New York State Bar Association Listserv Madness
A couple of days ago, an attorney sent in an email to the New York State Bar Association listserv. Like many people, the attorney was looking for a job. He decided to ask the listserv for some helpful tips:

I’m a Fordham Law School graduate and have an internship working at a small bankruptcy/divorce/immigration firm and also have been doing debt collection in state court and attending 341 hearings as a per diem attorney. I also have an interest in criminal law and litigation and therefore took hands on courses in law school: civil litigation drafting, trial advocacy, fundamental lawyering skills, criminal procedure.
I want a full time position but contract work would be helpful also.
If anyone has any suggestion as to where to apply or what to do please advise.
Everybody tells you to network to find a job in this economy. But what if you don’t know anybody? One can understand how the state bar association listserv could seem like a viable option to a recent Fordgam graduate.
Were the employed attorneys helpful to the young Fordham ram? What do you think?
After the initial email, a couple of other desperate interested attorneys glommed on to the request. It is truly a sign of the times that people are trying to use listservs to get job leads. Those career service professionals are really earning their keep, aren’t they? In any event, after a couple of these requests went out, employed attorneys started offering suggestions:
Query for all non-resident members: I value this list serve tremendously but worry that the multiple recent posts in the nature of resume postings may lead/are leading to a very different purpose for the list. Is there a way to segregate the job search postings sto avoid bogging down the list serve?
That was quickly followed by:
Agreed.The purpose of the list serve is not for job searching, but as a resource for legal questions and referrals. I think that there other services for job assistance and if needed it should be segregated. I think the list serve has worked well and is a great resource.
And then there was even more agreement:

NYSBA should discourage such mails. It should be purely for referrals, partnership,professional networking & legal resources.
Seems to me that “professional networking” was precisely what the unemployed lawyers were trying to do.
Of course, this argument was made on the listserv as well:
If the list serve is to refer attorneys to paying clients, or to send client who can pay to attorneys on the list, then why can’t baby attorneys look for jobs? It is difficult out here now even for established attorneys. Baby attorneys do not have the money to pay for head hunters or professional search engines because they don’t have the money. Most likely the ones that are looking for jobs are the first attorney in their families like I am, and because of that fact they probably have zero contacts in the profession.I have gotten many clients and jobs because I knew someone who could put me in touch with an employer or client who needed my expertise. This was before I ever participated on any list serve.
I say if you can help, then you should, these kids are taking a shot in the long dark of night, hoping and praying that they can get a position so that they can actually practice and start paying down their student loans. We should encourage this practice of job seeking, and encourage job posting.
In deed, on the many other list serves I participate in with other lawyers, baby and established attorneys look for jobs. Jobs are posted for baby and established attorneys as well. People also look for office space, partnerships and experts. Why should this site be any different? If the purpose of the site is to help attorneys, questions, practice tips and oh yes, for referrals, guess what my friends, that referral is a job for some one. Membership should have some privileges.

Fordham Law wasted a potential opportunity. One cannot underestimate the networking power of a well written and targeted email. He shouldn't be asking for a job but, instead, legitimize himself by appearing well-researched and specific in his areas of interests. He should then seek coffee with someone who is experienced in his areas of interest (i.e. an informational). Informational interviews are more conversational, and the mentor can become an advocate for the 'baby attorney'. Then when the old attorney hears of an opening or needs some help, he recalls that wide-eyed youngster he had coffee with that will work his a** off just for a leg in the door. The job opening then bypasses HR and the resume gets put right in front of the hiring manager. If you're the first to see the hiring manager and can sell yourself right, the offer is yours. Hiring managers don't want to waste their time. I was laid off from a great company, sulked for a week, and got my hardcore networking on. I'm first gen college grad but managed to land 4 offers at great companies by doing just that (not wasting time on listservs or job boards but sending out personalized emails and attending happy hours etc.) I signed and hiring managers are still contacting me...

