A battle went down the other day on a basketball court at Gregory Gym on the University of Texas - Austin campus. It’s a battle that has been fought across time and generations. It pitted a freshman defensive back from the Texas Longhorns (ranked #2 in the latest Associated Press Top 25 poll) and a UT law student (ranked #15 in the latest U.S. News law school rankings). Who hasn’t been a part of a strong kid v. smart kid fight?
The football player is freshman Kenny Vaccaro. The law student is Jonathon Fuhrman. The Austin-American Statesman takes it from here:
Fuhrman, who is identified as a UT student, told police Vaccaro and his friends were throwing basketballs at him. The affidavit said Fuhrman threw a basketball back at Vaccaro, hitting him in the head.Fuhrman said Vaccaro then punched him in the face. The affidavit stated that Fuhrman, when he was interviewed by police, had blood coming from a cut lip.
Guys at my high school used to throw basketballs at future legal scholars all of the time. Then they would make love to all the women and be treated like gods. But now they all have multiple out-of-wedlock children and/or priors, while the future legal scholars enjoy prosperous careers and fulfilling romantic relationships. It was no big deal.
Will Vaccaro get punished for this? I’ll share some painful childhood memories, after the jump.
In fairness to Vaccaro, can you imagine what happened to the last dork that had the gall to throw a basketball at his head? I bet that kid received a lot more than a bloody lip. Arguably, Vaccaro showed some restraint here.
As for Fuhrman, you kind of have to applaud the moxie he showed by standing up to the big scary schoolboys. I too have been in the position where I’ve hurled whatever was in my grabbable area at athletically superior individuals who were taunting me. Trust me, when you throw something at a bigger, stronger kid, you are not surprised when you are bleeding ten seconds later. One time a bunch of bullies were playing keep-away with one of my 8-bit Nintendo games. I finally got it back after much taunting, and even as I tried to walk away, they kept on me. So I turned around and winged the cartridge right at the mouthiest kid. Caught him right below the eye.
I don’t remember much after that, except being vaguely impressed that the human skull was in fact much tougher than a Nintendo cartridge. But there are some things worth taking a beating for. No single punch stings more than the loss of pride.
Vaccaro, of course, claims that Fuhrman was spoiling for a fight. Does anybody believe that some law student was cruising the UT campus looking to trade fisticuffs with D-I football players? Because I don’t. And methinks a judge — i.e., a former law student — will not believe it either.
But remember, this is Texas. And in Texas justice doesn’t always apply to those that can perform on the gridiron. Longhorns coach Mack Brown is already circling the wagons:
Texas coach Mack Brown released a statement shortly after news of the arrest warrant surfaced.“We’re aware of the situation with Kenny Vaccaro,” Brown said. “We’ve talked to Kenny and his family, and pending the completion of the legal process, we’ll do what’s best for the university, Kenny and the team. One thing we have really prided ourselves on in our program is our family atmosphere, and this will be handled within our family.”
I wonder if coach Mack will be so supportive of Vaccaro when Tim Tebow is running through him in Pasadena next year.
You know what — why involve the authorities in this at all? Life is long, just let this play out. It’s not inconceivable that one day Kenny Vaccaro and Jonathon Fuhrman will meet again — only perhaps next time Fuhrman will be called “The Honorable” Jonathon Fuhrman. We’ll see who wants to throw his balls around then.

I can attest to being on the throwing end of those basketballs, but have managed to escape the predetermined path for high school athletes who beat up on you. Then again, I'm not a minority.

Let's be honest. If you check the records of this football player I am sure you will find priors and problems. I played football in college. The majority of the guys from the "other side of the tracks" had no business being on a college campus. If I were a parent of a freshman girl, I'd be concerned with these guys running around.
The solution is forming minor league football so college football truly reverts to student athletes. Maybe people should look at Stanford as a great example. UT football is full of future inmates for Huntsville prison. . . . .

You may not believe that he was looking for a fight, but any judge who spends 5 minutes with Fuhrman will believe it. Trust me. And I wouldn't put money on this particular law student becoming a judge. Taking Texas over Colorado this weekend would be a much safer bet.
The idea he'd pick a fight with a d-back is, I guess, not completely unbelievable, but the idea he'd pick a fight with him when Vaccaro was surrounded by a group of his friends is just plain stupid.
I also seriously doubt witnesses would have a problem coming forward if what they said would exonerate the defensive back.
If Vaccaro didn't meet and fight with the law student one-on-one (like a man), but needed an audience and a group of people to gang up on him, then the law student would be displaying a sense of loyalty, fair play, and honor (in just shutting up) that Vaccaro obviously doesn't feel the need to display towards him.
The sooner Vaccaro actually has someone punish him for this stuff, the better for him and the rest of society.

