Everyone’s Favorite Cravath Alum Feeling Overtaxed by Sex Offenders Program

James Colliton Jim Colliton Cravath Swaine Moore Above the Law blog.jpgJames Colliton — the ex-Cravath tax lawyer who, in the words of the AP, “paid a woman so he could have sex with her two underage daughters” — has served his time, and is now living in a motel “on Route 9.” Apparently, he’s getting too many visits from town police officers who stop by frequently as part of a county program to monitor sex offenders.

Colliton plans to file a $100 million federal suit against the town of Poughkeepsie and Dutchess County. From the Poughkeepsie Journal (via Tax Prof Blog):

Colliton claims the program violates state law and deprives him of his constitutional right to privacy and his Fourth Amendment right against unlawful searches.

Describing police visits as the “intentional infliction of emotional distress,” Colliton recently served town and county officials with a notice of claim — often a precursor to filing suit.

In his eight-page claim filed last month, Colliton indicates he intends to seek $3 million in compensatory damages and $97 million in punitive damages in federal court.

Although he practiced as a tax lawyer, Colliton clearly likes litigation. He previously sued American Express for giving police the credit card information that led to his arrest, and he sued Cravath for stiffing him on his bonus.

I, for one, don't consider a less-than-two-year sentence for paying to rape young girls serving one's time, so I don't care if the police are living with this dude.

First case I ever argued in court on my own was against a pro se. A guy who sues if you look at him sideways. Once he sued a legal services clinic for a letter to the court which they wrote ON HIS BEHALF. (He said it slandered him.) In my case, he tried to lecture the judge about discovery rules, saying that he had no obligation to sit for a deposition. The judge just looked over at me, in astonishment.

I still have the three page decision the judge wrote, slamming him.

No real relevance to the story, except that beating a chronic pro se feels good...

This guy really blew it. I actually have struggled the last 15 years since getting out of law school even though I graduated from a decent law school and did very well on two different bar exams. How stupid could somebody like this be -- even if you don't initially get caught with a crime like this who is to say that the kids might grow up and remember and destroy your life. This guy has no chance in prevailing on any of his cases -- but he has nothing better to do now that his life is over. I do think that all of the restrictions for sex offenders are counter productive (with such restrictions, why not just keep them incarcerated). That is, for the rest of your life you have to publicly state that you are a sex offender in some cases informing those who live near you. You have no hope if you are subject to that. You may as well try to leave the country and go some place where you can get a fresh start.
