Edwards Angell Wants Responses to Offers in Three Weeks (or Less)
A couple of weeks ago, news broke that Sullivan & Cromwell was asking 2Ls to make summer decisions more quickly than the NALP rules suggest. You’ll remember that law schools banded together to pressure S&C to change its policy.
Will law schools react as strongly if other firms follow the S&C route? We could be about to find out. Above the Law is able to report that Edwards Angell Palmer & Dodge has made offers for its 2010 summer program. But 2Ls have been told that they have three weeks to decide “or until the summer class fills up.”
The 2Ls we spoke with that have received offers from EAPD are asking if NALP is going to step in and prevent the firm from shortening the deadline. But as we have mentioned multiple times, Jim Leipold, executive director of NALP, has said that “there are no NALP police.”
Sullivan & Cromwell tried to keep its open-ended offer period secret from the general public. In contrast, EAPD is happy to explain why the firm wants quicker decisions from 2Ls.
The firm’s statement, after the jump.
Edwards Angell management isn’t shy about how it is approaching the 2010 summer program. A firm spokesperson explained the decision this way:
Edwards Angell Palmer & Dodge is looking forward to hosting a 2010 summer associate program. We are giving students a shorter deadline to accept or decline their offer, which allows us to interview more students and make offers to more candidates. With many law students looking for jobs in a shrinking market, we thought this decision not only benefited the Firm, but also the law school community. We realize that accepting a summer associate job is a big decision for law students, and therefore we encouraged our candidates to contact us should they need more time to make their decision. To date, no one has expressed any concerns directly to us with the deadline we have set.
It’s not particularly surprising that summers, many of whom want to be first-year associates one day, aren’t complaining “directly” to EAPD about anything. What is surprising is that summers aren’t complaining to Above the Law either. The sources we spoke with had no problem making a decision about where to summer in three weeks.
They were marginally more concerned at having their offer rescinded if the class filled up. But they also felt that a lot of firms are flouting NALP rules; at least EAPD is being honest about it.
And that is probably the right way for 2Ls to approach this recruiting season. Assume disrespect for the 45-day period for holding offers open, and act accordingly.

For the last freakin' time: it's "flouting their rules," NOT "flaunting their rules!!!"
Delaware bar results out today...
its a buyer's market, Jerkie.
Y'all wish you knew what it felt like to be first!

LOL @ NALP. Remember the fear they inspired in students?
Yet another firm I've never heard of. This is about as interesting as your post on "Fenwick."
um... isn't EAPD on the verge of collapse?
6 - Seems to be fixed now.
7 - they just came up. Passed.
Texas bar results out. Everyone passed.
eapd seems to be doing horribly...offer rates have been poor and they have been laying off like crazy for two years now...i wouldnt want to have to accept an offer from them if i did not have to
Wow, I affected change!

DNR: Neither preeminent nor peer.
2Ls, as Elie has said before, Accept Multiple Offers!
Dear 2L,
Shut up. Accept the offer. Pray the firm doesn't rescind the offer.
Best.
WTF does Elie know about anything, 19? Huh? What?
Delaware bar results are out...64% pass is early word..
Walrus beats paper.
Rock beats walrus.
2Ls -
When you get something better/different later in the year, you'll have a decision to make.
Accept the offer. Now.
Minnesota Bar results out today -- pass rate just around 87%
6/17: clever ... you get the benefit of the doubt
May I effect change on 6/17?
Still, well done

EAPD rescinded offers it had made to 2Ls last year BEFORE the summer began, I think around March. Thus, kids who thought they were gauranteed a summer associate and stopped looking for other opportunities got screwed in the end.
My guess, is they know their name is Mud now, and are trying to rope people in and make them commit as early as possible. My suggestion: Take their offer and keep looking for other stuff. They would clearly ax you if they had to.
Just calculated DE pass rate (only 233 sat) = 60%.
Should be happy they got offers - accept them and be greatful!
Although not a peer firm, EAPD gets my support for shortening its response deadline. It's a new world out there (thanks to the majority of voters that cast the wrong vote last November). Firms are not here to coddle kids and conduct themselves for the sake of providing comfort and convenience to law students. It's a buyer's market today and with the oversupply of law graduates, neither law students nor NALP have any power to dictate terms. That is all.
30 - it's "grateful"
Roget again
If you unionize, the firms will have to respect the deadline.
15, I am calculating a 68% passage rate for Texas. Not everyone passed unfortunately.
ditto to 28 - students should watch out for EAPD - last year they left their "summers" high and dry, canceling the entire program in March, when it was too late to accept another offer...
When are people going to realize nobody gives a shit about NALP? It's a joke. Just like 1Ls are supposed to wait until December 1 to apply for jobs, yeah right.
So far no truth to the fear mongering PHJW types foretelling layoffs?
only 233 sat for DE bar and it took them this long to release the results?
I remember the good old days, pre-mtv/internet/blog/twitter, when law students and lawyers were literate. *sigh* The rising generation has little to be proud of. And, sadly, I bet PE would agree with this.
@39:
Well, if this is how the comments are going to be, let me just say that the correct usage is, "they have little of which to be proud."

