Career Alternatives for Attorneys: Band Manager

The American Lawyer has an interesting piece on a laid-off first-year associate, Brandon Dorsky. He was among the batch of Pillsbury Winthrop associates whose departures were inadvertently leaked by a garrulous partner on the train from D.C. to New York.

Dorsky was doing IP work in Pillsbury’s Los Angeles office. The Ohio native had moved to California with the intent to get into the entertainment industry and so he seized the opportunity provided by being laid off:

After leaving Pillsbury, Dorsky decided to build a practice geared to entertainment clients, while also managing musical acts. He e-mailed friends and business contacts looking for leads. Just three days after leaving the firm, he landed his first client, TRG Sports and Entertainment. A friend from the University of Michigan recommended him to the management company, which was looking for a lawyer to draft a recording contract….

“I’m out most nights,” Dorsky says. “I see five concerts a week. I’m out there looking for new clients and looking for opportunities for existing clients.”

When does it become o.k. for a lawyer to draft a contract? After 2 years? A lot of contract drafting is just looking at old contracts. How many years does an attorney need to look at old contracts before he can write one?

I have some gratuitous career tips for Mr. Dorksy. Right now, Mr. Dorksy comes off as an amateur dork. He won't attract legitmate clients until he raises enough capital to "appear" like an entertainment lawyer/manager. I hope that is not a picture of Mr. Dorksy. If it is, he comes off as an androgynous fag hag that has no fashion sense. What company would want to hire such a walking social and fashion faux pas. Mr. Dorksy, you can learn something from the protagonist in the modern day urban rags to riches story that was brought to life in the big screen in "Hustle and Flow." There is shortage of entertainers in the Hunts Point section in New York. Perhaps you can utilize the females in your family to fulfill the demand at Hunts Point and in the process have them raise enough capital for you so that you can buy yourself some decent clothes, frames and a half day treatment at the barber to get rid of that hideous haircut and facial hair. Learn how to hustle Mr. Dorksy. That is my advice. You are welcome.

Unfortunately most of us can't quit our jobs and be wannabe entertainment lawyers because we don't have rich families to support us (like Mr. Dorsky) while we aren't making any real money.

I recently spent a long weekend in LA visiting a friend. We went out with some friends of his who were "screenwriters", "agents" and "working in entertainment."

When I commented on their nice partments and brand new BMWs, it was only then that my friend told me that they were basically rich white guys living on trust funds. They always bullshitted at parties and dinners about their latest project or their script being "picked up by a network" but never seemed to do any work.

LA is full of these trust fund bullshitters.

Most of these "I jacked in my coporate Biglaw gig to follow my dream" stories are by people who have susbtantial parental financial backing.

Now that it has been confirmed that this photo is in fact of Mr. Dorksy, I have an additional tip for him. Mr. Dorksy, riffing on video game guitar (e.g., Guitar Hero genre) and having your picture taken while doing so neither qualifies you as an artist nor an entertainment attorney. It does, however, qualify you to you be the most pretentious cretin on this planet.

The music industry is certainly in flux and, it seems to me, a perfectly good time to be in the mix. Are any of the other commenters doing anything better?

Normally a valid point but here there is no "risk" because the family is backing him financially.

To me it is sad that we glorify people like Mr. Dorsky while ignoring law grads who turned down BigLaw offers, work for beans in non-profits, while truly not being able to afford it. That's daring to dream to me, as opposed to attention whoring, spending Mommy's money on new fedoras and hanging out with shitty bands.

Wow 38 - I didn't realize that the only "dream" you are allowed to have is the dream of working for a non-profit.

If this guy makes it more power to him, if not what has he really lost besides some time. He worked in biglaw for a bit and probably saved some money and got 3 months severence. I don't know about you guys but I'm pretty sure a single guy in his 20's can make that last a while.

Hate to say it, but this guy really doesn't have a clue about landing PAYING entertainment clients. Then again, his (unsigned) clients don't really have a clue about hiring an attorney. While it's all well and good that your attorney comes to your gig to see you play, that's not why you hired him. You hired him to represent your interests with record labels and other companies who have the MONEY you hope to earn. If your lawyer doesn't have the spit-and-polish necessary to deal with those types of folks as an equal, then you need to hire a different lawyer. Then again, if you're not paying him very much, you probably don't care very much about your career.

saw an alum at a club on Sunset--entertainment lawyer and/or manager. Moi just a bon vivant with a conspicuous consumption of leisure time and partying.


