It's not really any property crime since it's not personal property. But even if we consider a SCOTUS position "property," it's not larceny by trick. The joke seems to indicate that she obtained the position by misrepresenting herself somehow. Larceny by trick occurs when a person gains possession by fraud and later converts title. However, the US intended to give her "title:" free and clear right to the job; not merely temporary possession of it. The more appropriate joke would be "obtained by false pretenses," since that crime involves an intent to give both possession and title. Merely because the conduct is "tricky" doesn't make it larceny by trick.
