First.
And Elie is a moron.
Is it supposed to be irony that Elie made a joke about an advanced course in HTML, and then didn't properly link the story? Or is this just one more in a library full of Elie fuck-ups?
Waiting for Lat to write a post about whether those two plastic men in the photo are hot or not.
2: i'd suggest Elie was being cleverly ironic, but let's be honest...
No attorney cuts at Van Winkle!
It wasn't on purpose, but come on, that was pretty funny.
--Elie
I'd like Elie to STFU. Why shouldn't they defend federal law against a state? Have you not heard of the Supremacy Clause, you fat fuck? Go eat another cheeseburger.
who cares if a cop uses the word "pee"? I'd rather they be out doing their jobs then sitting in a classroom learning a list of euphemisms.
Great to know that major budget crisis and all, the MA Attorney General has nothing better to do than to file wasteful litigation against the federal government that should (sans batshit crazy liberal interpretations of the constitution where anything and everything is a right or entitlement) be slapped down under the Supremacy Clause.
How can you claim equal rights when you're not equal?
It is time that polygamy also be equal.
1 man, 4 wives should be equally protected

Elie, it was funny. But not as funny as a post about a law student whose parent is being held hostage while their house is being burned down. For pure ATL posting humor, that takes the cake. Just ripe for jokes about faking the deaths of grandparents...Ahahahaha!

I don't know if you're kidding, 11, but seriously, polygamy should be equal. Supposedly this country was founded on "Christian" values, but many Old Testament christian hero's had multiple spouses. The New Testament doesn't say anything else about it other then that you can't be polygamous if you want to be a pastor of a church. IMO its a stupid thing to do... but not criminal. And not even immoral!
WTF is with this country's fascination on controlling people's personal lives? I can't grow herb in my own yard and smoke it in my own living room without getting tossed in jail. Herb. It grows fucking wild. Is God a criminal too? Damn. And I can't have two wives. George f'ing Washington grew cannabis for Christ's sake, and Father Abraham himself had two wives.
When I get married, I'm not buying a fucking marriage "license". Fuck their bribery. If it weren't for government marriage licenses and the tax and estate benefits they create, there'd be none of this debate over gay marriage and we'd all get along a lot more easily. But then what would the professional wrestlers (I mean the politicians) argue about?
I'm moving to San Francisco. Is MOFO hiring?

17, i was not kidding. if the institution of marriage can be dismantled by based on sex, then the only equal and principled conclusion is that numbers should not matter in a marriage.
men having multiple wives is analogous to homosexuality on the basis of sexuality; where some males are attracted to males; other males are attracted to multiple females (it is a part of their biology)
it is time that "law" fit to our natural instincts
17/19,
The government has a compelling interest in preserving two-person marriages that it doesn't have in preserving traditional marriage: The myriad marital benefits that government gives. Imagine one man with 10 wives, and the tax benefits, social security and Medicare benefits, immigration benefits, property benefits, etc. Imagine the inheritance battles that would result from an intestate polygamous husband.
Whereas, there is no difference between same-sex marriage and traditional marriage except gender roles.
Apples and oranges.
15 = that guy who died in Washington after being sodomized by his horse from a pierced rectum.
Here are the problems with polygamy:
1, religious groups' propensity for exploitation of women for marriages. Female slavery.
2, religious group's mistreatment of young men, e.g., expulsion so the old men can marry the young. This happens ALL the time in the Southwest.
3, Ignoring #1-2 (real and practical problems), polygamy has theoretical difficulties. For example,
there is no logical cutoff point to how many one could marry. Deconstructing the traditional monogamous relations in favor of a"marry whomever you love" principle, there's no reason why 300 million people could not "love each other" and the entire populace be married to one another.
Perhaps this may be acceptable to some/not viewed as a problem, but I suggest it makes the reasons behind having laws about marriage superfluous.
20,
First,, a big reason for having marriage laws is to have/incentivize breeding partners to stick together. Gay couples don't have that issue QUA couples. Not apples and oranges.
Second, denying people the right to marry based on numbers to prevent bureaucratic messes is a terrible argument IF marriage is a fundamental right.
20 - maybe the government should remove all of those benefits.
with respect to your tax argument
based on haig-simmons principles, individuals should be taxed based on accession to wealth, not on their relationships. in other words, husband-wife; husband-husband; wife-wife; husband-wife-wife-wife-wife relationships should not get any tax breaks just because they are in a special relationship. most g-8 countries, like canada, adopt this principle where an individual is taxed on their own income, not based on a joint tax filing.
With respect to immigration benefits:
What immigration benefits would there be if American citizens engaged in polygamy? Are you saying that American immigration policy should break up family units of people immigrating from saudi arabia or pakistan because those countries allow polygamy?
With respect to social security and Medicare benefits property:
Please elaborate
With respect to inheritance battles:
That is a pretty weak argument. laws change over time. just as before homosexuals could not enjoy other divisions, the law accomodates. in fact, the UK has set up shariah courts for muslims to use for family law and inheritance disputes.
The US could just as easily create more laws to handle these matters. On a side note - this could be a boon for unemployed lawyers.
Finally, why do you get to define what a traditional marriage is - over 1.3 billion Muslims, as well as Mormons, and other religious groups define marriage as 1 man and multiple wives.
In a pluralistic society, polygamy should be the next set of laws allowed once homosexual marriage is

