again, I adn't read the true slant. What is the legal age of consent in Kansas, i'm from the UK and it is 16 here.

I stick with answer (b) though, but I am probably gonna stir up a hornets nest of feminine power now but what was a 17 year old girl doing being out and getting drunk with a group of boys anyway?

Someone commented earlier on how the prosecuter could tell or not whether it was consensual. I think I would be able to tell...there would be quite a lot of creaming and shouting for a start!

I may get the drug induced rape thrown back at me now but can't that be traced by testing or did this girl leave it too long before reporting the incident?
