Lawsuit of the Day (from Across the Pond): Climactic Noise Pollution

English couple Caroline and Steve Cartwright have a healthy sex life. But it doesn’t sound healthy. According to BBC News, their love-making sounds to neighbors like “murder” and has been described as “unnatural.” So prudish, those Brits.
Neighbors complained the noise kept them up all night, making them oversleep in the morning and arrive late to work.
Apparently Caroline Cartwright is the noisy one in the couple. She was convicted of “breaching a noise abatement notice.” She appealed the conviction:

She argued she had a right to “respect for her private and family life” under Article 8 of the Human Rights Act.

So do the British courts respect a woman’s right to be vocal about her pleasure?


No, that isn’t proper, said the court. The magistrates and recorder overseeing the case rejected the claim that she couldn’t stop herself from making loud noise during sex:

[Recorder Jeremy Freedman] said: “We are in no doubt whatsoever about the level of noise that can be heard in neighbouring properties, in the street and in the back lane.
“It certainly was intrusive and constituted a statutory nuisance. It was clearly of a very disturbing nature and it was also compounded by the duration — this was not a one-off, it went on for hours at a time.
“It is further compounded by the frequency of the episode, virtually every night.”

Who knew having a satisfying sex life could get you into so much legal trouble?
Apparently, the noisy Cartwrights are still at it despite the complaints. Caroline Cartwright has racked up three more violations and will stand trial in December.
The problem for neighbors may be aural and visual. We don’t really want to hear, see, or imagine these two snogging.