He had his own place in Malibu
during those halcyon days--so doubt he was in it, or needed-the money.

if youd like to know why managers procuring entertainment employment in CA (aside from a record contract) is illegal, check out this link for a decent synopsis:

or if you just want the statute its Cal. Lab. Code section 1700 through 1700.46

there is a more recent case (the name of which i cant remember) which has said the portions of the contract in violation are now severable, and it doesnt make the entire Contract invalid, but still... not a good idea, especially when you have it now written in an article, and the SOL only runs once they sue you (thanks park v. deftones).

My brother has a loft across the street from that club--funny that I am an SC alum as well. Its on 8th and broadway--very cool scene.

I always get in free without knowing the password--yes the door guy is intimidating to the uncool.

Query: isn't private practice with de minimus legal experience negligence per se?

I guess you just go to the downtown law libray and use the form books but certainly a trap for the unwary.

Yet if he does get that far--he will find no shortage of experienced erstwhile big law k attorneys to do the review.

That is my point exactly... he won't lose anything except time. There is no risk when there are no serious consequences of failing. I would rather see stories about and praise people who have taken risks -- usually financial risks -- by, FOR EXAMPLE, working for peanuts for a cause they care about, for the sole reason that they care about it, and not because it is a hobby they can pursue while not having to worry about rent.

its theoretically possible for you to be a manager and a licensed agent, you just never see it.

you generally see the conflict come in between managers and agents, because mangers can take whatever % they want, whereas agents are limited generally to 10%. lawyers generally take about 5% so you see the conflict less often, just becuase of money. managers acting as agents is usually the big issue, becuase theres alot of room to take advantage of the artist if youre acting as a manager and an agent.

but the bottom line, and what youre getting at is sure, you can be a lawyer, manage some bands, lawyer some bands, and be a licensed agent for others. I think there are ethical rules in CA that have bearing on when you can be someones lawyer and represent them as a different entity in other areas as well, but i cant think of those off the top of my head

really though, ive never seen it. being a licensed agent is expensive (which is why you try and work for a big agency), and youre limited to 10%. being a manager, taking your 20-30% and getting gigs on the side is much easier, albeit illegal.


the bottom line is that it happens all the time, every manager ever in the history of managing has gotten his artists shows at some point. its the nature of the beast. He's not bad for doing it. The agencies just have a ridiculous lobby and want to make sure they have a corner on the market of employment procurement, otherwise, why in gods name would you sign with one?

if he's a licensed agent, more power too him, but i doubt it, and i still wouldnt be happy about that little bit of info in there.

Dear haters,

I happen to know Mr. Dorsky and know that he has already been paid by his clients and is well on his way to making it. I also know that he doesn't "book" the acts for his bands - his artists do it - he just advises them on it.

Brandon loves music and he seems genuinely excited to be doing what he is doing. He isn't making 6 figures a year and he isn't being supported by a trust fund - but he is happy and he is enjoying himself.

In the end, I'm pretty sure that is all that matters.

I can't believe the absolute hating you guys are doing on this guy. He's obviously a smart, charismatic guy who was dealt a bad hand and is now using that as an opportunity to do something he loves. He's probably working on his own schedule, maybe not making a ton of money (yet), but loving life. How do you biglaw types feel about that when you're at the office again past 10 pm?

Friends? Maybe he's actually a charismatic and smart guy who is trying to make the best of himself.

I actually do reporting for a living and I contacted the guy and he wrote me back within 24 hours. He answered all my questions and even sent me a picture. I was surprised by his candidness and honesty. A publication I work for is picking up his story. You can reach him on his website - www.supergoodmusic.com.

Also went to high school with Dorsky, but am older. Was in the same class as his sister Niki Dorsky. He made mixtapes with this guy Robert Klimek. They called them Ghetto Mix - and they were awesome.

Have not seen or spoken to him in years. He was smart and charming in high school. He is doing better than all of his friends are doing, even if he did get laid off. If I had to bet on him succeeding or failing - I'd put my money on success.

I volunteered with Brandon in SGORR (Student Group on Race Relations). He always went above and beyond what people asked him to do. He was a really good guy and a hard worker. I have confidence he will succeed.

