Does The Equal Protection Clause Require States To Issue Licenses For Same-Sex Marriages?

Intelligence Squared hosts a debate on the constitutionality of marriage equality. Watch the debate live here.

Tonight at 6:30 p.m. Eastern, Intelligence Squared presents a debate on marriage equality and you can watch it streaming right here. Specifically, whether the Equal Protection Clause requires states to issue licenses for same-sex marriages.

Arguing for the god-given rights of states to treat their citizens like sub-humans are John Eastman, the Chairman of the National Organization for Marriage and a Professor at Chapman Law; and, Sherif Girgis, the co-author of What Is Marriage? (affiliate link) — you may remember this book from the time Northwestern’s Fed Soc chapter brought Girgis’s co-author in to speak about marriage and catered the event with Chick-fil-A. With the arduous task of arguing that “equal protection” means “equal protection” are: Evan Wolfson, Founder & President of Freedom to Marry and author of Why Marriage Matters (affiliate link); and, Kenji Yoshino, NYU Law professor, and author of Speak Now: Marriage Equality on Trial (affiliate link).

Obviously, this whole debate will be moot after the Supremes hand down Obergefell, but this is fun while we wait.