If you have an offer from a firm, for gods sake take it, IMMEDIATELY!
What kind of economy are you guys living in????
Unless you're a Supreme Court clerk, you must accept your offer immediately.
This news is of no interest to anyone except perhaps law students at Roger Williams, Suffolk, and Western New England.
I interviewed at EAPD some time ago. I remember the partner wearing corduroy pants and the young associates who took me to lunch being a sad, sad bunch.
The math is pretty simple -
(a) if a 2L has a better offer, decline EAPD's offer and accept the better offer;
(b) if a 2L has a better offer and is waiting to hear back from/interview with other firms, decline EAPD's offer and wait to accept one of the other offers;
(c) if a 2L has an interview scheduled w/ a better firm, accept EAPD's offer, then if a better offer is made, rescind your acceptance of EAPD's offer after accepting the better offer;
(d) if a 2L has no better offer, take EAPD's offer.
In this market, I haven't heard of too many people w/ too many offers sitting around anyway.

@40 - Stop bitterly clinging to outmoded language norms.
Winston Churchill, was once corrected by an assistant about ending a sentence with a preposition. Churchill replied:
"This is errant pedantry up with which I will not put."
40: You proved my point. Sad.
If EAPD doesn't follow the NALP rules, why should 2Ls? Accept their offer, continue interviewing, accept other offers if you are lucky enough to get them, then make a decision where to go later. EAPD doesn't care about NALP rules, so it cannot reasonably expect students to care about them either.
Is EAPD hiring laterals?
where is my offer to come back?
33,
If we unionize does that mean I can retire at 50 and live off of a bloated pension and health plan until I am 97?
EAPD is taking acceptances on a first come first served model. Therefore, wouldn't those who have offers respond on the basis of their outlook - the bleakest first?
How many days does it take to suck and swallow? What a fucking joke.
48 - I tend to agree with you except law firms talk. And they'd have no problem trying to ruin your life. And you never know if you'll have to work with them in the future. I say weigh those risks and make a decision best for you, not for them. I was one of those who got an offer this year from them for 2010 summer and am turning it down, but was tempted to take it and wait. But I feel comfortable with my other options, so why bother risking a negative response from them if I turn them down later.
I would only take EAPD if I had absolutely nothing else. They fucked their SA's last summer by canceling the program (no I was not one of them but saw a good friend crushed by it), and even the year before their offer rate was only like 50-60%.
Stay the hell away from EAPD if you can avoid it. I've heard the treatment of associates is pretty bad too, at least on the east coast.

Management seems to make a lot of unpopular choices, but at least EAPD always seems to be open and honest when they do.
Last year's summer class would be an exception, but even that was only 5 or 6 people. They scaled way down from their 30+ group in years past.
Sorry for multiple posts.
58 - doesn't that argument cut the other way...if it was only 5 or 6 students, why bother? How much could it have mattered to bring them in? And also, I think there were more than 5 or 6. Are they so bad off they can't take 5 students? That's scarier frankly.
That's a fair point because it probably does cut both ways. Still, I bet they were more concerned with the other resources and time that goes into a summer program than they were the salaries of 5 or 6 people. A summer makes about $30k, I'm sure they weren't sweating $150-$200k in salary. There's a good argument that any summer program for only 5 or 6 people is wasteful and inefficient from a financial perspective.
@ 58-- they were "open and honest" last fall when they were scaling back their program from the 2008 summer in order to be in a position to make post-grad offers.... Then they cancelled the summer program in March. I would consider not accepting an offer from EAPD, even if I didn't have anything else.
Wow, 62. You're dumb.
That kind of decision-making process will leave you permanently unemployed.
Open and honest? As opposed to the other firms who fired people and didn't tell them they were fired? What do you mean? Because EAPD embraces firing people or having a summer class and then a few months later deciding not to and screwing those summers means that because they announce it and embrace it that's a good thing or is admirable?
EAPD laid off half of their first year class in March, with little severance.
EAPD laid off half of their first year class in March.
DON'T work there. They fired almost their entire first year class this spring, canceled the summer program, and deferred their incomings indefinitely. It was the most disorganized and unprofessional place I have ever worked at. Nepotism is rampant, and unless you are connected, no one gives a shit about you. At worst, accept the offer and continue to look for another position.
60-
They cancelled the summer program in March because they had just laid off a bunch of first year associates and they didn't want to look bad bringing in summers.