He does legal work for my friends hat company, Grassroots California. I asked the CEO of the company if he thought the guy was a good lawyer and he says the man does everything well. Apparently he just locked up a contract for the hat company to be the exclusive hat designer for High Times Cannabis Cup.

Went to USC Law with Boom D. He always made sure he could fit Coachella into his finals schedule. He opted to do a much longer paper in his last semester as opposed to take a simple exam just so he could go see Prince in 2008.

I find the responses to this article interesting for several reasons.

The first being that the responses are overwhelmingly negative. I have to wonder what kind of person is reading an article about an accomplished and intelligent young professional who has turned his loss of a job into something motivating and successful and finds it to be so aggravating that they need to write something nasty and childish.

I can think of nothing more uplifting than the story of someone who during tough economic times and immediately after losing his job has reinvented himself and is achieving independent success.

This begs the question: are you so unhappy with your own lack of success and inability to make yourself happy that you get pleasure out of knocking down a clearly happy and motivated individual? I have to wonder why you have the time to write something negative in response to this article if you are so much more successful and qualified than Brandon Dorsky.

Which brings me to my next point: If any of the negative feedback had been even remotely intelligent or raised a compelling argument, I might not have felt compelled to comment or I might have even found some truth in them. But these comments are generally childish, inane and uninspired. This paints the picture of an unhappy and unmotivated individual angered at the very mention of the opposite, so much so that they resort to name-calling and superficial insults.

If your ability as an attorney is so superior than the subject of this article, so much so that you feel qualified to comment on it, shouldn’t you be able to come up with something more intelligent than a crack at his hat, facial hair, or his name?

I took several classes with Brandon at USC Law. He was always up on his materials, enthusiastic about learning and seemed to genuinely like law school. I don't think you could derail this guy if you tried - he is just happy go lucky.

I'm about to check out of my biglaw downtown LA office and hit horrendous traffic. What I wouldn't give to wake up and do work from my apartment every day of the week and not have to drive around LA. Even if I make more money than him, my life doesn't seem nearly as fun as his sounds and I probably spend half of that extra money on f'ing gas.

Unfortunately commenter #228, Brandon is not a moron. He already had clients when he interviewed with SAG and SAG was only promising him one year because Pillsbury was going to subsidize his salary. It was 55K to work at SAG for a year with no guarantee of future employment or 3 months severance. What would you do if you already had paying clients? If you say SAG, you're the moron.

It is amazing how quickly commenters lose sight of the substance of the article. This was about someone getting laid off doing something different - and the real question is - was this a smart decision? I think that is yet to be seen. My guess is he probably wouldn't have a job with a big firm though.

Tyler Glover of TRG Sports and Entertainment? Do ATL blog commenters even know who that is? That is T R, the hip-hop artist and producer. He has one of the top dance songs in the world right now - "Give Me Tonight." Brandon is obviously doing something right if he can land a client like that.

While there has been an overwhelming amount of positive comments in favor of Mr. Dorsky, none of these comments seem remotely relevant to what was discussed in the article. Who cares if he throws a good party or has good taste in music or makes an "awesome" mix CD? Shouldn't we only care about whether or not he is marching a path to success? Shouldn't commenters be giving the guy some helpful pointers on how to best navigate through the entertainment law community? If he has not already figured it out, he will soon realize that it is all about who you know and not about what you know. For a boy who grew up in Cleveland, OH - I doubt he knows anyone in the entertainment law community.

Maybe he got laid off because all he did to find work was "send out multiple e-mails a week" searching for billable work. Last time I checked - as a first year, you have to show your face to the partners for them to even know you exist.

I interned with Brandon at ICM in Summer 2006. He always took the time to explain things in great detail and he made sure I knew where the best music in town was. He was such an interesting guy, I based a character off of him in my script.

Entertainment law is about the client and not the type of work. People at my firm represent celebs in criminal proceedings, nuisance actions, all kinds of weird stuff. (And yes sometimes even negotiating contracts -- just like Jeremy Piven on Entourage bro!). Right now this guy sounds more like A&R or a promoter, especially from how much people say he likes music. That's cool, but it ain't lawyering.

Note that virtually everyone who actually knows Dorsky is happy to vouch for him. I too went to SC with Brandon. He's a great guy and knows music back and forth.

I also went to school with Brandon Dorsky and the outpouring of support exemplifies the quality of his character. He is extremely passionate about music and obviously motivated to make something happen. Not many people are brave enough to take the risk - but Brandon is.
