Latham's Lessons in History:

Latham became rich and successful after representing Drexel Burnam in the 80s and the king of junk bonds Michael Millken. Latham is still basically known for its junk bonds. When Michael Millken was arrested and put in jail, Latham collapsed and they fired 1/3rd of their associates. First, they conducted stealth layoffs followed by public layoffs a month later. However, through no achievement of Latham, the fired employees from Drexel went to work for new york power houses like Lehman, Bear and Goldman and also bunch of private equity firms. So, incompetent management of Latham (which included Bob Dell at the time) that put all their eggs in the Drexel's basket ended up quadruapling their client base through a failure of their client - like a retard falling into a bag of money.

Latham continued to expand their junk bond practice and their only real clients in NY were former Drexel employees - employees of a firm whose boss was put in jail for fraud. But again, their clients fell apart and are investigated by the SEC. So latham, having not diversified a bit in 25 years had to conduct layoffs.

They did exactly the same thing this time around. First, they stealthly laid off people and when publicly laid off people. The totals in US are estimated at 325, so that comes out to around 1/4 of associates, with 40% cut in NY. Still, latham does not have enough work from their financial clients and continue to think of ways to fire more people.

This is not a made up story, but a story told to us by Bob Dell and Dave Gordon.

Unless financial industry comes back to robust activity (because latham usually get leftovers of top NY shops and needs a lot of activity to get work), Latham will fall apart as they have no other real practices outside of CA. Their international office and NY office are interconnected, thus as goes NY office will go international office - to shit.

Even if things change in 2-3 years, you should not consider working for Latham as you would be tying yourself to a non-diversified firm that will fire you if economy goes bad.

You will find it in both papers. All they say is this, verbatim:

A child born to an American citizen while overseas is, by law, an American citizen by birth, and entitled to all the benefits of citizenship, except being able to run for president.

So, you are suggesting that Obama's mother thought the possibility of her half-black son running for president was likely enough that she called a friend back in Hawaii (before the days of cell phones or sattelite communications, mind you) and asked him/her to arrange for a birth announcement to appear in two newspapers in Honolulu????

Obama has proven his birth to the satisfaction of his 2008 opponent, the House of Representatives (see Monday's unanimous vote) and the American people. The burden is now on the Birthers to produce some sort of evidence supporting their position, because without it, every complaint they file is going to be dismissed outright. Obama has shown enough of his evidence to carry the argument, and it is obviously pretty persuasive, or he wouldn't be in office.

John McCain was born in the Panama Canal Zone. Mitt Romney's father, who also ran for president, was born in Mexico (he was there because his parents were mormon polygamist). Barry Goldwater was born in the Arizona Territory. Lowell Weicker was born in Paris (France, not Texas). All repubs, all ran for prez.

The effective rule appears to be either born in something more or less deemed to be the US, or have to US citizen parents, and maybe even only one US citizen parent. Undeniably, the Messiah has a us citizen mom.

The constitution doesn't define natural born, so I suspect once the Messiah is no longer prez, congress will clarify the issue along those lines.

33 - 301 doesn't purport to define "natural born" as used in the constitution. So find a statute that does.

Oh, and another thing. The first nine presidents of the US were not born in the US, since the US didn't exist when they were born: Washington-Harrison. They were all born in places which became the US, but before 1776 (and 1783, and 1790). Actually, you could add Tyler to the list, since he was born in 1790, but before the constitution was ratified by Rhode Island.

So natural born is a tad more complex than it might initially appear.

Lincoln was born in the Illinois Territory (It didn't become a state until nine years after his birth).

Chester A. Arthur's dad wasn't a citizen. He was a British subject.

Arthur's opponents said that Arthur himself was born in Canada, but they never found any evidence to support it.

So, as for those birthers who claim that because his father wasn't a citizen, he isn't a "natural born" citizen, we have precedent that clearly says you are wrong.

ANOTHER VERY, VERY interesting point. In fact, this point illustrates the difference between a "citizen" and a "natural born citizen." The Founders knew that they would be disqualified from running for the presidency as a result of not being "natural born" so they added language to the clause to allow them to run. Specifically, they limited the presidency to a "natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution."

Read the text: "No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States."

SO, since Obama wasn't around when the constitution was adopted, this means he has to be "naturally born." And since the founders did not consider themselves naturally born, this means a person who is born overseas, but who later acquires U.S. citizenship is prohibited from being president.

Now, our INA allows citizenship to be granted to children born overseas under certain circumstances, but in no case could Obama be eligible for the presidency if he was born overseas.

This certainly is "a tad more complex than it might initially appear" which is why it's SO ODD that some people are dismissing this without even thinking about it. As lawyers, we're supposed to be critical thinkers. Unfortunately, Obama-bots just aren't too deep of thinkers, it seems.