Lat is gay.
Its true.
Gay.
20,
The whole point of my rant was that this "compelling interest in preserving two-person marriages" you note, "the myriad marital benefits that government gives", should be done away with. There is no good reason to spend my hard-earned tax dollars to give benefits to people for marrying. Why is the government in the business of bribing people to marry one member of the opposite sex? WTF? A "marriage license"? Are you fucking kidding me? But we all accept this as if it is normal.
And where else are they shoving their big nose? No wonder my taxes are so damn high. I'll tell you where they're shoving it... into my back yard cannabis patch. That's where. Flying over my house with their friggin' helicopters loaded with Guard troops looking for my personal stash.
Fuck this. I'm moving West, b/c if I stay on the East coast much longer I'm gonna end up going out guns 'a blazing. Closed-casket. It's virtually guaranteed at this point. Give me liberty or give me MOFO.

1. Russia has had more nuclear weapons than the United States for the better part of the past half century. They currently have nearly twice as many nuclear weapons as the United States. Why does this matter if both nations have enough nuclear weapons to destroy all of humanity? What is the strategic benefit in being able to say "I have more than you"? Mutually assured destruction is still intact.
2. It is called a sole-executive agreement. Good luck overturning the well established Supreme Court precedent upholding sole-executive agreements.
3. I'm not sure what you are talking about with the G8 thing, but I'm not aware of any agreement coming out of the G8 allowing international regulation of American business. The countries at the G8 did agree to the aspirational goal of limiting climate change to no more than a 2-degree Celsius increase. However, there is nothing binding and there is no agreement on how to achieve this goal. Furthermore, for all of Obama's talk of common regulatory schemes and increased regulation, he has been very resistant to international regulation of U.S. financial markets and businesses.
In short, these things are not being reported because there is nothing to report. Feel free to remove your tin-foil cap.
Again, you sausage swallower defenders... I paraphrase the late, great Sam Kinison: How can a man fall in love with another man's hairy ass? How is that possible? The only way it's possible is if one has a mental defect. Thus, having a mental defect = being gay. Mental defects are treated as disabilities and can be treated. Shock therapy for all homos. QED muthafuckas
How is the DOJ supposed to "STFU"? Thanks to this lawsuit, DOJ will now be forced to defend DOMA directly once again.

Hey, my buddy in career services just said that Orrick's not interviewing on campus this year. True or false?
True or false: Republicans/conservatives are the stupidest people on the planet.
false. 40 is the stupidest person on the planet.

If my calculations are correct, and I think they are, I believe Lat is a homosexual gay.
this blog sucks. its a cut and paste job, like print media. yawn. watch - you'll censor this comment. losers. couldn't practice law.
I second #1. Elie is a moron. I wonder how he passed law school. And this is stupid:
"Should cops be bawdy when testifying in court? Probably not. But how many euphemisms do you think your local patrolman knows for "public urination"?"
Hey dummy, what are the elements of this crime? You think actual urine is an element? Think about it. If you don't see the problem with the above argument, then you may have to go back to law school.
"The Mass. A.G. is challenging the constitutionality of the Defense of Marriage Act. Memo to Obama/Holder: If you don't have anything nice to say, this would be a good opportunity to STFU."
And you think you have reason to believe Obama supports your position on gays . . . why?
