Motion of the Day: “We shall meet again you know where.”
Tajudeen Oladiran is an Arizona attorney who is currently of counsel at Aguilera International Counsel. A Biglaw refugee, he spent a year at Greenberg Traurig, as well as a year working for the Arizona Attorney General’s Office.
Given those credentials, we were surprised that he would file one of the craziest motions we’ve come across here at Above The Law.

It is a motion in a case that Tajudeen Oladiran and his wife filed against Suntrust Bank for racketeering. We gather from the motion that Oladiran was not pleased with the ruling by “the Dishonorable Susan R. Bolton” (as she’s identified in the caption). Oladiran wrote: “I just read your Order and I am very disappointed in the fact that a brainless coward like you is a federal judge.”

Can you contact this freak to see what sent him over the edge and caused him to file this motion that, apparently, threatens a federal judge? Has he been disbarred or arrested yet?

It is an appropriate response and my hats off to Taj for having the balls to call the judge out.

What bothers me most about this is that he goes to the trouble of giving his own name TWO defined terms ("Mr. Oladiran" or "Taj"), and then doesn't bother to use either of them in the Motion that follows.
I mean, even if it mattered, I think we could all guess who "Mr. Oladiran" is without having it called out in a parenthetical.

Upon information and belief, the Virginia Banks maintain no offices or banking outlet in Arizona; yet, the Virginia Banks actively seek, and do make mortgage loans in Arizona.
Upon information and belief, the Virginia Bank enjoyed financial gains in Arizona by loaning money to borrowers, regardless of the borrower’s ability to repay. In addition, the Virginia Bank intentionally corrupted the Arizona home loan supply chain (including, but not limited to real estate agents, mortgage brokers, mortgage bankers) by providing a financial incentive for mortgage professionals to attract mortgage borrowers, through any means possible, to borrow money from the Virginia Bank. As explained further in the Complaint, this corrupt system resulted in the mortgages that are at issue in this case.
If I were the Attorney General, I would go after these bank executives under the RICO statutes. I'm sure 99% of the Banks have these shady loans; second, third etc loans to people they have no reason giving loans to; people the Banks know will default.
These loans allow the Banks to increase their loan portfolios, market shares, and executive salaries with gold plated parachutes. If the AGs charge them with racketeering they will be glad to contribute to a stimulus fund for real homeowners. A fund that people who lost their shirts to bad real estate investments fueled by the Banks' illegal generousity can access to get their lives back.

This is clearly a suicide note. Please remove this out of respect for the family. Reprehensible judgment on the part of ATL.
This reminded me of this one old lawyer that I would see around the court. He was a widely respected litigator and solo practitioner. A lot of judges respected him and knew him as an honest guy. There was this one judge that kept on ruling for his opponents for the most ridiculous reasons, and I was there for a few of those oral arguments. At the final summary judgment motion, you can tell from listening to oral arguments that the other side had no case. But the judge made a bench ruling and granted summary judgment against that old lawyer. As soon as the ruling was made, that old lawyer walked up to the judge, pulled out his wallet and threw about $75 bucks in cash at the judge and yelled "is this what you want, is this what it takes to win a case in your court." He walked out, retired and enjoyed the rest of his life.
That is leaving in a blaze of glory.
It's either professional suicide or the real thing. Not the smart thing to do either way.
I just pulled a docket report off of PACER. After this motion was filed, Judge Bolton recused herself and a new judge was assigned.
I guess you can say he prevailed on the motion. What a genius.

It sounds like "Taj" tried to live the american dream by purchasing a home in Scottsdale, AZ that was beyond his financial means. This is a common mistake for newly minted attorneys who feel that passing the bar means they have "made it." Taj probably purchased the property with no money down and incurred an interest only mortgage which he could not afford. Bank tried to foreclose and Taj files a suit alleging RICO, TILA and RESPA violations against the Bank. These types of lawsuits are the ploys of desperate folks. I am sure Judge Bolton properly dismissed Taj's case. And yes, I would construe his last paragraph as a veiled threat against her life.

I am wondering about the lawyers to whom he gave a shout-out in the motion. They are probably far from being pleased at that their persumably private conversation with Taj is made public in a manner that's unlikely to endear them to Judge Bolton.

Speaking only for my state's bar association -- the South Carolina Bar -- it would take its own initiative to seek sanctions once word of this motion leaked. Even if the Judge wanted nothing to do with the sanctions, the discliplinary committee would likely act on this and bring down the hammer.
Here's an idea:
Above the Law: Do some investigative reporting for once beyond the stupuid gossip you usually report and tell us the fallout from this. Is the dude still alive? Why no sanctions? etc.

Judges are not exempt from being forced to testify about their decisions in a civil action; or are you unaware of Dennis v. Sparks, 449 U.S. 24 (1980).

I think this guy has balls. Anyhow, the judge won't be able to prevent the relevant state bar Committee from investigating further. Because some members on that Committee are DEFINITELY going to want to probe further to get the dirt (on both the crazy motion and also possibly the judge's ethics). And BTW, the Committee wouldn't need permission from the particular judge to open an investigation.

Kash - do you have a copy of the federal judge's Order and/or decision supporting it (the one that got Oladiran fired up). From Oladiran's motion, it looks like his lawsuit survived summary judgment because the motion refers to scheduled depositions (he claims out of state banks came into Arizona, loaning money to borrowers who probably couldn't repay and making money in the process; he says that's rackateering.) So if deps had not yet been taken, what did the federal judge do? Was it some narrow issue she ruled upon but it set him off? We should see the Order.

The case already was reassigned to Judge G. Murray Snow when he filed the motion; that is why the file stamp has "GMS" at the end. I don't know if he earlier filed a motion for recusal that caused the new judicial assignment, but his motion that is the subject of this article isn't what led to Judge Bolton no longer having the case.
Below is an excerpt from his first amended complaint. Is it accurate that the mortgagee (Sun Trust) has obtained insurance to cover it in case of the mortgagor/debtor's default? He signed up for a $700K mortgage loan, which was split into two mortgages.
"25. The Bank's racketeering scheme allowed the Bank to make money on the front-end from the Oladirans' mortgage while the Oladirans struggled to pay the Bank (borrowing more money, emptying saving accounts, cashing in 401ks, getting into credit card debt, etc., to pay the Bank); and make money on the back-end by foreclosing on the borrower (as its seeks to do in this case), liquidating the subject real property (as it seeks to sell the Oladiran Home) and the contract (the Loan Transaction) at fire sale prices; selling the remaining debt to scavenger debt collection companies; and COLLECTING THE REST OF ITS MONEY FROM THE INSURANCE POLICY IT BOUGHT TO COVER A LOAN THAT IT WAS SURE WOULD DEFAULT."

If the courts had to expect this sort of occurrence on a daily basis nothing would ever be accomplished. This guy definitely had some other motive for attacking the judge like that. I'm not trying to give Taj any credit here, but SunTrust is a pretty nasty bank. I saw them loan money to a business, and when it went under, they make sure they get paid before the *employees.* In fact, they left the company executives holding the bag on that issue.
