Will the Great Blizzard of 2010 Lead to a Storm of Lawsuits?

3. Lawsuits against the Metropolitan Transit Authority (MTA) by trapped subway riders.

Some 400 people were stuck overnight on an unheated A train coming back from Kennedy Airport. And they weren’t the only ones. Riders on the N, D, and 7 lines were also trapped on stalled trains (although for shorter periods of time).

Might these subway riders have causes of action against the MTA? Perhaps for the always-fun tort of false imprisonment? Recent bar takers, please break it down for us.

Governments have deep pockets, so this isn’t the end of potential liability….
