Breaking: Justice Ginsburg Hospitalized

Ruth Bader Ginsburg cancer surgery.jpgIn February of this year, Senator Jim Bunning predicted that Justice Ruth Bader Ginsburg would be dead in nine months from pancreatic cancer. It was a horrible and tasteless prediction, for which Senator Bunning apologized.

But might he be right? Here’s the latest news about Justice Ginsburg’s health. From the Associated Press:

Supreme Court Justice Ruth Bader Ginsburg was hospitalized Thursday after becoming ill in her office at the court following treatment for an iron deficiency.

The 76-year-old justice, who underwent surgery for pancreatic cancer in February, was taken to Washington Hospital Center at 7:45 p.m. EDT as a precaution, a statement from the court said.

Earlier in the day, she had received an iron sucrose infusion to treat a deficiency that had been discovered in July. About an hour later, she “developed lightheadedness and fatigue,” the statement said. She was found to have a slightly low blood pressure, which the court said can occur after the type of treatment she received.

Although an examination found her to be in stable health, she was given fluids and taken to the hospital as a precaution, the court said.

So this actually doesn’t sound like a big deal. The famously frail justice probably just needs something more to eat. Maybe she can ask her granddaughter, who has good taste in restaurants, for some recommendations in D.C.?

We send Justice Ginsburg best wishes for a speedy recovery.

Update (9/25/09, 3 PM): Justice Ginsburg is doing fine. She was released from the hospital this morning.

Wait a second. If she dies and Barack Obama has to spend political capital to appoint a Supreme Court justice, delaying his other priorities, would he have a promissory estoppel claim against her honor's estate? Would people who die for want of health care reform have a claim? I feel section 90 of the restatement is helpful here, but I'm not sure how.

Southwestern Law makes us memorize all of the names of the Supreme Court judges. I never heard of her before and took for EVAH to remember her name. I passed the quiz though! Score!

Any cancer is bad, and pancreatic cancer, just like Patrick Swayze had, is particularly bad. The 5 year survival prognosis from diagnosis is 5%.

15, if you have to memorize a different name because of an untimely passing, you may have a p.e. claim against either her estate or her doctors. Your damages may be limited, though, since the quiz already passed.

As has been said, pancreatic cancer is one of the worst kinds of cancer. At what point do we start talking about her responsibility to see that she isn't hearing arguments on cases she may not live to decide, and that there is an orderly process to her succession. Obviously there is a right and a wrong way to go about that, but it's still a conversation that should be had.

I go to Ohio State (I know TTT)
But we had her here last year for our symposium, and she is definitely a physically, frail woman. But she is mentally very strong, and I would imagine she has a very strong drive. When her cancer news first broke, we were worried she couldn't attend our symposium, but she did come, and spoke, and attended every panel.
I wouldn't look too much in to this news. I'm sure she'll push through it without any real problems. I don't agree with her jurisprudence, but she is very tough, and I wish her a speedy recovery.

This site just cracks me up.

First the comments make fun of ATL because it was scooped on a breaking news story--as if Ginsburg's clerks should've been calling Elie on the way to the ER.

Then you see this real, concerned story, but you scroll down just a little to see "Girl on Girl Sexual Harassment," followed by a picture of a toddler giving the finger.

You just have to love ATL. NY to 190!

The reason pancreatic cancer is so insidious is because it typically does not show any symptoms until well after it has spread to the point of being incurable. I thought that in Ginsberg's case, the cancer was discovered by chance during surgery for some other procedure (gall bladder or something), and that it was in the earliest possible stages. In other words, a rare instance in which the cancer had not spread and was curable. If that's true, she could live a long time.

If not, she will in fact go the way of The Swayze within the next year.

I will say a prayer for her. I virtually always disagree with her in non-routine cases but she appears to be a lovely person. I hope she stays on the Court 20 more years, if that's what she wants.
