Weil Gotshal Defers Current Summer Associates to 2011 or 2012
Big news from Weil Gotshal today. The firm previously deferred its incoming associates to January 2010, with the option of deferring until January 2011 (with a $75,000 stipend).
In recognition of the fact that it will have some of the class of 2009 starting in January 2011, the firm is offering current summers — i.e., the class of 2010 — the option of deferring until January 2012. Above the Law received the following statement from Weil Gotshal:
Earlier today, we informed our 2009 summer associates of the following:* We are offering each summer associate who receives an offer of permanent employment at the conclusion of this year’s Summer Program the option of deferring his or her start date from January 2011 to January 2012.
* Each incoming associate electing to defer will receive a $75,000 stipend and health care benefits. In order to receive this stipend, the deferring associate must spend 1,000 hours during the deferral year performing some form of Firm-approved public service work in the US or abroad, including interning for a judge, or working for a Firm client.
* An incoming associate may decide to travel or take a paid position during the deferral year. The Firm will only pay the stipend to those people doing public service work. However, the Firm will provide health care benefits to all deferring associates.
* As we did with the successful deferral program for the class of 2009 associates, we will assist those who elect to defer with identifying public service placements, clerkships, and client opportunities.
The earliest current summers can start at Weil is January 2011 (and that is of course dependent on whether they receive an offer from the firm). But the option to defer until 2012 is even more evidence that the class of 2010 could be worse off than the class of 2009.

Back in the spring, when Weil Gotshal deferred some of its incoming class of first years to 2011, the firm promised incoming associates that there would be a job waiting for them in 2011 if they took the deferral. At the time, firm chairman Stephen J. Dannhauser told incoming first years:
A number of you have asked whether you will have a position as an associate at the firm in January 2011 if you defer your start date. I would personally like to assure you that if you defer your start date, you will have a position with Weil Gotshal in January 2011.
We understand that the promise still stands. But perhaps keeping that promise forced the firm to try to push back some current summers all the way to 2012. According to the statement provided by Weil:
Please be assured that the Firm is performing well and our balanced platform has helped us remain strong, even in this challenging economy. However, we are still experiencing the exceptionally low rate of associate attrition, accompanied by large classes of junior associates, that prompted us to implement the deferral program for the class of 2009. Accordingly, given the anticipated needs of the Firm for January 2011, the Firm is now offering the voluntary deferral program to the current summer class to counterbalance the overall lack of associate attrition.

I think this is where small law may actually have it right. Hire summers only if you need them, and hire them in the late winter/spring not in the summer when you don't necessarily know what your needs are for the summer, let alone the following year. Hiring two years out (which is effectively what 2L SA is) is terrible business sense unless everything you do is long & drawn out and can be projected two years out

I think this is a great way to show the committment to the deferred class of '09 and a way for the firm to assure summers that they intend to make as many offers as they can at the end of the summer. While practicing attorneys probably don't agree with this, I think law students are really going to like this and it may help Weil recruiting.

61 - "taxed as a bonus" is a concept that does not exist in U.S. tax law. Bonus income is ordinary income like salary.

Your stipend was withheld at 40%, not taxed. You'll get it back when you file your taxes next year.

People people - as a laid-off Weil associate, I can tell you that Weil has ALREADY laid people off. (About 35 from NY Corp in January.) They pretended it was performance based, but with only the flimsiest of excuses. For me, they "just didnt see it working out."

Sure BFR (restrucutring) picks up some of the slack, but the firms biggest clients were GE, Lehman (the I-Bank, not the estate) and Citibank.

I kid, but I hope you'll have more sense than to post such identifying information about yourself next time. Weil Boston has a really small summer class, and there aren't exactly many Syracuse grads in Boston BigLaw, so that should have been a good indication that it wasn't wise to post that combination together if you wanted to maintain anoymity. It's one thing to be Columbia at Cravath, or HLS at Ropes Boston, but Syracuse at Weil Boston sticks out like a sore thumb.
Looks like the class of 2009 has a decent shot of starting in January 2010. My previous posts make it clear that I am as bearish as they come, but, at this stage, it seems clear that the firms are making a sincere effort to honor their commitments to the class of 2009.
Granted, the firms could still revoke some of our offers, but I personally think they are past the point of no return at this late stage. Of course, those of us who fail the bar will be quietly let go.

Just did some checking on the black hole known as Morgan Lewis. they tell us that we have 1400 attorneys. Count the number of attorneys who have their names listed, even the senior counsel. There are less than 1000.

Weil DC is the worst. Underachieving students from T10 schools are consistently chosen as summer associates.
Jesus Christ I'm going to lose my s--t if people that supposedly are so smart can't figure out why bonus payments are withheld at a higher rate than regular salary payments.
Its because most firms use automated tax withholding systems that don't distinguish between regular salary payments and one-time bonus payments. If you're paid twice a month at a $160,000 salary rate, your bi-monthly withholding amount will assume a $160,000 salary in connection with the amount of exemptions you claim.
If you get a $40,000 bonus one pay-period, the withholding system won't take into account what other salary you get throughout the year, it takes into account that $40,000 only, which results in huge withholdings.
There are ways around it, by claiming extra exemptions, etc. but the reality is earned income from salary and earned income from bonus are TAXED the same, as ordinary income.
This would never happen at Paul Hastings. We are too busy advising corporate American how to legally layoff thousands of employees without risk of litigation.
Every person I have ever dealt with at Weil is a total douchebag.

Hopefully the Weil summers are savvy enough to realize this is a fantastic opportunity.
