First Undocumented Attorney To Be Licensed To Practice In New York

Cesar Vargas is set to make history as the first undocumented immigrant to become licensed to practice law in New York State. Vargas just found out the good news that NY Supreme Court’s Appellate Division in Brooklyn has approved his application to the New York bar.

Vargas entered the U.S. illegally as 5 year old and grew up here, going on to attend college and eventually graduate from CUNY Law School. After graduation, Vargas went on to sit for and pass the New York Bar Exam.

Vargas has garnered some influential bakers in his quest to become a lawyer. New York State Attorney General Eric Schneiderman and CUNY School of Law Dean Michelle Anderson were among those who testified in support of Vargas’ application.

The determination as to whether an individual who is undocumented can practice law currently varies from state to state. California recently granted an undocumented man named Sergio Garcia a law license, but the Florida Supreme Court has taken the opposite approach, ruling last year that law school graduate Jose Godinez-Samperio was ineligible to practice law due to his immigration status.
