Undocumented Law Grad Faces New Hurdle

An undocumented immigrant who was cleared to practice law in New York now faces a new hurdle. Cesar Vargas, featured in our last news post, has been in legal jeopardy since recently taking part in an immigration protest at a campaign rally for possible Republican presidential candidates in Des Moines, Iowa. Vargas interrupted New Jersey Governor Chris Christie’s speech to ask him if he would be in favor of deporting Vargas’ 70-year-old mother.

Because the rally took place on private property, Vargas was arrested and sentenced to one year of probation for trespassing.

Vargas has said that in addition to the probation, he was also required to pay $650 in fines and penalties.

The judge granted a “deferred judgment” on Vargas’ sentence, which means that Vargas’ record will be clean after his probation is concluded, provided no other offenses are committed in the meantime.

There is technically no rule against granting bar admission to an applicant who is on probation, but it is required under Judiciary Law §90 that all applicants possess the “character and general fitness requisite of an attorney.”

The Second Department says it plans to conduct a review of the circumstances of Vargas’ case before reaching a decision on whether the probation will hold up his admission to the New York Bar.