As a UT fan, I would have liked to have seen the other football players really go after this law student. The defense really needs to swarm and gang tackle as a unit, and frankly this shows a lack of fire and effort. Coach Muschamp must be disappointed.

In any case, there's no need to make assumptions, this is a pretty big and widely used gym and chances are it has security cameras. So, we'll find soon enough and since they've issued an arrest warrant for Vaccaro instead of the law student (even without witnesses), I'm willing to bet somebody took a look at what's on those cameras.

Well, here goes: for those of you who didn't pay attention in Civ Pro, an affidavit is a sworn statement. Virtually all of the "evidence" anyone here has access to comes from . . . an affidavit . . . signed by one of two people. . . who got into a fight at a college gym. F*** me if I'm wrong, but that's not exactly reliable source material.
As for "witnesses," I'd didn't see any witnesses for either party. Again, no one here knows s***.
And finally, if you are interested in finding Vaccaro's defenders, you may want to look outside ATL - perhaps on the ESPN comments or elsewhere. Say what you want about the postings on that site, but, amazingly, most non-law students do not read ATL.
Alternative Theory After Actually Reading the Affidavit
First, Vaccaro did not seek out a nerdy law student reading Blackstone in the law library. It was a pick-up basketball game and talking smack is part of it. (Elie: think 2L’s arguing original intent vs. original meaning constitutional interpretation over Ovaltine).
Fuhrman said he knew Vaccaro was a football player and “wouldn’t do anything.” Vaccaro does not benefit from making this up, so it seems that Fuhrman was attempting to provoke a fight. Each threw balls at the other and then Fuhrman chucked a basketball from 10ft hitting Vaccaro in the ear (being hit hard in the ear is second to being hit in the groin). Vaccaro smacked Fuhrman causing a swollen, cut lip. Under TX law, both Fuhrman and Vaccaro have committed Assault-bodily injury.
Now the fun part. The incident occurred on 9/20, the affidavit was signed on 9/27, and the arrest warrant was not filed until 10/7. Two and a half weeks is kind of a long time to get a warrant for a simple assault. Considering each has a valid assault claim against the other, I speculate officials had no desire to prosecute two misdemeanors amounting to a stupid courtyard brawl. But I also speculate, based on the timing, Furhman pressed for the warrant to issue and charges to be filed against.
Why would Furhman press the issue? He knows that Vaccaro is a football player and won’t press charges himself b/c that would create much more media attention for something so trivial. Also, the economy sucks and graduation is probably approaching for Furhman. So what does a douche bag law student do to get his name in the TX and national spotlight? Pick a fight with a TX football player on a nationally-recognized team!
Just my own uncorroborated theory. The courts may not unveil the truth, but I bet the TX Board of Law Examiners will when they investigate and re-examine Furhman’s Character and Fitness.

The football player is a fresman (redshirt or not isn't made clear), so he is at the oldest 19 or 20. Mr. law student is at a minimum 23, and quite possibly significantly older (if he is a 3L, he is 25 at a minimum). Mr. law student has the benefit of greater maturity (in terms of biological age at any rate), education and overall life experience. Thus, I would argue that in this instance, where both sides have clearly gotten their panties all bunched up and have contributed to an escalation in inane b-ball hostilities, the burden lies with Mr. law student to think clearly and behave like a rational quasi-adult. An 18 or 19 year old college football player (or ANY testosterone addled guy that age) is neither rational, nor an adult. Unfortunately, Mr. law student instead elected to tag his far more dangerous opponent in the back of the head with a basketball. The result? He got popped in the face. Nobody should face criminal charges for this incident. Nobody should be investigated or expelled or benched. Instead, Mr. law student should put some ice on his lip and use the experience as an opportunity for growth. Mr. football player will hopefully mature somewhat from the negative publicity this whole stupid mess has brought his way, and will vent that frustration on a hapless Oklahoma wideout.

What I don't understand about some people's comments is that you're ignoring the fact that Fuhrmann's team lost a pickup game against Vaccaro's team, and Fuhrmann refused to leave the court. He stared down Vaccaro, and violated the Gregory rules of vacating the court so the next match could begin. And then he struck Vaccaro in the head with a basketball, which understandably elicited a punch.
So those of you equating Vaccaro's behavior to some sort of thuggery or undue violence are obviously completely out to lunch. Vaccaro should have been the bigger person and reported that Furhmann refused to leave the court, but can you really blame the kid for responding to an attack with a single punch?

It's like that CrimPro Supreme Court case where some guy got killed after welching on a bet. I would have voted "not guilty" because there is a code. That code includes paying your gambling debts and leaving the court when your team loses at pick-up.

If it was alright to punch a guy when you get a ball thrown at you, it was alright for Fuhrman to throw a ball as well when Vaccaro did this to him, right?
