The Spanking Judge Gets Off

judge herman_thomas.jpgRemember Judge Herman Thomas? He’s the former Alabama state court judge who was accused of spanking male prisoners, trading favorable treatment for sexual favors, and improperly interfering on behalf of a cousin in legal trouble.

Judge Thomas challenged the charges at trial, and this afternoon the jury returned its verdict. From the Mobile Press-Register:

Herman Thomas has been found not guilty on charges of sex abuse, sodomy and assault. The jury initially returned seven not guilty verdicts on five sex abuse charges, one sodomy charge and one assault charge and reported they were deadlocked on the remaining counts. Judge Claud Neilson dismissed those deadlocked charges against the former Mobile County Circuit Court judge.

Now that’s what we call a “happy ending.”

Libs love to scream "racism" like the little boy in Never Cry Wolf, but they never explain how they've come to their conclusion. So let's break it down:

#3 assumed the jury was "primarily black." That could be true. Alabama ranks 7th of all states in terms of total black population. It is over 26% black. Obviously, jury numbers never match up perfectly to the population, so it's a possibility that #3 is correct; they jury could have been "primarily black." Or he could be wrong. I don't see where the racism is here.

#3 also referred to people of one race sticking up for people of their own race -- despite clear violations of the law -- as "tribal." Members of the KKK also act along tribal lines; they don't consider citizenship a unity-causing element. It's all about the way others look -- just like one would expect from a tribe. Tribalism is described as a "kinship" or "clan mentality" -- the KKK even uses "klan" in it's name.

So is referring to KKK members as "tribesmen" accurate? Absolutely. Does this make a person racist? I would think not.

People who call #3 a racist are simply reactionary, and unthinking.

That is no correct.

A jury finding that the case lacked proof beyond a reasonable doubt is not a declaration of innocense--although both exist under the law.

What I wonder is how all of those spanked in-custody defendants got to the judge's "private office" without being escorted by deputies and where those witneses were at trial.
