John O’Quinn Dies in Car Accident

John OQuinn.JPGWe wanted to give people an opportunity to reminisce about John O’Quinn, the legendary personal injury attorney, who apparently died this morning in a car accident. The Houston Chronicle reports:

Prominent Houston attorney John O’Quinn was one of two men who died this morning when their SUV slammed into a large tree on Allen Parkway after the driver apparently lost control, police said. …

It wasn’t immediately clear whether O’Quinn or the other, still-unidentified victim was driving.

O’Quinn is a huge name in Texas and around the country. He made his mark in PI work:

O’Quinn, who made his fortune largely in personal injury cases, most notably in successful breast implant cases in the early 1990s, was a local philantrhopist. He gave money to the Harris County Children’s Assessment Center, the Houston Council on Alcohol and Drugs and various Texas Medical Center institutions including St. Luke’s Hospital, which has a tower bearing his name.

As a law student at the University of Houston I am appalled at the vitriol being dished out against a man on the day he lost his life. This man came to the rescue of our school after a tropical storm destroyed our library. This man came to our school every year and spoke on behalf of a friend he lost while he was in law school. This man deserves our respect for his legendary career as a trial lawyer.

When you have an obituary, don't allow people to comment, just as you don't have a link to "comments" when you job opportunities/thank sponsors, etc. Can anyone else who knows about Internet advertising tell me: Does ATL somehow benefit from the quantity of daily commentators--like being able to quote numbers to advertisers and charge higher rates? Aren't ad rates based off of visitors, and can't the number of visitors of web sites readily available? So what do the comments ad in terms of ATL's revenues.

Seriously, you provide valuable information, but when it comes to horriblem gratuitous comments, you are an enabler. I love free speech, but you don't have to give these assholes an anonymous platform to say hateful shit about dead people.

Could we use this as an opportunity to honestly discuss the propriety of criticizing someone after his death? I'm not sure it's so clear one way or the other. Setting aside for argument's sake the comments which are graveyard humor and nothing else, why is it wrong to reflect on someone's legacy at the time of death?

To take an extreme case, would it be in appropriate to note that Saddam was a scumbag until some time passed after his execution? If not, where should the line be drawn, if at all?

Some of you who are crying about the comments on this post should read a few 'Economist' obituaries: it's not all sunshine and lollipops (though none of it is quite so risible as some of the shit here).

As a big-time corporate defense attorney, I seriously recommend that you disable your comments for tragic events like obituaries. If an immediate relative were to read some of the comments, and become emotionally distraught, some money-hungry parasitic plaintiff's lawyer could name you, legitimately, as a Defendant in a IIED (Intent. Inflict of Emot. Distress). I've actually seen a similar situation before. Seriously, people will bring lawsuits about anything, and you knew or should have known that these comments were coming based on past practice. At the very least, I would recommend that you consult with your counsel.

Unlike apparently anyone else on this site, I knew John O'Quinn personally for the past 23 years. To be clear, we are speaking of Houston trial lawyer, John M. O'Quinn killed this morning in a car wreck on Allen Parkway in Houston, Texas. He is not the brother of Quinn Emanuel and I recall that he was the only child from a modest home. He worked hard for his success and helped more individuals, charities, schools and hospitals than your feeble minds will ever know. Many of you only know what the media has fed you and thus will never know the real truth behind this man. Plus, I will guarantee you one thing: You can scream ambulance chaser all you want but if you were the one in need, you would certainly be wanting him to take your case. Those fortunate enough to have been represented by him will never forget this man and neither will I. As posted previously, please remember that there are loved ones stumbling upon this post who do not deserve to see uneducated ramblings about a man you never even had the pleasure of being in the same room with. No, I am not an attorney! Let's also not forget another person died in this accident as well... As a partner in good standing for over 20 years at a V35 firm, I would agree with the comments expressing concern about potential liability for these comments. In particular, without limitation, I would refer to the comments about the Quinn Emanuel firm's founder. False statements about one's death necessarily include false statements about an inability to perform one's profession. That, of course, is libel per se. I have seen this many times in my career. If I were a partner at the Quinn firm, I would have some of my top mid-level associates turn around a memo with the cutting edge research on the issue, including a choice of law analysis.

119, you need to learn about Section 230. All the Mighty Quinn can do to ATL is make them respond to a subpoena giving up the IP addresses of the commenters (and in some comment threads that might prove interesting). ATL has total immunity with regard to the slanderous or otherwise tortious comments of the maroons frequenting the comment section.

That is as it should be. Anyone brain dead enough to pay any attention to anything in this thread couldn't possibly afford Quinn Emmanuel, and so there are no possible damages.

I did not know John O'Quinn, but as a native Houstonian and a current Houston lawyer, I know that he made a significant positive impact on both the community and the profession. This is a tragic loss of a charismatic and talented mand who, at the end of the day, made philanthropic contributions to the community that will outlive him for decades to come. My thoughts and prayers go out to his family, firm, friends, and clients, and I, for one, am in awe of a life fully lived and full of accomplishment. I would be blessed to be half the lawyer that he was. R.I.P., and we will miss you.

Anyone who is familiar with John O'Quinn knows he graduated from University of Houston Law School and has contributed a great deal of funds to that school. The attorney at Quinn Emmanuel graduated from Harvard Law School. You check your facts and stop announcing to everyone what a dumba** you are.

To 122 and others. In my thirty-plus years of V35 partnership, I have had occasion to author or co-author many articles, including many articles on Section 230. It appears that the contemplated litigation would prevail because, and my associates' research would support this, this case would fall within the MCW exception to the qualified immunity. I will be speaking on this topic, among others, at a prestigious conference next Spring in Vancouver. Many partners from other V35 firms will be there.

If he made is fortune on breast implant cases, he was involved in one of the greatest legal hoaxes ever perpetrated. It led to the bankruptcy of major corporations. All based entirely on junk science.

But he gave some money to charity so I guess he was pretty swell anyway.

Saline is cheaper and, at least, perceived safer than silicone. Not seriously disputable.

Safer and cheaper product = more demand. See e.g. supply and demand curve.

More demand = more breast implants.

More breast implants = healthier, happier society.

I am one of the people who knew John personally and cared about him. I find it hard to stomach that people on this site who are members of the same profession - one that is theoretically marked by integrity - have the audacity to say such hateful things about a man on the day of his death. Shameful.

On another note, John was bigger than life. He was a lightning rod, yes; but someone whose success changed lives - lots of them. Most importantly, John recognized the "little" people - yes, his foundation has given money all over the city of Houston, but he also changed lives on the micro-level, finding people in need of opportunities and giving them to him. He was a good man, a smart man, and a man who deserves to be honored on the day of his death. I will miss him tremendously, and the legal community has certainly suffered a great loss.

He gave a lot of money to charity = good

He made most of his money shaking down Dow Corning based on junk science; he bankrupted that company and LOTS of people lost their jobs because of it = bad

He won verdicts for people with very legitimate, serious injuries (or death) = good

He was sanctioned multiple times, in multiple states for unethical conduct = bad

I know from personal experience as opposing counsel in several cases that he relentlessly pursued cases that had absolutely ZERO factual or legal basis = bad

He owned the Batmobile = good

The guy was a mixed bag, like most. R.I.P.

I think there was a scandal involving O'Quinn's theft of plaintiffs' funds stemming from the breast implant litigation. I believe a judge ordered him to return the stolen money, but I never heard anything beyond that.