This story reminds me of an associate I had the pleasure of terminating back in 1994. The miserable peon answered a blind ad in the NYLJ that was placed by a firm which was managed by a good friend of mine. Imagine my surprise when my friend called me one afternoon and said: "Did you give notice to Mr. X? He responded to one of our blind ads." That same afternoon I called "Mr. X" into my office and asked him if he was happy at the firm. He replied yes. I then asked him if he was thinking of leaving the firm. He responded with a puzzled "Absolutely not!" I then asked the final question: "Have you ever lied to me?" He responded "no sir, never." I fired him for being a lousy liar. He did get four weeks (reduced from our standard 4 month policy) notice and his name was circulated to all the recruiters and headhunters in the tri-state area. Last I heard, the associate in question was chasing ambulances in Peoria, Illinois. Morale of the lesson: don't air your dissatisfaction of life or career in an open forum. The Fordham chap reminds me of a reformed gambler who badmouths the gaming industry. The pit boses and table dealers are not the problem. You are the loser. Deal with it.

Since you all don't hold back with your criticisms of third-tier grads, maybe you could answer a question I have (and spare yourself the trouble of making pithy "TTT" remarks - I've heard them before):
What is the success rate of grads from schools like Fordham in starting as sole practitioners? It seems to me like this is the obvious solution. If top law jobs depend mostly on prestige and networking (both afforded chiefly by higher-ranked schools), isn't a better solution for this grad to get a small business loan, develop a client base, and build his/her own empire or lateral into midlaw by bringing reliable business? What is the impediment to banding together with some of his/her classmates and starting a small firm doing criminal services in NY/NJ?
I am actually asking honestly because this is important to me. Thanks!

Solo practitioners and folks who form small firms live penurious lives. It is my understanding that the only way you will make a million dollars as a solo or small time lawyer is to invest two million. That being said, go hang a shingle and make a decent living preparing wills, tax returns and some HUD forms for your petty clients' real estate closings.

When the things you say cause harm to others, you've crossed a line. Sitting there and arguing that anonymous comments can't ever destroy someone's career is either willfully ignorant or, worse, maliciously dishonest. They obviously can and do.

The right to anonymous speech has been upheld by most courts that have considered the issue. The most important case in front of SCOTUS was just re-argued, and it is pretty clear that “the highest court in the land” is going to permit speech that does not reveal who paid for it. The internet and the liberty (often “abused”) that it provides, is based in large part on anonymity. The UK libel laws are notoriously restrictive, and have been justly criticized for that reason.

I actually have some sympathy for the complainers on the listserv, and I'm an unemployed recent grad myself. There's a difference between networking and spamming, and I can understand the frustration where a once-useful resource has become overrun with useless, identical "Will anybody hire me?" messages. Most Linkedin groups have the same problem.

The last guy who posted the obnoxious "paint" email on listserv -- I can picture him right now: He's a fat, soft, badling f--k who goes to calendar call every day in NY Supreme wearing the same wrinkled, worn-out piece of s--t suit he bought 10 years ago at Syms. He stinks to high heaven, carries a ripped up, worn out briefcase, filled with papers he has never read, in a ripped up Redweld. He clamours for clients and overcharges the very few he has. He is single and/or divorced, goes home at night and trolls the internet looking for clients (unsuccessfully) and after about 10 minutes, he switches his search to Tube 8 and free p--n. He goes to NYSBA functions for the free coffee and bagels, sweats when he eats and lacks all social skills that normal human beings learned in grade school. He is an outcast in a dying profession and fears that his life is over at 40. It is.
Post that asshole's name and/or email address. In this profession, there should be repercussions for rudeness and laughing at another's plight. I'm part of the listserv in question. I don't like the job seekers' advertisements and ignore them. But I think the REAL problem is w/the idiots who spam the listserv with their "stop this nonsense" and "please remove me from list" e-mails.

In a profession where your reputation really matters, I can't believe that people are so rude on listservs. I also can't believe that bar associations don't use internet forums instead. Much easier to track, and only the topics that interest you end up in your inbox (if you want them there).
This profession needs to start using more recent technology.
I think it is a shame that it has become so hard for an attorney to make a living that we have folks spaming listserves looking for a penny.

As a member of the List Serv I am in total agreement that people searching for a job should not be posting on the List Serv. I end up getting dozens of emails a day as a result of my membership and 99% are a total waste of time as people respond to all rather than directly to the person who posted the listing.
MORE IMPORTANTLY, the NYSBA has numerous job resources available including a way of contacting members in specific areas of interest.
I spent close to two years looking for a job after law school and used these resources as well as those of my law school to find a job. In the end, all of my networking and hard work paid off and I found a great job.
